Special 'Meeting Planning and Zoning commission July 28, 1981 Chairman Hedstrom called the meeting to order at 5:00 p.m. with members Welton Anderson, Roger Hunt, Joan Klar, Lee Pardee and Jasmine Tygre present. Richard~Gri.ce L .pl.:i'!:!l.ning office, said P &'Z reviewed Aspen Ski company's snow making plans in 1978 for 8040 greenline review and approved it. Grice said when construction for the pumphouse began, the Ski Corp discovered a 12 inch city water main. It is essential to maintain 5 feet of earth above the water main so that it does not freeze in the winter. Grice said the proposal raises the structure 3 feet above the original grade. To compensate for this, the Ski Corp has offered to backfill the site around the building, create a berm and restore it to its original contours. Grice said the staff feels this is an improvement over the original proposal and recommends approval. Hunt moved to approve the 8040 greenline review for the additional height of the Aspen Ski Corporation snowmaking pump house as being insignficant in deviation from the previous approval, seconded by Ms. Tygre. All in favor, motion carried. ASPEN MOUNTAIN PARK - preliminary plat Submission Ms. Tygre stepped down. Alan Richman, planning office, said this specially planned area is 515,000 square feet. P & Z reviewed this conceptually in May and recommended approval to Council. Conditions include making sure the parcels front on public or private streets, try resolve issue of the road in parcel C, upgrading sewer, gas, electrical systems, not creating a substandard parcel in parcel E, streets will be privately maintained, dedication of rights- of way; access easement for third access into the trailer park. Richman said during preliminary review, some problems have been run into. One is the applicants intent to create individual lots in parcel C, which are not allowed by Code, and that modular homes are not allowed, and that parcel C could not be zoned MHP. The building department requested a total improve- ment survey for the park. The alternatives are one - building a multi-family structure in parcel C of 26 units in five buildings, which is not being considered tonight. The other alternative is new trailers on parcel C of 17 units on 3,000 square foot minimum lots. Richman said this area is zoned SPA, which is nothing specifically but to look at the entire site and to adopt a precise plan. The precise plan establishes density, setbacks, open space and does give flexibility to vary from Code provisions. The permitted and conditonal uses are established for the property. Adopting an SPA is a comprehensive planning process. Richman said the two parcels, the existing mobile homes and the new area, should not be separated in the process. Richman said the purchasers of these units will be qualified by the housing authority to be a legitimate employee of the community. This will preserve this as employee housing. Richman said the new units should be deed restricted to low income guidelines or at the very outside, moderate. Richman said as part of the settlement agreement, the city has given Aspen Mountain park the right to 19 free market units and to enact legislation to enable this. The 17 new mobile homes will be used in the 70/30 to create 7 free market units. The other 12 free market units are to come out of the 90/10 and this cannot be gotten from the existing trailers. The staff has come up with 85/15 to meet the settlement agreement. Richman said Council generally exempts low and moderate units from the park dedication fees. If the new units do not fall into these guidelines, they should not be exempted from the park dedication fee. The water department is requesting the applicant participate in the construction of the water main. This is a request to condominiumize the 17 units in the new area. The staff recommends approval with 16 conditions. The homeowners want to correct these violations. Hedstrom said the P & z is concerned about health and safety and that these violations get corrected. Richman said the rental restrictions should be as outlined in Brooke Peterson's memorandum for the existing units. Hedstrom, Anderson, and Hunt agreed. Richman said the new units are to be deed restricted to low income guidelines. Peterson said the applicants cannot agree with this. Hedstrom said the Commission is unanimous in wanting this low income. Conditions 8, 9, and 10 were agreed upon by both city and applicant. Richman said condition 11 is the payment of the park dedication fee for the new units. If the units are dedicated to low income, the staff would withdraw this condition. The applicant will be paying for an 8 inch water main, and the city will pick up the difference to install a 12 inch water main. The last two conditions regard easements and are agreed upon. Hunt said he would like the new part to meet every aspect of the mobile home code. Ferrel said this area is zoned SPA, not MHP. They have lowered the amount of trailers and have gone as far as possible. This has met the major requirement of having 3,000 square feet per dwelling. Pardee, Anderson, and Hedstrom agreed to let it stand as it. Pardee moved to approved the Aspen Mountain Park preliminary plat submission and to recommend to Council to approve the request to condominiumize the 17 new mobile homes, exempt them from GMP competition, adopt the plat as the precise plan for the site, include zoning for parcels A and C, and R-15 of parcel D subject to the conditions outlined in the planning office memo of July 23, 1981, as amended during this discussion, seconded by Anderson.
