Regular Neeting Aspen ~lanning and Zoning Commission January 22, 1980 The Aspen Planning and Zoning Commission held a regular meeting on January 22, 1980, at 5:00 P.M., in the City Council Chambers. l1embers present were Olof Hedstrom, Roger Hunt, Perry Harvey, Welton Anderson and Lee Pardee and Joan Klar. Also present were Karen Smith, Sunny Vann, Joe Wells and Jay Hammond of the Planning Office, Dan McArthur and Lou Buettner of the Engineering Depart- ment. Approval of Minutes Olaf Hedstrom asked for a IlDtion on the minutes of November 20, 1979. Roger Hunt IlDVed to table the minutes for further deliberation. Welton Anderson seconded. All in favor, IlDtion approved. Carmissiol1lllE!l1ber Caments The carmission discussed the statis of the Resolution on Law Enforce- ment Facility and IlDtion to table. Joe Wells of the Planning Office stated due to the minutes of the last rreeting not being CCIlpleted in order to prepare the resolution, a request to table until next regular rreeting would be in order. The carmission agreed and Roger Hunt IlDved to table the Resolution on Law Enforcement Facility until the next regular rreeting. Perry Harvey, seconded. All in favor, IlDtion approved. Little Annie Rezoning Request Joe Wells of the Planning Office introduced the Little Annie Concep- tual P.U.D. and Subdivision, Rezoning Request. The Little Annie Skiing Corporation is requesting consideration of Conceptual P.U.D. and Subdivision, and Rezoning of land in the proposed base area as the initial step in processing City applications required under the tenus of the Site Specific Agreement. The Site Specific Agreement is the document entered into April 3, 1979, among the City of Aspen, Pitkin County, the State of Colorado, the u.S. Forest Service, and the Little Annie proponent pursuant to the Colorado Joint Review Process. The applications determined to be filed by the applicant for input into the draft Environmental Impact Statement are the Rezoning request, the Conceptual and Preliminary P.U.D., the Conceptual and Preliminary Subdivision, and the Conditional use application. The Engineering Depart- ment recommends approval for the above conceptual submis- sion subject to the owner/applicant correcting the items 1 to 5 as stated in their memorandum of December 31, 1979, and by addressing the remaining items as stated in the Planning Office memorandum and review of September 13, 1978. The Planning Office recommends approval of the con- ceptual application conditioned on those matters which are of concern. The rezoning should have an established ex- piration date if granted, at which time if construction has not begun, zoning would revert to the present zoning. Bill Kane representing Little Annie discussed and explain- ed and exhibited the existing plans and organizational steps and facts and information leading up to and at pre- sent being acted on concerning the developement and as- pects of construction and concerns from all agencies in- volved and agreements made concerning the matters in question. The commissionmembers felt favor to the project in gen- eral, with concern for the willingness of people to endure the long wait up and back on the skiing premise, and con- cern for the transportation system in this area, and in the area of employee parking and living situations and how these will be taken care of with effiency. CO. - " - RECORD OF PROCEEDINGS 100 Leaves January 22, 1980 Regualr Meeting Sullivan Stream Margin Review Forge Building Special Review Grindley Subdivi- sion Exemption Aspen Planning and Zoning Commission Sunny Vann of the Planning Office introduced the applica- tion for proposed improvements on the single family dwell- ing existing on Lot 1, Block 1, Red Butte Subdivision. A portion of the proposed three-car garage adjoining the existing dwellin~ is within 100 feet of the Roaring Fork River and is, therfore, subject to stream margin review. The Engineering Department has reviewed the applicant's development plan and has determined that the proposed gar- age is located outside of the 100 year floodplain, and recommends approval SUbject to two considerations. The Planning Office has determined there are no designated trails which traverse the property, and therefore, recom- mends approval SUbject to the conditions outlined in the Engineering Department's memorandum dated December 31, 1979. Joan Klar moved to approve the Sullivan Stream Nargin Review on Lot 1, Block ~ Red Butte SUbdivision, subject to the conditions outlined in the Engineering Department memorandum dated December 31, 