PLANNING AND ZONING COMMISSION
April 20, 1982
Regular Meeting
The Aspen Planning and Zoning Commission met for a regular meeting on April 20, 1982
at 5:00 p.m. in the Council Chambers. Olof Hedstrom called the meeting to order with
members Perry Harvey, Jasmine Tygre, Al Blomquist, Lee Pardee and Pat Falin.

MINUTES - Lee Pardee said that on the first page on the 4th line, it should read
"that too many of the projects that received GMP allocations two years later when they
finally build ..." Pardee said that two lines below that should read to submit the
building plans instead of be. Pardee said to take out "have to be submitted".
Perry Harvey mentioned that the correct motion on the performance bond issue should be
added to the minutes. Harvey moves to approve the minutes as amended for March 16, 1982.
Jasmine Tygre seconds. All in favor. Motion carried.
NEW BUSINESS
A. Pitkin County Jail Facility - Subdivision Exception and Public Hearing - Adoptiori of
Specially Planned Area (SPA) Plan and Rezoning from SPA to Public.
Colette Penne, of the Planning Office, requests that this issue be tabled until the
Planning and Zoning's May 4th meeting. Penne said that the County will come in with a
completely new application and site plan to review the subdivision exceptions and re-
zoning and the SPA at the same time.
Perry Harvey moves to table the City County Jail structure Conceptual Subdivision and
SPA to the P&Z's next regular meeting, which is May 4, 1982.

B. Public Hearing - Proposed Code Amendments to Section 24-11.6, Lodge GMP Procedures.
Olof Hedstrom opens the Public Hearing. Alan Richman enters his memorandum into the
Public Hearing record and the attachments to that memorandum. Richman said that the
Lodging quality is going to be as much of a consideration of Growth Management as is
quantity.
1. Public Facilities and Services
Perry Harvey said that it seems to him that in Public Facilities and Services that if
sidewalks are being added that perhaps the P&Z should be looking at the advisebility
of parking. Alan Richman believes that this is in the design section and that it shou:
be emphasized. Lee Pardee feels that P&Z should require a lodge district to improve
the district.
2. Proximity to Support Services
Al Blomquist said that certain areas are zoned for certain reasons so then the points
should be compared for best possible design. Alan Richman said that the design sectiol
has been a model for some of the changes to the commercial and some changes that are
being proposed right now to develope commercial system with the County.
3. Quality of Design
No changes are proposed for this category.
4. Services Provided for Guests
Al Blomquist said that if the Planning Office gives points for a restaurant and the
Lodge is too small to really carry one, then it has to be a commercial restaurant that
serves the neighborhood. Perry Harvey said that the point of this is that it gives
points to larger projects and the concerns that P&Z have, which is why Harvey was askil
about in the lodge zone, what is the potential build out on site by site basis.
5. Conformance to Local Public Policy Goals
Alan Richman said that this section has been proposed to receive major technical
changes. Perry Harvey asked if he was right in assuming that in the lodge zone you
have a FAR that is a square footage, it is not number of units, then you could as
many units in there ... Sunny Vann said that you have an external FAR which relates
to the maximum size of the building, the internal FAR which establishes a maximum
realm area. Perry Harvey said that many times these old lodges would like to be able
to recreate the units in a larger size. Harvey said that he thinks what is happening
here is giving points for tearing down each five units and rebuilding them. Hlrvey
said that the new proposal might be pushing the applicant into more smaller units
which may be defeating the purpose of upgrading the quality.

Alan Richman said that if the issue becomes if the intent is to provide this flexibility
for both the non-conforming and the conforming, probably the only way to make it work
will be some further refinement to the lodge preservation.
Lee Pardee said that at this point, this is part of the PUblic Policy, the relationship
and the balance equating 10 points for demolition and reconstruction versus 6 points
for proximity is not Public Policy. The Public Policy is established by zoning is to
have our lodging at the base of the mountain. Pardee's concern is to yes give some incen-
tiveto other than base of the mountain, lower quality lodging to reconstruct. Pardee
said that bounds should lean in favor on a point basis for building at th e base of the
mountain, where we don't have transportation problems, and all our zoning and public
policy is aimed for. Pardee feels that the weighting is quite unfair toward the
Public Policy.
Spence Schiffer said that he thinks there is another Public Policy here that has not been
addressed and that is for example in Han's situation, "you would want him to be rebuilding
units before building new units". Schiffer feels that the total number of lodge units
should not be increased at first but that you get the quality lodge units first.
Olof Hedstrom said that many of these operational things, one would normally rely on
competition to combine the incentive or the necessity for the provision and that would be
sufficient. Hedstrom said that it does seem that competition in that respect towards
providing better and more services doesn't always work.
Mark Danielson said that the way it is written now is that you get points for the
additional incentives Danielson questions that concept.
6. Bonus Points
Alan Richman said that the P&Z had asked the Planning Office to come back after the
last set of GMP scoring, with some suggestions regarding the bonus points area.
The Planning Office suggested that the Commission award the points as a whole as op-
posed to Commission members awarding bonus points individually and then averaging them
this may be an area that the Commission would want to discuss the good and the bad
points about each application at the end of the scoring.
Lee Pardee prefers the High and Low,
Perry Harvey said that you could add up all of the bonus points and divide that by all
of the Commission members voting. You then add the bonus points as the individual
scores and then you total all the individual scores.
Alan Richman said that the bottom line score is the average of everybodys score which
is therefore averaging across the board. The method that you have now is that the
points are awarded individually and they are averaged in and they are added after
meeting the threshold point. Richman said that if they do not reach the threshold
in areas 1 thru 5 the bonus points will not get the applicant over the th reshold any-
way.
Olof Hedstrom disagrees with Alan on that point.
Jasmine Tygre feeels that people have a right to be extreme if they want to, if they
really feel strongly about a particular project.
Olof Hedstrom agrees with Jasmine, he suggests that everyone score including bonus
points; then the Commission should have a discussion on bonus points. After the
discussion everyone, individually puts down what they want. Hedstrom said that in
the final tally, the scoring, he suggests using the figureskating method, which
eliminates the extremes completely.
Alan Richman said that when this Public Hearing was advertised,..it was advertised for
not only for section 24.11.6 but also for the commercial quota 24-ll.lC, the
PJmnning Office is not. prepared to do that tonight.
Olof Hedstrom asked that Alan go through the revisions stage by stage in the code.
The Commission members discuss the existing language as compared to the proposed revision.
Olof Hedstrom closes the Public Hearing.
Lee Pardee moves to accept as changed the Resolution 82- , considered on this day
concerning guidelines for re-zoning applications as amended with approval by the Commis-
sion for our Chairman to approve as changed.
Alan Richman reads the changes: Letter D, it will say at the end "shopping center
will not be limited to the following evaluation criteria, as they may apply to the
particular application in question. The second change was on #4 removing the first few
words and instead saying analysis of the community need for the proposed rezoning
including whatever the Planning and Zoning Commission accepted.
