Re: Revised Building Permit Survey (07/01/94) for the Aspen Ice Garden Property
Located at 233 West Hyman Avenue, Aspen, CO
After reviewing the original building permit survey conducted for the Aspen Ice Garden
West End Renovation (Alpine Surveys, Inc., stamped James Reser, April 21, 1994), I
requested that the surveyor include dimensions between the existing building and property
lines which he has provided in this revised map. These added dimensions confirm other
pieces of information found in several files related to the Aspen Ice Garden although this
is the only map specifically of the property and the building prepared by a registered
surveyor that I have been able to locate. A copy of the revised building permit survey is
attached to include in your files and an unsigned mylar copy is on file in the Engineering
Department.
It appears that the original footprint of the building (circa 1964) was constructed entirely
within the property lines of Lots A to J, Block 54, Original Aspen Townsite, and that
two (2) subsequent encroachments were created through additions along the north and
east sides of the building. The encroachment along the north side of the building (W.
Hyman Avenue) appears to be 5.00 ft at both the east and west ends of the building as
depicted in the architectural sketch prepared by Pielstick-Rosolack, August 1972. (The
property line lies approximately along the outside flanges of the columns which support
the roof.) The encroachment along the east side of the building (S. 1st Street) appears
to consist of two (2) equipment enclosures added on the building in approximately April
1984 through an encroachment application. These appear to encroach between
approximately 1.8 ft and 4.2 ft into the public Right -of -Way of S. 1st Street.
It also appears that a new encroachment has been created with the renovation of the
west end of the building where the roof eave probably now projects over the property line
since the outside face of the vestibule wall is built in the place of the original retaining
wall, the outer face of which was built approximately on the property line. Although a
survey will not be conducted to determine the extent of the encroachment, this may be

nominally taken as the width of the vestibule eave, approximately 18 inches (+- 1.5 ft) at
approximately 10 ft above the existing ground surface for the length of the vestibule,
approximately 21 _ft.
The height of the original masonry chimney is approximately 29 ft 9 in from the existing
ground surface (scaled from the original architectural drawings). And the peak of the roof
over the skating rink is approximately 25 ft according to George Pucak, Ice Garden
Manager. Neither of these dimensions has been confirmed by survey measurement to my
knowledge.
I hope this additional information is useful in completing the physical property description
of the Aspen Ice Garden as of the completion of the West End Renovation, July 1994.

SUMMARY: The Aspen Ice Garden is being remodeled. As part of this
remodeling a 200 square foot vestibule is being added to the
building. Because this is an expansion of an existing use that
does not increase the net leasable area of the building and is
insubstantial in nature review of the proposed vestibule is a GMQS
Exemption by the Planning Director.

APPLICANT: City of Aspen
STAFF COMMENTS: The Ice Garden was built in 1964 and purchased by
the City of Aspen in 1979. The property was rezoned from R-15 to
Public in 1990 to correct the nonconforming use status of the
property. The Public zone district requires dimensional
requirements to be set by adoption of a conceptual and final
development plan pursuant to the Planned Unit Development process.
However, because the building predates the rezoning to Public and
no substantial redevelopment has occurred on the site, a final
development plan has not been developed or approved.
The building includes the ice ring, lobby, four offices, two
bathrooms, locker rooms, store room, rental office and shop,
mechanical rooms and closets for a total square footage of 27,400
square feet. The vestibule addition is proposed to add 200 square
feet.
Staff finds that the small addition to the building of 200 square
feet is insubstantial in nature. The addition represents a 0.7%
increase in the size of the building and does not change the
character of the building or the use of the building. Section 24-
8-104 A.l.d., expansion of commerical or office uses, enables the
Planning Director to exempt the expansion of a building that is not
considered net leasable area. Although this expansion does add
floor area to the building, stairways and circulation corridors are
not defined as net leasable space. Because the expansion is not
net leasable area, employee housing and parking mitigation is not
required.
In addition, according to the application, a conceptual plan for
remodeling the western end of the building was developed in 1989
but never approved. That design included an extension of the
northwest corner of the building to the retaining wall. Staff
presumes that this conceptual plan was reviewed at the time the
rezoning was contemplated and approved.
RECOMMENDATION: Staff recommends approval of the 200 square foot
vestibule addition for the Aspen Ice Garden as represented in the
revised plans with the following condition:
1. Prior to issuance of a Certificate of Occupancy the pavement
shall be stripped and bollards installed to delineate the
pedestrian walkway in front of the west parking area.

Response to Attachment 2, requirement 5. - GMQS Exemption
This GMQS Exemption Application for Essential Public Services is for the addition of a
vestibule of approximately 200 square feet to the western end of the Aspen Ice Garden
building during re -modeling. The new addition would enclose a portion of the area which
is presently the walkway into the building to provide a better weather barrier for greater
comfort and energy efficiency.
BACKGROUND AND DISCUSSION: The Aspen Ice Garden facility was built in 1964
and the exterior was partially remodeled in 1972 and 1984. The City of Aspen purchased
the existing facility in December 1979. In 1990 the subject property was rezoned from R-
15 to PUBLIC (PUB) to correct a non -conformity between use and zoning which may
have jeopardized future renovation and maintenance of the facility. Because the facility
pre -dates current planning standards, neither a conceptual development plan nor a final
development plan exists for this facility. Current planning standards require both plans
for properties zoned as PUBLIC. No specific standards have been developed for this
facility which has in essence been grandfathered into the present planning/zoning system.
In 1989 at least one conceptual plan was developed for remodeling the western end of the
building with features similar to those in the present design. These include extending the
northwestern corner of the building to the existing retaining wall which is also the limit of
the present proposed expansion. Presumedly this 1989 design (filed in the Building
Department cumulative file) and its dimensions were reviewed by staff for the 1990
rezoning evaluation which was in part supported by the recognized desire to remodel and
expand the floor area of the lobby.

The proposed vestibule addition would add approximately 0.7% "non -leasable" floor space
to the total floor area of the facility. This is less than the prescribed addition which is
considered to constitute a substantial amendment as set forth in the Aspen Municipal
Code Section 7-907.A, Amendment of PUD Development Order, which applies to
property zoned as PUBLIC (per Section 5-220.D). This proposed addition also appears
to meet the other conditions of this first referenced code section to qualify as an
insubstantial amendment since the overall character of the building and use will not
materially change by the addition of the vestibule.
Copies of the improvement survey and architectual plans are attached for your reference
and to fulfil requirements 1 and 2 of Attachment 3 for a GMQS Exemption.
