RECORD OF PROCEEDINGS 100 Leaves June 03, 1980 Regular Meeting Aspen Planning and Zoning Commission The Aspen Planning and Zoning Commission held a regular meeting on June 03, 1980 at 5:00 P.M., in the City Co ncil Chambers. Members present were Olof Hedstrom, Welton Anderson, Roger Hunt, Joan Klar, Perry Harvey and Lee Pardee. Also pre- sent were Karen Smith and Richard Grice of the Planning Office, Attorney's Ashley Anderson and Giddeon Kaufman. Commissionmembers .comments '--., \, Karen Smith commented that she wanted to remind the members of the Lodge Preservation Study Session that will be held Wednesday at 5:00 P.M. in the Chambers. She further stated a few other announcements are, that your Highway 82 Reso- lution will be on Monday, June 9, 1980 City Council meeting to be presented and suggested to have someone from this commission present. The Aspen Institute will also be on that agenda. City Council has initiated several ordinances on for public hearing on July 08, 1980 agenda, involving eliminating a rather superfluous requirement we have had on the books for several years, that any unit that has two baths or more must come in for special review, and is one of those archic regulations we are going to try to delete from the code. It came up due to the Housing Overlay and was deleted from it and now will make the code consistant. A new proposal for the 70/30 GMP exemption is going to come before you and we have had a lot objec- tion that 70/30 based on bedrooms, is overly restrictive and we decided that what we are trying to get is that 70% of the units and then some mix of employee units to be deed restricted to the employee price guidelines but not all of those to be studio units then the free market units to be up to 3 bedrooms, this is objectionable. We are proposing that there be a minimum criteria of 70% of the units, then an average bedroom type as maybe 1.6 bedrooms. Then City Council would like for us to consider employee units in nonconforming lodges and allowing expansion up to that extent and is a change in the Lodge Preservation Ordinance. Finally, COG is planning for another Planning Commissioner Workshop next year. Lee Pardee commented that he would like to thank COG for paying the expenses for us and my impression of the work- shop was very impressive and positive and being able to work with and listen to other planning and zoning commis- sion from other areas and their simular problems and the approaches to solving these is not unique. He felt that when he left the workshop that our Aspen area is not up to par with and is loosing it's place in lodging and resort accommodations and future aspects after hearing and seeing what other ski areas have to offer. Joan Klar agreed with Lee and further stated that she would be more than interested and would like to be con- tacted for any further meetings pretaining to such infor- mation as was discussed at the COG meetings. Karen Smith commented that she and Joe Wells went to the workshop and working with other planner's from around the state will help us in using this information to help us and the program presented was excellant and to be able to exchange ideas is very helpful. Roger Hunt commented that on his trip he conducted a study of transportation systems whiLe in Europe and would like to get involved in some of the transportation solutions. CO. -2- RECORD OF PROCEEDINGS 100 Leaves June 03, 1980 Regular Meeting Forge Building Parking Realloca- tions-Special Review Aspen Planning and Zoning Commission service in Zurich has added an interface with the railway system and about 80% of the train service goes through this point and eliminates problems. Looking down the line with Stapleton we could possibly inject something into that approach to come up with more of a solution to our transportation problems and getting more people up to the ski areas. Due to the fact that our transportation systems are inadequate compared to European systems we need to as a community and a nation to try to solve our transportation problems. Karen Smith commented that there is a specific effort happening on the part of the Colorado Association of Ski Towns, to try to get rail transportation up to these areas. Also, COG announced at their conference that they were pursueing a study for Intercommunity Transportation. Roger Hunt commented that it was brought to my attention that a duplex 1225 Alta Vista appears to be a summer camp operation and if the inspector finds everything al- right then it brings up a question to what our limitations might be in zoning areas. Richard Grice of the Planning Office introduced the appli- cation for reallocation of parking space. This commis- sion granted Design Workshop special review approval pur- suant to the density bonus provisions to utilize the .25:1 ratio bonus provided for in the 0, Office Zone to expand the Mountain Forge Building. The applicant also requested and was granted special review approval for a reduction in the number of required off-street parking spaces. Sub- sequent changes have necessitated the modification of the original development program as submitted. These modifi- cations are significant in scope and impact and therefore require reprocessing of the applicant's original requests for special review approval. The Planning Office recom- mends that the applicant's request for reaffirmation be denied and that a minimum of nine spaces be required, seven for the proposed office addition and two for employee