Al moved to approve the minutes dated January 13, 1981.
Perry seconded. All in favor. The minutes were approved as
written.

Comments
Roger stated the City Council had approved a lot split that
Planning and Zoning had opposed. He therefore moved that
Planning and Zoning sponsor a Code Amendment to prevent
this type of circumvention of the Code in this manner.
Lee seconded. All in favor, The motion is carried unanimously.
Lee asked Sunny what procedure had been established concerning
Building Permits for conditional and permitted uses?
Sunny said the Planning Office has been working with the
Building Dipartment on this.
Lee also asked Sunny when the Commission could see the Planning
Office's Master Schedule. Sunny said by the end of March.
Alan Richman, Planning Office, stated this item is in response
to a request Planning and Zoning made to follow up on having
Life, Health and Safety inspections required in Condominiumiz-
ation. These inspections would occur prior to the review of the
request by Planning and Zoning. This would be incorporated
into the referral system.
Herb Paddock, Building Department discussed what this inspection
would involve.

a mandatory requirement for condominiumizatiQn within the
City of Aspen,

Alan Richman" Planning Office, stated this application is for
conceptual subkivision approval and mandatory pun review.
The location of the property is Lot3, Sunny Park Subdivision.
The current zoning is R/MF pun. (See Planning Office memo
dated February 10, 1981 for specific referral agency comments).
Gideon Kaufman, attorney representing the applicant, answered
the Planning Office and referral agency comments one by one.
The result of this was as follows:
Olof entertained a motion to exempt this application from
mandatory PUD. Roger so moved. Perry seconded. All in favor
with the exception of Jasmine. The motion is carried.
Lee Pardee moved to grant conceptual subdivision approval
based on the following:
1. the 10 employee units have a high percentage within the
low price guidelines.
2. 10,000 sqare feet leased area
3. Water system implementation be coordinated with the Water
Department.
4. Road right-of-way be dedicated.
5. Applicant participate in curb and gutter improvement (as
stated in the Engeneering Department memo)
6. Understanding that Preliminary Plat RBO will include review

Al Blomquist seconded. All in favor. The motion is carried.
Jack Johnson , Planning Office, stated the applicant is request-
ing conceptual PUD approval for its grocery store use located
south of Cooper Street between Original and Spring streets.
Specifically, the request for PUD approval involves a reduction
of the parking requirements and waivers to the open space
requirements in the NC zone district, necessary for the expansion
of an additional twelve feet of building space into the
existing parking space.
The Planning Offece does not see over whelming benefits occuring
to the City or the general public in the approval of the PUD
application. In the judgment of the Planning and Zoning, should
a hardship exist with this particular property to the effect
that variations to the parking and open space requirements
of the Code are warranted, the following conditions should be
placed upon the approval of the application:
-Engineering requirements as per memo dated February 3, 1981.
Following discussion by the Planning and Zoning Lee Pardee
moved to approve Conceptual PUD with the requirement that
there be 5 additional parking spaces for a total of 38
parking spaces. Also, conditioned upon the Engineering
Department memo dated February 3, 1981, with that #4 being
changed to 38. To waive open space requirements in a plan that
is agreeable to the City.
Welton seconded. All in favor. The motion is carried.
Welton Anderson left the meeting.
After the Planning and Zoning reviewed the Resolution 81-2
they decided to have any-- further changes be approved by
Lee Pardee (in Olof's absence) on Friday February 27, 1981
when he will inspect the new draft. Roger moved to adopt
the amended Resolution 81-2 and, further, to authorize
Lee Pardee to sign the final draft on February 27, 1981.

Roger Hunt moved to adopt this amendment with the Planning
Office's new language, Jasmine seconded,
Roll Call vote unanimously in favor of approval. The motion is
carried.
Perry Harvey moved to adjourn. Joan seconded.
The meeting adjourned at 8,45 P.M.
