Regular Neeting
The Aspen Planning and Zoning Commission held a regular meeting on January 08,
1980, at 5:0hPM in the City Council Chambers. Members present were Olof
Hedstrom, Welton Anderson, Parry Harvey, Roger Hunt and Nancy McDonnell. Also,
present were Karen Smith, Joe Wells, Sunny Vann all of the Planning Office,
and Ron Stock, City Attorney, and Jay Hammond of the Engineering Office.

All agreed they had not had enough time to complete the
reading of the minutes. The minutes were tabled until
next meeting of January 22, 1980. Motion made, Roger Hunt,
seconded. All in favor, motion approved.
Karen Smith announced the presentation of the Zoning En-
forcement Officer Resolution is scheduled for January 14,
1980, City Council meeting. Also, the Housing Program
followup meeting is scheduled for January 10, 1980 from
5:00 to 7:00 P.M., and the Housing Overlay is scheduled
for January 14, 1980.
Joe Hells of the Planning Office introduced the Little
Annie Rezoning Request which should be tied to the PUD
and Subdivision Request since the facilities are not per-
mitted in the R15 zone district. ~his is on the agenda
simply to ask that the P & Z formally request a schedul-
ing of a Public Hearing for January 22, 1980. A portion
of the site is to be down zoned from R15 to RR Rural Resi-
dential and a portion would have to be upzoned to R6 for
employee housing.
Roger Hunt moved to schedule a Public Hearing for Little
Annie Rezoning Request which shall be initiated by the
P & Z Commission on January 22, 1980. Helton Anderson,
seconded. All in favor, motion approved.
Karen Smith of the Planning Office asked to consider this
later in the meeting since the parties involved are not
at this meeting as of yet. Olof Hedstrom agreed and asked
to proceed with the business at hand. After a few minutes
of discussion this public hearing was reopened and pro-
ceeded.
Joe Wells introduced the Law Enforcement Facility Rezoning
Request application with two alternatives in this pre-
posal. First is the request on the Oden property, 'Which
is a parcel behind the Mill and Main Building and between
this and Caps Auto Supply along Mill Street. A rezoning
request on that site from "0", Office zoning to "Pub",
Public zoning to accommodate the Law Enforcement Facility.
The alternative is a site on city owned property behind
the Courthouse generally due north of the Courthouse at
the present set of stairs down to the parking area. How-
ever the request by the County has been modified to only
be a request for the commencement of an S.P.A. process
on the city owned site, specifically the portion behind
the Courthouse, dropping the request for rezoning on the
Oden property for financial reasons stated in the attached
memo by George Ochs dated December 17, 1979. Possibly a
land trade potential would be available.
George Ochs introduced his comments on the request to re-
zone the area that is presently zoned S.P.A. to Public
and that area is 17,600 sq. ft. This is the adoption of

the developement plan for that section of the S.P.A. zone,
and that requires a rezoning procedure. The P & Z needs
to approve the developement plan for a Law Enforcement
Facility on this site or the initiation of the process.
Some reconsideration is necessary due to the redeveloping
by the architects of the size of the building and secondly
the financial capabilities of the County.
Olof Hedstrom closed the Public Hearing and considenJthis
an informal discussion arriving at an expression of opinion
from the commission with no formal action to be taken.
Perry Harvey commented he felt there is a lack of required
information to make judgement or give guidance and it
seems to give severe access problem for emergency vehicles
and questions the uses of the proposals.
Welton Anderson agreed with Perry and also questions the
access problems.
Olof Hedstrom agreed with both and commented that the ac-
cess problems can be solved but more needed information
on the total areas usage and requirements is necessary.
He disagrees with the piece meal developement and need to
consider the public use of this site.
Roger Hunt agreed and that process should include the
Galena Street extension.
Nancy McDonnell agreed and felt it is our responsiblity
to get that plan together so that procedure of projects
of this nature can be done.
Olof Hedstrom asked for a motion of an adoption of a re-
solution incorporating the comments of the commission-
members. Roger Hunt so moved, Welton Anderson seconded.
All in favor, motion approved.
Mountain Forge
Parking
Olof Hedstrom stated consideration will be taken informal-
ly due to having the Planning Office presentation and
comments and recommendation come before us for formal ac-
tion, but would here the matters in question since the
applicant is present.
Don introduced the request for variance from
parking facilities for office use and felt since no ac-
tion would be considered at this time, they should wait
and be put on the January 22, 1980 agenda for formal ac-
tion.
TDR Discussion
Ron Stock presented the changes made in the draft of this
Ordinance being: Section 2, paragraph A, line 10, "sub-
section and reconstruction an illegal" should be "legally".
Section 1 was changed, the floor area ratio and not allow
mixed projects. Section 2-11.2 changed saying in order
to have an approval process for the TDR of a lodge, would
have to be approved under Section 24-10.12 and the right
to reconstruct pursuant to the section is nontransferable.
Anytime a conversion to employee housing takes place, a
special approval will be required. I would like to see
included in this ordinance to a time limitation on con-
forming rebuilding uses.

Karen Smith wanted to point out Section 1 changed regard-
ing the internal floor area ratio. The ability for an
application to apply for a 1.5 to 1 floor area ratio is
in addition of the TDR and the 1.25 to 1 bases FAR.
Due to the diliberation on the allowed time span to have
property reconstructed with building permits the added
wording by Ron Stock states; must be constructed within
one year or such later time as maybe under exception of
Section 24-10.12. All agreed.
Sunny Vann of the Planning Office introduced the Blitz II
Subdivision Exemption in the L-2, Lodge Two Zone, on
South Galena Street, Lot 15, Anthony Acres Subdivision
consisting of a new duplex under construction. The Engi-
neering Department recommends approval subject to four
conditions. The City Attorney and the Housing Director
have no objections. The Planning Office recommends appro-
val sUbject to the conditions stipulated in the Engineer-
ing Department's memorandum dated December 7, 1979.
Welton Anderson moved to recommend approval of the Blitz
II Subdivision Exemption, Lot 15, Anthony Acres Subdivi-
sion, subject to conditions in compliance with Engineer-
ing Departments memorandum dated December 7, 1979. Nancy
McDonnell, seconded. All in favor, motion approved.
Sunny Vann introduced the George Hamilton Subdivision
Exemption, Lots K, L, M, Block 26, Aspen Townsite at 540
West Smuggler. One-half of the duplex is owner occupied
and the remaining unit is utilized as a guest house.
The Engineering Department recommends approval subject to
three conditions. The City Attorney recommends approval
conditioned upon the owner/applicant complying with the
notice and option provision and six-month minimum lease
requirement of SEction 20-22 of the Municipal Code. The
Planning Office recommends approval subject to compli-
ance with the stipulations contained in _the Engineering
Department's memo of December 31, 1979 and the notice and
option and six-month minimum lease provisions of Section
20-22 of the Municipal Code.
Welton Anderson moved to recommend approval of the Hamil-
ton Subdivision Exemption, Lots K, L, and M, Block 26,
Aspen Townsite at 540 West Smuggler, subject to conditions
in compliance with Engineering Department's memorandum
dated December 31, 1979 and the notice and option and
six-month minimum lease provisions of Section 20-22 of
the Municipal Code. Perry Harvey, seconded. All in
favor, motion approved.
Nancy McDonnell moved to adjourn the meeting, Welton
Anderson seconded. All in favor, motion approved.