housing. Any approval of a reduction to nine spaces should be conditioned upon a review and approval of the proposed parking layout by the Engineering Department. Perry Harvey moved to recommend approval of the revised development program conditioned on the approval of the applicant's site plan by the Engineering Department and conditioned upon the receipt of Council approval for the proposed employee housing units and conditional upon the execution all required deed restrictions prior to issuance of building permits. Lee Pardee seconded the motion. All in favor, motion carried. Perry Harvey moved to recommend denial of request to 8 parking spaces and recommend reduction to 9, 7 for the office and 2 for employee housing and conditioned on the approval of the applicant's parking layout by the Engineering Department for approval. CO. -3- RECORD OF PROCEEDINGS 100 Leaves June 03, 1980 Regular Meeting Chatmas Subdivision Exemption #14-80 Duvike Subdivision Exemption Aspen Planning and Zoning Commission Richard Grice introduced the Chatmas Subdivision Exemp- tion located at 222 West Hopkins and being a multi- family structure which contains three one bedroom units, one two-bedroom unit, and one five-bedroom unit and one owner-occupied unit. The applicant has proposed to deed- restrict the five-bedroom unit in exchange for the one- bedroom unit which currently falls within the low-moderate income guidelines. The Housing Office has no objection to this proposal subject to #1 and #2 as stated in the Plan- ning Offices memorandum dated May 27, 1980. After some discussion on the problems associated with the health and safety and inspection of said property, the members understood that they could not require for improvements to be made before approving the applica- tion. Lee Pardee moved to recommend approval of the Chatmas Subdivision Exemption, sUbject to conditions outlined in the Engineering Department's memorandum dated May 22, 1980, first two conditions which are; #1 The owner shall revise and resubmit the improvement survey plat to include the following: A) Identify areas an/or structures reserved for common use. B) Location of existing driveways and parking areas. #2. The owner/applicant shall be required to join a sidewalk improvement district if and when one is formed. Also, conditioned on the notice of option and six month lease restriction of Section 20-22 and the imposition of a ten-year deed restriction on the five-bedroom unit as proposed by the applicant, additionally approval is conditioned on the Fire Marshall and Building Inspector's approval. Due to some conflict of policies and the changes to be made of condominiumization the members revised the motion to read: Lee Pardee withdrew his motion and stated the motion is the same except the revision to exclude the comment -"additionally approval is conditioned on the Fire Marshall and Building Inspec- tor's approval." Perry Harvey seconded the motion. All in favor, Roger Hunt and Joan Klar voted nay. Motion carried 4 to 2. Joan Klar seconded the motion. All in favor, motion carried. Richard Grice introduced the condominiumization of the Aspen Leaf Building, basement and ground floor for commercial space and the second floor has been used for both commercial and residential space. The Engineering Department recommends approval subject to the owner/ applicant revising and resubmitting their condominium map to include a number of items outlined in their memo- randum dated May 21, 1980 and agreeing to underground conduit for electrical cables located at the northeast corner of the lot from the basement well to the alley. The Planning Office recommends approval subject to the owner/applicant complying with the stipulations outlined in the Engineering Department's memorandum dated May 21, 1980. FORM '0 C.F.HOECKElO.B.lI:l.!';J. -4- RECORD OF PROCEEDINGS 100 Leaves June 03, 1980 Regular Meeting Red Onion Subdivi- sion Exemption Aspen Planning and Zoning Commission Joan Klar moved to recommend subdivision exemption for the Duvike SUbdivision, subject to the Engineering Depart- ment's ccm~ents in their memorandum dated May 21, 1980 and the underground conduit will be done in a manner that meets the approval of the applicant and the Engineering Department. Perry Harvey seconded the motion. All in favor, motion carried. Richard Grice introduced the Red Onion Subdivision Exemp- tion, which consist of condominiumization of a commer- cial space and there is no displacement issue involved. The Planning Office has included in the packet, the Engineering Department's complete recommendations dated May 21, 1980 and subject to the conditions outlined, and we do recommend approval. Roger Hunt commented that there are four employee-type units on the second floor and we have insufficient in- formation. Ashley Anderson commented that we are not doing anything to the units in question that could not be done anyway. I thought it was office and is going to be used for commercial space. Olof Hedstrom entertained a motion to table this appli- cation pending the use occupancy, rental history infor- mation and clarification and whether long term residen- tial housing for the second floor, for the last 18 months to two years and clarification of the descrepancies in the condominium map and written discription. Perry Harvey so moved. Joan Klar seconded the motion, all in favor. Motion carried. Perry Harvey moved to adjourn the meeting Pardee seconded the motion, all in favor. adjourned. at 6:45.
