ASPEN PLANNING AND ZONING COMMISSION
REGULAR MEETING FEBRUARY 16,'82
The Planning and Zoning Commission met on February 16, 1982 for a regular
meeting at 5:00pm. Members present: Olof Hedstrom, Roger Hunt, Lee Pardee
Jasmine Tygre, Pat Falin and Al Blomquist.
COMMISSIONERS' COMMENTS - Roger Hunt has two comments to make; first of all
he calls attention to the fact that the "City Used Car Lot" is back in use
again at Cemetery Lane, secondly Roger heard that there is a development
proposal going on at the Truman property. Roger checked the PUD Plat and
evidently the Plat did not include what the Planning and Zoning Commis-
sions comments were concerning that property.
Alan Richman, of the Planning Office, said that if this item did come to th
Planning and Zoning Commisssion it would come under the GMP and the
Commission would have quite a bit of jurisdiction.
Olof Hedstrom asked for comments from the Commission on whether or not they
are in favor of a Planning and Zoning informal discussion of objectives
in response to the Planning Office work program for 1982.
The Commission members are in favor of the informal discussion. The
meeting will be held at Welton Andersons residence at 5:30 pm on March9,'8;
Olof Hedstrom raised tha question about a simpler method of improving the
minutes. Olof asked the Assistant Attorney if there is some other way to
take the load off the Clerk's Office.
Gary Esary said that there are several specific uses for the minutes;
he reads section 20l0B4C which provides if the commission disapproves of a
Conceptual Subdivision Plan and the applicant isn't present,the Commission
isrequired to send a copy of the minutes to the applicant. Gary said that
it is the Attorneys' recommendation that the minutes be kept essentially
the way they are now. Gary said there is obviously a simple, practical
way to reduce the burden on the Clerk's Office - that is to have shorter
meetings.
Alan Richman said that the Planning and Zoning planners tend to not para-
phrase enough and not summarize enough of the memos regarding applicants
request. In the future the Planning Office will introduce the memo into the
public record rather than reading the memo.

at 5:00 p.m.

OLD BUSINESS - Red Onion Subdivision Exception (Condominiumization) and
Exception from GMP for Conversion of the Space of Unit #3.
Colette Penne, of the Planning Office, said that the Planning Office check
the GMP inventory and it did indicate that the use of the space is residen
tial; however, in section 24.11 2B of the Code there is an exemption
provided for individually Historically Designated Structures to convert
that space outside of the GMP. The Red Onion has requested that designati
and the HPC stopped process in designation of properties in the Commercial
Core and Main street. The Planning Office recommends that the P&Z approve
the re-condominiumization along the lines that they ask that the Southerly
1081 square feet of Unit #3 be part of Unit #5 and that the Northerly por-
tion can then be converted to commercial or office use, under the conditio
that the designation process be completed and that the building department
requirements be met.
Lee Pardee moves that the Planning and Zoning Commisssion recommend to Cit
Council Subdivision Exception for the purpose of condominiumization
of the Southerly 1081 aquare feet of Unit#3 as part of Unit#5 for use as
office space or that the Northerly portion of Unit#5 be exempted from the
GMP competition due to the provision of section 24.11 2B of the Municipal
Code the following conditions; 1) that the Historic Designation process b
completed for the building and 2)the recommendation of the Building Depar
ment concerning necessary provisions to meet life, health, safety standard
are followed.

Public Hearing - Nature's Storehouse - Conditional Use
Alice Davis of the PLanning Office introduces the memo into the Public re-
cord. Alice said that the request is for approval of a restaurant for a
Conditional Use in the C-l Zone district. This should be reviewed accord-
ing to section 24.3.3B of the Code. The Planning Office recommends appro-
val of the request for a restaurant as a conditional use at 620 E. Hyman.
Olof Hedstrom opens the Public Hearing.
Adam Walton urges the Commissin-to grant the applicant his request; how-
ever Adam would not like to see that further the deterioration of that
Zone into a restaurant zone.
Terry Badger, one of the owners for Nature Storehouse, said that Nature
Storehouse is a simple operation and it will be more effective if they mOVE
both places into one area.
Andrew Drecopley, represents the owners of the building, said that the
space is less than 1500 square feet and there no provision for ventilation
for gas cooking, etc. He stated the applicants do not have any interest in
having a three-way liquor license.

NEW BUSINESS - Albano Subdivision Exception (Condominiumization)
Colette Penne of the Planning Office , states that the Planning Office
recommends approval of Subdivision Exception for purposes of Condominiumiz
ing the Albano Duplex at 133 W. Hyman with rental restrictions, 6 month
minimum leases and the Plat revisions which are outlined in the attached
Engineering Dept. memo.
Olof Hedstrom entertains a motion to recommend Subdivision Exception
for the purpose of Condominization to the Albano Duplex, located at 133 W.
Hyman, with conditons 1&2 stated in the Planning Office memo of February IE

Laulainen Subdivision Exception (Lot Line Adjustment)
Alice Davis states that this is a Lot Line Adjustment for the lot line be-
tween 666 and 707 Gibson Ave. The criteria that this should be reviewed by
is under Ordinance 37. They do meet all the four criteria.
1) Its a boundary change between City landowners 2) It does not directly
or indirectly effect the development rights 3) The lots do continue to
comply with area and bulk requirements 4) Lots comply with the subdivision
regulations. Alice Davis said that the Planning Office is recommending
approval subject to the final plat meeting the conditions of the Engineer-
ing Dept.
Jasmine Tygre moves that the Planning and Zoning Commission grant approval (
of theLaulainen Subdivision Exception, for the purposes of adjusting the
Lot Line as requested; approval is subject to the condition # 2 in the
Engineering Departments memo dated January 4, 1982, subject to the condi~
tions that recordable Plats be submitted to the Engineering Department for
review, that the Hill House Condominium Utility Easement is extended
to the new property and that it is simply a Lot Line Adjustment and
dedication is not necessary.

Jasmine Tygre amends motion to include that the existing road be deliniate,
as the existing right of way.
All in favor, except Al Blomquist. The motion is carried.
Hill House Condos Subdivision Exception (Lot Split)
Alice Davis of the Planning Office would like to enter Hill House Condo-
minium Subdivision Exception for Lot Split into the record.
Olof Hedstrom accepts the memo as part of the minutes.

Alice Davis said that this is a Lot Split at 707 Gibson Avenue, on a
82,459 square foot parcel; it is being requested under section 24-ll.2D
of the Municipal Code. The two criteria listed in the memo are:)l)
that the track of land being divided has a pre-existing dwelling unit
2) that no more than two lots are created. Both of these conditions are
met in this case. Alice said that there are 16 conditions that the Engine-
ering Department has placed on this. The Planning Office recommends ap-
proval subject to those, the final approval being attained from the Engin-
eering Department.
Jasmine Tygre moves that the Planning and Zoning Commission recommend
to City Council the approval of the Hill House Condominium Lot Split.
Approval is subject to the conditions in the Engineering Depatment memo
dated February 9, 1982, with the exception of Number 1 and the addition of
Number 17 which will show that Gibson Avenue will be designated as a
condition for the Plat., and that these changes be made by the applicant
and approved by the Engineering Department prior to City Council review.
The Planning and Zoning Commission also recommends approval to exempt the
Lot Split from mandatory PUD requirements on a single family structure
to be developed as a result of the Lot Split.