1979. Roger Hunt, seconded. All in favor, motion carried. Sunny Vann introduced and apologized for not having this information included within the packets but explained due to all the applications being submitted, this was overlooked and requested for a review at this time. The Forge Building located at 230 W. Hopkins in a O-Office district is requesting expansion of the existing building and taking advantage of the density bonus provision pro- vided for in the O-Office zone. Also, this would include two employee housing units at a 1.25 bonus. The Engineer- ing Department recommends approval subject to the onsite trash removal prior to receiving a building permit. The Planning Office recommends approval subject to the appli- cant resolving the onsite trash disposal as the Engineer- ing Department request and to the consideration of said department. Roger Hunt moved to approve the FAR Bonus for the Forge Building application subject to the trash disposal con- cerns of the Engineering Department and the all required deed restrictions be executed prior to the applicant ob- taining a building permit. Welton Anderson, seconded. All in favor, motion carried. Sunny Vann introduced the second part to be reviewed con- cerning the Offstreet Parking reduction application. The expansion proposed would require nine parking spaces and the three for employee housing and the applicant is re- questing this number of required spaces for the Office be six and the P & Z wave the employee housing parking requirements entirely. Roger Hunt moved to allow the reduction of parking to 8 spaces to satisfy the Engineering Department as far as size, shape and location and is reflected by the reduc- tion from 3 to 1.5 to 1 spaces per 1,000 sq.ft. for the conwercial portion of the building. Lee Pardee, seconded. All in favor, motion approved. Sunny Vann requested to table this application due to City Council's adoption of new housing price guidelines and may necessitate changes in our recommendations. FORM 10 C.f.HOECKELB.B.llL.CO. -3- RECORD OF PROCEEDINGS 100 Leaves January 22, 1980 Regular Meeting Astor Subdivision Exemption Law Enforcement Facility Resolu- tion Aspen Planning and Zoning Commission Roger Hunt moved to table the Grindley Subdivision Exemp- tion application until the next regular meeting. Welton Anderson, seconded. All in favor, motion carried. Sunny Vann introduced the Astor Subdivision Exemption app- lication requesting an exemption from the definition of subdivision in order to subdivide a,,'parcel of property located between King Street and Zueen Street in the Hughes Addition. The approximately 45,000 sq.ft. area is to be divided into three lots containing two existing duplexes and additional duples on the third lot. The Engineering Department recommends denial for subdivision exemption and requests to follow full subdivision procedures along with items outlined in their memorandum dated January 15, 1980. The City Attorney concurs with the Engineering Department's recommendation and further recommends approval be condi- tioned on three conditions stated in the Planning Office men10randum dated Januray 18, 1980, and is supported by the Housing Director. The Planning Office recommends denial of the request for subdivision exemption plus the applicant be required to follow full subdivision procedure. We further recomend the initial submission be excepted and approved as a conceptual submission and subject to stipu- lations outlined in the Engineering Department's memoran- dum dated January 15, 1980 and the criteria discussed. Roger Hunt moved to recommend except the Astor Subdivision Exeruption material as conceptual plat material for the purposes of further movement of this project, further moving to deny exemption of strict application of subdivi- sion regulations, however, move to allow an exception of the subdivision regulations in order that they may reenter the system at the preliminary plat phase before the P & z. Conditioned on the three conditions of the Planning Depart- ment's memorandum dated January 18, 1980, as well as the three conditions of the Engineering Department's memorandum date January 15, 1980. Joan Klar, seconded. All in favor, motion carried. Joe Wells explained due to the minutes of the last P & Z meeting were not complete in time to prepare the resolu- tion and asked to table until the next regular meeting. Roger Hunt moved to table the Law Enforcement Facility Resolution until the next regular meeting. Lee Pardee, seconded. Joan Klar moved to adjourn the meeting. Lee Pardee, seconded.
