Regular Meeting planning and zoning commission August 18, 1981 Chairman Hedstrom called the metting to order with members Perry Harvey, Roger Hunt, Jasmine Tygre P & Z requested that the floor area ratio proposal be brought back to them. Hunt moved to approve the minutes of February 10, 17, 24, March 3, and 17, 1981; seconded by Harvey. All in favor, motion carried. PROPOSED CODE AMENDMENT - Residential GMP Alan Richman, planning office, said the Board has outlined some areas that need changing and clarification. These are reorganizing categories; alter points; change the employee housing sections. In availability of public facilities and services, the categories have been changed from 7 to 6 and from 3 points each to 2 points each. In availability of social facilities and services, there were 7 categories 2 points each. Police protection, child care facilities, recycling, and handicap features were not felt to be relevant to evaluation of residential GMP projects. This has been divided into two categories; quality of design with five categories at 3 points each. This includes neighborhood compatibility, site design, energy, trails and green space. The other category proximity to service, including public transportation and community commercial facilities at 3 points each. The provision for low, moderate and middle income housing has not been changed. provision for unique financing has been left unchanged. Previously, the bonus points were 20 percent of categories 1, 2, and 3 for a maximum of 15 points. The bonus points has been lowered from 15 points to 7 maximum points. Richman said neighborhood compatibility is specifically size, height and location than building materials and architecture. Trails and green space have been separated Harvey questioned the possibility of providing "trail links" within the urban area. Hedstrom opened the public hearing. Gideon Kaufman agreed with Harvey on the trails issue. In his previous experi- ence, no urban application has been able to provide trails. This seems like a wasted category. Bil Dunaway questioned the word "usable" in the open space category. Richman said the intention was to make sure the open space was not isolated bits and pieces. The commission requested this language be clarified. Richman said if there is a project with a possible trail link, the applicant should be awarded for providing that link. If the link is eliminated, the trail possibility is lost. Hunt requested Richman add "where feasible" Kaufnan said there have been problems scoring the phrase "project in and of itself improves the quality of service in a given area". Richman said the difference between the score of 1 and 2 are improvements to the project itself and nothing else versus improvements which make a difference for the neighbor- hood. The Commission said they felt they could tell the difference and score a project accordingly. Kaufman pointed out that RBO projects will be discour- aged with this scoring for points for trails and open space. Hedstrom said there should be a balance, and the Commission should have the opportunity to mark down projects with no open space. Richman said the RBO section does have criteria to meet. Richman said the proximity to services has been rewritten, points have been changed to 1, 2, 3, instead of 0, 2, 4. The basis for the points has been established at two blocks and six blocks, with 1 point for further than six blocks. Richman told the commission that provision for housing is the same with the added definition of displacement of employee housing. The section also outlines the policy of counting the ratio of bedrooms per free market to employee bedrooms or floor area ratio, whichever ratio is less is the one that governs the points. Kaufman said the scoring is weighted too heavily for providing employee housing. The Commission agreed this is a flexible process and can be re-examined in the future. Richman said he will bring this back to the Commission in resolution form to forward to Council. Hedstrom closed the public hearing. SKIER'S CHALET CONDITIONAL USE EXPANSION - Colette Penne, planning office, told P & Z this is a request to expand the restaurant at the Skier's Chalet, which is a conditional use in the L-2 zone. The structure is 4400 square feet, the first and part of the second floor is used for restaurant. The rest of the second floor is housing and storage. The third floor is rental lodge rooms. The proposed expansion will add 1100 square feet of restaurant and storage space. The building is a non-conforming structure, does not satisfy setback require- ments, and encroaches in street right-of-ways on two sides. The specified parking spaces are in absence. ~s. Penne said even with this addition, 54 per cent of the parcel will still be open space. The historic boat tow and lift are also located near. The planning office recommends approval of this request with a condition of formalizing the parking agreement with the Skiing Company. Hedstrom opened the public hearing. John Dolensick, adjacent neighbor, told P & Z these people are excellent neighbors and he supports the expansion. Peter Forsch, representing the Aspen Skiing Corporation, support the request for expansion and told P & Z they would continue the parking arrangements from the past. Hedstrom closed the public hearing. restaurant Hunt moved to approve the conditional use expansion for the Skier's Chalet/on lots 12, 13, block 8 Eames addition conditioned on the informal parking arrange- ment with the Skiing Corporation; seconded by Harvey. All in favor, Motion carried. AMENDMENT TO HEMMETER 8040 GREENLINE - Alan Richman, planning office, said this is an improvement over the previous review. The decking has been reduced by 1300 square feet; the roof line has been lowered. The structure fits the mountain to a better degree. The fire access problem has been helped by this change. Hedstrom congratulated the applicant for responding to the concerns of the P & Z in a very satisfying design. Hunt moved to approve the Hemmeter 8040 greenline amendment; seconded by Harvey. Hunt said the conditions on this approval are the same as on the original approval. All in favor, motion carried. PROPOSED CODE AMENDMENT EXEMPTION FROM GROWTH MANAGEMENT PLAN 85:15 Harvey and Tygre stepped down; therefore, this is no quorum. This will be brought back at the next meeting. FAIRWAY SUBDIVISION EXCEPTION - Colette Penne said the building inspector has some problems and requests tabling. Hunt moved to table the Fairway subdivision exception to the next regular meeting; seconded by Harvey. All in favor, motion carried. BYERS III - USE DETERMINATION - Colette Penne said this is a request for an interior decorator office at 633 West Main and it should be made clear there is to be no retail sales. This is to be an office with samples. Hunt moved that an interior decorating office is an appropriate use for the 0, office zone at 633 West Main street with the understanding it will be primarily wholesale operation and not used as retail; seconded by Ms. Tygre.
