AN ORDINANCE REPEALING AND REENACTING SECTION 22-12.1 OF THE A~PEN
MUNICIPAL CODE PROVIDING FOR THE WAIVER OF PARKING LIMITATIONS AND
THE ISSUANCE OF PARKING PERMITS
WHEREAS, the City Council deems it to be in the best interest
of the City of Aspen, its inhabitants and visitors to repeal and
reenact Section 22-12.1 of the Municipal Code of the City of Aspen
to facilitate the issuance of special parking permits.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 22-12.1 of the Aspen Municipal Code is hereby
repealed and reenacted to read as follows:
"Sec. 22-12.1. ~a__iz~_9~_Ra__r~!~ limitations.
(a) All vehicular traffic is prohibited within the pedes-
trian mall (as defined in Ordinance 20, Series of 1973)
and within Alley 89; provided that the chief of police
may permit service and delivery vehicles, vehicles of
medical personnel and of those desiring access to pri-
vately-owned parking areas, to enter into areas of the
pedestrian mall and Alley 89, and to park therein, for
such periods and under such conditions as he may deter-
mine (taking into consideration the need for such ser-
vices, deliveries and access, the level of traffic con-
gestion within the area, and the public safety).
(b) The provisions of subsection (a) to the contrary not-
withstanding, all fire-fighting equipment, ambulances,
police vehicles, other emergency vehicles, private vehi-
cles carrying the injured or ill, public vehicles, and
public utility vehicles may enter into the pedestrian
mall and Alley 89 and park therein when necessary to
render medical, police, utility or other public ser-
vices, or aid to an injured or ill person, but only at
such times, and for such periods as necessary to render
such services.
(c) The police chief shall issue parking permits waiving
parking limitations under the following conditions:
(1) Medical Personnel Physicians and operating room
personnel who are required by Aspen Valley Hospital
to maintain "on call" status shall be issued per-
mits allowing a waiver of timed parking limitations
within Aspen. These permits shall be renewable on
a yearly basis.

(2 Handicapped Persons - Temporary permits waiving
timed parking limitations shall be issued to per-
sons requiring limited body movement who are
employed in a timed parking area. Written verifi-
cation of these conditions must be submitted by the
person's physician ~ employer. These permits
shall be valid for the duration of the handicap.
(3) Senior Citizens - Permits waiving timed parking
limitations shall be issued to residents of the
City of Aspen 62 years of age or older. A valid
Colorado driver's license shall be required as
proof of age and residence.
(4) Service Vehicles - Permits waiving timed parking
limitations shall be issued to service vehicles
that require extended parking in timed parking
areas. The permit shall extend the timed limit to
two hours beyond the posted limit. A City of Aspen
Business License shall be required. These permits
shall be renewed on a yearly basis.
(5) Construction Vehicles - Permits waiving time park-
ing limitations shall be issued to the general con-
tractor for the duration of construction activity
within a timed parking area. A maximum of five (5)
permits shall be issued. A City of Aspen Business
License shall be required.
(6) Official Vehicles - Federal, State and local
government officials who are required by their
employer to use their private vehicles on official
business in timed parking areas shall be issued a
permit waiving timed parking limitations. These
permits shall be renewed on a yearly basis.
(7) Delivery Vehicles - Vehicles used to make regular
deliveries of goods to businesses in Aspen shall be
issued a permit allowing parking in loading zones
during expeditious loading and/or unloading. A
City of Aspen Business License shall be required.
These permits shall be renewed on a yearly basis.
(8) A processing fee of $20.00 per permit transaction
shall be levied for all permits, excepting those in
subsections (3 and (6)."
Section 2
If any section, subsection, sentence, clause, phrase or _por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional in a court of competent jurisdiction, such portion shall
be deemed a separate, distinct and independent provision and shall
not affect the validity of the remaining portions thereof.
