ASPEN PLANNING AND ZONING COMMISSION
June 9, 1981
Members present included: Welton Anderson, Perry Harvey, Roger Hunt, Lee Pardee,
Jasmine Tygre, Al Bloomquist
Welton Anderson brought the meeting to order at 5:00 P.M.
Commissioners Comments-
Welton- I do have a comment... it is about Condominiumization of ground units.
Ideas for establishing criteria for renters that if they have lived there for two or five
year, whatever- perhaps they get a fairly genreous extension on thier lease.
People that are renters should be given a chance to be heard.
Sunny- Did you catch the thing in Bradfords newsletter- about the National moratorium on
condominiumization-being opposed because of displacement
Welton- Whether it goes into deed restricted sale or free market sale- it doesn't make
any difference.
Sunny- When we get into the work program- we'll talk more about Condominiumization.
1st item of new business: EPICURE PLAZA SPECIAL REVIEW OF PARKING AND EXCEPTION OF
EMPLOYEE HOUSING
Jack Johnson- This is an application that came before P&Z recently to look at condominiumi:
zation to look at thier proposed Epicure Plaza Building into twenty commercial, office
and residential spaces. P&Z recommended approval of that condominiumization application.
It went to council, council is holding thier decision on that matter until the
matter before you this evening comes to them. This is an application to requesting
special review of both parking and the exception for thier employee housing unit~.
When the commercial GMP allotment was granted in 1979 for the 10,041 Sq. ft. of commercial
space associated with that was the residential component which needed a plate for
subsequent approval for exception for the GMP process, which is set forth in that City Code
provided it is restricted to low-moderate income housing. It is an eligible exemption.
The applicant is before P&Z today to request thier consideration of both the exception
of GMP for the three employee housing units and a request that no parking be imposed
on those three units. The Engineering and Planning Offices both have concerns that
as we continue to exempt the housing component within the CC district from the associated
parking needs that eventually we are going to have alot of parking problems insome of
the surrounding residential neighborhoods that do not enforce a restricted parking.
The Planning office has and still does support the Auto disinsement policy.
The condominiumization that was looked at and recommended on by City Council did have a
condition for the employee housing unitsin this application, suggesting a deed restriction
at middle income level, six month minimum leasesand two short
Council has yet to act on those recommendation or those conditions. We are looking
at the issue of exceptions and GMP for employee units, waiving the parking and if it is
still connsideraded appropriate for the middle income level toa pply.
Roger- Why didn't we get this part of the application with the previous portion?
Jeff Sachs- It was my oversite; however, on the other hand, after having looked at it
with respect to a commercial growth management allotment the code is deficient and
ambiguous as to this type of special review. For example, most importantly, the thing you
look at very carefully, which is the income levels to be applied to employee housing;
the specific code provision that has been used to bring that before you for this type
of special review is in fact drafted so that only applies to residential GMP applications.
and not to commercial and not to Lodge. If you intend to review all three types of housin:
there ought to be a code amendment to that specific section.
Sunny- This project is GMP appli cation dates back to 1979. You should know you must
receive development of lot prior to receiving subsequent prior approval.
Jasmine- The top floor of the Epicure building did have employee units previously
are those still in exixtence.
Michael Solheim- Yes we still have employees living there.
Jeff Sachs- This is being built on the adjacent lot.
Welton- This is not a public hearing
Roger- I don't recall how I voted on this but I think I am in favor of low income housing
Perry- Low as a consideration of waiving the parking.
There is no parking requirement in CC is there for residential?

Sunny- The code has been amended to the point that it is not complely clear.
We are looking at aprocess by which you get a more accurate recommendation from your
Housing Office, as to the appropriate designation. The way the guidelines are set up now
they esxillate with the new constructioon costs each year, therefore, we want low every thin:
That situation is expected to change.
Perry- Do you know what our total to date in terms 0 f approvals on low and moderate
housing units?
Roger- Some have been moderate.
Lee- What is the criteria to be used to determine whether it is low or moderate.
Sunny- It is a recommendation of the Housing office at this time.
Perry- Do you have what these would rent for?
Jack- This is a fairly close guess-- 42 on low 53 on moderate and 62 in the middle.
Jeff Sachs- There are two studios and a One bedroom The total is $1900.
Michael Solheim- $1959
Sunny- The way GMP is set up... we use the guidelines for which theywere proposing for
giving applicants points.
ll1e!ton- What are these units being used for?
Jeff Sachs_ They will be used as rental units with the first right that we put tenants in
who are employees in that building.
Sunny- Interestingly enough The idea of producing for sale units will not be that
far from one aspect of the current demand.
Roger- If I move it will be with the exception of the parking requirement,
Jeff Sach-- No way, we can't do it. The construction loan application is in based on
the allotment that has been granted. The Code that you are acting under does not
provide for this special review. We would like to see the code corrected.
Michael Solheim- We have been trying to secure financing, which is about a years work
and this has been based on the projection or rather the GMP acceptance by the City.
These are the figures that have been used. To change them now when we are virtually
ready to start is asking an awful lot.
Sunny- I an not sure that I agree, there

Sunny- No. ... all applications are written based on obtaining subsequent approvals.
Welton- P&Z & Council scored and approved based on the applications presented to us.
Jeff Sach- There are going to be three very, very nice units located on the top floor
of a new building- those will rent for slightly over $400 per unit under the middle
income guidelines. This is very fairly priced employee housing under middle income
guidelines.
Lee- What is Sale price
Jeff Sachs- If they sale at middle income the sale price is &83.00 a foot. 50,000 for
a studio in the heart of ASPEN.
Perry- Sunny do we have anything in there that deals with untilities or additional charges
on these units?
Sunny- There is no way to anticipate.
Welton- Can we get a consensus here.
Jasmine- Based on whatSunny said I don't think that it might be in our judgement...
specifically on our approvals for residential units in commercial applications where it
hasn't been as specific as we might have wanted it, because of our scoring as to the income
levels where they have to adjust to the upward or downward.
Lee- I disagree -- I would very much like to see it low and i will continue to push
low, but I remember that coming through and I remember them saying these are middle
income units, which I didn't like at the time and I think people scored appropriately
and if it got its allocation I think there is reliance and should be. We shouldn't
be changing policy now and an applicant when we voted two years ago differently.
