The application is submitted pursuant to Section 7-404.B. (and the proposed amendments thereto) of the Land Use Regulations by the Pitkin County Library. Permission for Vann Associates, Planning Consultants, to represent the Applicant was previously provided in connection with the Applicant's text amendment application. Background On February 6, 1990, the Planning and Zoning Commission approved a growth manage- ment quota system exemption to permit a so-called "change-in-use" of the old Pitkin County Library building from public to office use. The GMQS exemption, which was approved pursuant to Section 8-104.B.1.b. of the Regulations, was conditioned upon the provision of sufficient parking and affordable housing to mitigate the additional demand which would theoretically result from the building's change in use. In addition, the P&Z recommended that the City Council rezone the library property from P, Public, to 0, Office, to accommodate the change in use approval. On April 23, 1990, the City Council adopted Ordinance No. 90-15, which formally rezoned the library property to 0, Office. As you know, the parking and affordable housing mitigation requirement imposed by the P&Z as a condition of their GMQS exemption approval was also imposed by the City Council as a condition of the rezoning. The condition stated that the amount of parking required to mitigate the change in use was to be based upon the applicable provisions of the Regulations, and that mitigation could be accomplished via a cash-in-Iieu payment. As the Applicant had previously received an employee credit in connection with the approval of a GMQS exemption for the construction of the new library building on the 230 East Hopkins Avenue' Aspen, Colorado 81611 . 303/925-6958 . Fax 303/920-9310 f"""'.. .~ Ms. Leslie Lamont, AICP April 20, 1992 Page 2 Rio Grande property, the amount of affordable housing required to mitigate the change in use was to be based upon the total number of employees generated by the purchaser of the building. The parking and affordable housing impacts resulting from the change in use were required to be mitigated prior to the issuance of a building permit or a certifi- cate of occupancy for the building. In November of 1991, the Applicant and a prospective purchaser of the library property submitted a request to the Planning Office for a clarification of the building's parking requirement. The Applicant wished to obtain a credit against the required parking mitigation for approximately nineteen (19), off-street parking spaces located adjacent to the west side ofPaepcke Park. Tne purpose of the credit request was to reduce the extent of the parking required to mitigate the building's change in. use, thereby enhancing the marketability of the property. The Planning Director formally denied the Applicant's request for a parking credit, and the Applicant appealed the matter to the City Council for further consideration. While the Council subsequently concurred with the Director's position, they indicated that they would consider other alternatives regarding the mitigation of the library building's parking requirement. As the possibility of a code amendment to address the parking issue was raised by both the Council and the Planning Office, the Applicant is presently pursuing this alternative. An application to amend various provisions of the Regulations pertaining to the City's off-street parking requirements was submitted by the Applicant on February 27, 1992. After reviewing the application, the Planning Office recommended changes to the proposed amendments, which were subsequently approved by the P&Z on March 31. The application is scheduled for City Council review on April 27 and May 26, 1992. While it is uncertain whether the proposed amendments will be approved by the Council, the Applicant has elected to proceed with this special review application on the assump- tion that the amended code language will be adopted as drafted. Review Requirements If adopted, the Applicant's proposed code amendments will allow the P&Z to reduce the commercial parking requirement in the 0, Office, zone district from three (3) spaces to one and one-half (1-1/2) spaces per one thousand (1,000) square feet of net leasable area, and to permit the resulting requirement to be mitigated via a payment-in-Iieu of parking. In addition, the amendments will allow the City Council to further reduce and/or waive the parking requirement established by the P&Z. A further reduction and/or waiver is also subject to special review approval, and is specifically limited to existing buildings for which a .change-in-use. GMQS exemption is requested. As Table 1 below indicates, the existing library building presently contains approximately seven thousand five hundred and ninety (7,590) square feet of net leasable area. Based on the 0, Office, zone district's commercial parking requirement of three (3) spaces per f"""'.. ,-, Ms. Leslie Lamont, AICP April 20, 1992 Page 3 one thousand (1,000) square feet of net leasable area, twenty-three (23) parking spaces would theoretically be required to meet the office needs of the building. As only one (1) parking space is available on-site, a maximum of twenty-two (22) additional spaces, or an equivalent cash-in-lieu payment of $330,000.00, would arguably be required to mitigate the building's off-street, parking requirement. As this require- ment substantially impacts the marketability of the building, the Applicant hereby requests special review approval from the P&Z to reduce the building's parking require- ment to one and one-half (1-1/2) spaces per one thousand square feet, and to permit this requirement to be mitigated via a cash-in-Iieu payment. The actual number of required spaces will be determined by the net leasable requirements of the building's purchaser. The Applicant's request is based upon the physically inability to provide additional parking on-site; and the proximity of the property to the downtown area, an existing RFfA bus stop, and the City's municipal parking garage. As the building's prior library use was more intensive than the proposed office use, the lack of additional on-site parking should have little, if any, adverse impact upon the surrounding area. In fact, on- street parking impacts may actually decrease, depending upon the nature of the building's future office use. The Applicant's request, therefore, is consistent with the special review criteria of Sections 7-404.B.1. and 2., as amended. To further reduce the burden of the building's parking mitigation requirement, the Applicant also requests that the P&Z recommend to the City Council that the required cash-in-Iieu payment be waived pursuant to Section 7-404.B.3., as amended. The old library building is the recipient of a prior .change-in-use" approval, and a valid public purpose would be served by retaining the building as opposed to its demolition and reconstruction. Although the building is not historic, it significantly contributes to the character of the Main Street Historic District. f""""'.. ..-.", Ms. Leslie Lamont, AICP April 20, 1992 Page 4 While no physically ability exits to provide additional parking on-site, sufficient public parking is presently available in the immediate site area to adequately serve the building. The location of a major RFfA bus stop on the property, and the Applicant's prior conveyance of an easement for transit purposes, significantly supports alternative transportation modes. Based on the above, the requested waiver should pose no detriment to the community's public health, welfare or safety.
