AN ORDINANCE AMENDING DIVISION 3 ARTICLE III OF CHAPTER 23 OF THE
MUNICIPAL CODE OF THE CITY OF ASPEN, COLORADO, ENTITLED "WATER
RATES AND CHARGES "( AND THEREBY AMENDING ORDINANCE NO 3-1983
SECTION 2 ) SETTING FORTH A PROVISION FOR DEALING WITH HARDSHIP
CASES BY ADMINISTRATIVE MEANS, AND SETTING FORTH A PROVISION FOR
DEALING WITH QUALIFIED SENIOR CITIZENS BY ADMINISTRATIVE MEANS.
WHEREAS, the City Council finds it necessary to expand the
definition of a hardship case pertaining to water rates specifically
to include senior citizens with limited financial resources; and
WHEREAS, if a verifiable hardship exists and upon the
approval of both the Finance Director and the Water Superintendent
special billing arrangements may be made for such hardship cases;
and
WHEREAS, the City Council also desires that water charges be
as low as possible to hardship cases, particularly as to senior
citizens whose financial resources are limited; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
That Division 3 of Article II of Chapter 23, of Municipal
Code of the City of Aspen, Colorado (and by implication Ordinance
3- 1983, Section 2) be and hereby is amended to read as follows:
A. That a new section 23-102 (d) be added to read as follows:
(a) With respect to the water bates and charges contained
in section 23-101 and 23-102, :above, in case of
verifiable hardship and upon the approval
of both the Finance Director and the Water Superint-
endent, special ~illing arrangements may be-made.
Further, any senior citizen who applies to the City
Finance Department for lower water rates, and
who generally meets the guidelines followed by the
Social Services Department of the State of Colorado
for ~opleonold age ~nsion or such other guidelines
as the Finance Director and the Water Superintendent
may establish, will have their water rates adjusted
as. follows: flat rate residences (Section 23-101)
will have the 100% penalty surcharge removed from
their account. Metered residences will be charged
only their minimum metered rate (Section 23-102,
above) determined by the location of their
residence.
The verifiable hardship and senior citizen rates contained
in Section 1 of this ordinance shall become effective as of
AUgUSt 15, 1985.
If any section, subsection, sentence, clause, phrase or
portion of ~is ordinance is for any reason held invalid or
unconstitutional ~ any court of com~tent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining ~rtions.
A public hearing on the ordinance shall be held on the=~~
of ~~ , 1985, at 5:00 P.M. in the City Council
