Vice Chair Welton Anderson called the meeting to order at 5: 00
p.m. with members Pat Fallin, Jasmine Tygre, Al Blomquist, Roger
Hunt and Lee Pardee present.
COMMISSIONER COMMENTS
1. Anderson said he spent time with the state historic
preservation office. Anderson said under the Code on some
residential lots one large structure is allowed but not two
smaller structures. Anderson suggested discussing a code
amendment to allow some variation when the character and scale of
the neighborhood is better served by doing two small structures
rather than one long strung out structure, where a duplex would
have been allowed. Anderson said this should apply only when
there is an established neighborhood like Lake avenue. Blomquist
suggested this could be accomplished by changing the definition
of duplex. Anderson said this should give flexibility to
historic neighborhoods. Blomquist said there would be advantages
from a solar access standpoint to have two separate structures.
Alan Richman, planning office, said the difference is the
intensity of which the lot is used. The rationale is that a
duplex would not use as much of the lot; however, in some cases
that may not be true. Richman said this is a reasonable thing to
look into. Colette Penne, planning office, brought up the
example of the Glidden house. The state historical people said
that type of Mansard roof Victorian house is very unusual in
Colorado. The owners have enough land to have a duplex. They-
prefer a separate structure. Ms. penne noted that meeting the
requirement of 20 percent connection for a duplex will ruin the
historical feel of the structure. Anderson requested this be put
on the agenda for future meeting.
2. Ms. Fallin said the Council has expressed an interest in
having a joint work session, particularly on timesharing and GMP
exemptions.
3. Richman handed out the commercial GMP applications which
will be scored at the next meeting.
EX-PARTE CONTACTS AND CONFLICTS OF INTERESTS
Anderson requested this be tabled since the Chairman is not
present. Hunt moved to table the ex-parte and conflicts of
interest when it can be conveniently rescheduled; seconded by Ms.
Tygre. All in favor, motion carried.

Alan Richman, planning office, said this was initiated to make
the process easier for everyone involved. Richman said
Commercial and lodge submissions both corne in September 1st.
This creates some difficulties for an applicant with more than
one application. Richman said it is also difficult to schedule
these in front of P & Z. The major problem is the January 1st
residential GMP submission date, which is a holiday and people
have to apply by December 31st. No one is happy with that and it
is an inconvenience. Richman pointed out even simple residential
GMP applications take 6 or 7 months to get through the process,
which means one may miss the building season.
Richman suggested commercial GMP be moved to August 1st, lodge be
moved to October 1st and residential be moved to December 1st.
This will work well for staff resources, the applicants, and to
get plans done for the building season. The Code requires P & Z
score the application a month after it is received, and Council
allocate the next month.
Anderson opened the public hearing.
Anderson closed the public hearing.
Hunt moved to instruct the planning office to develop a Code
amendment concerning the GMP submission dates making commercial
submission August 1st, lodge submission October 1st and
residential submission December 1st; seconded by Ms. Tygre All
in favor, motion carried.
There were no comments.
FIRE STATION REZONING SPECIAL REVIEW FOR PARKING
Colette Penne, planning office, said this is a request for
rezoning, which has been sponsored by Council to rezone from
P,park to public/SPA to allow an addition to be built on the fire
station and an addition by the fire district to the east of the
property line. There are 5 parking spaces being provided on the
alley, and in staff's opinion is adequate. Ms. Penne said there
is some confusion about whether this approval has al ready been
given. The rationale of the public/spa zone is that this is for
a government function. The Thrift shop is a quasi-public entity
in this town, they will lease the portion of the building on the
east side of the site. Ms. Penne told the Commission the fire
district does have some expansion plans for housing and office
space; this is not part of this application.
Ms. Penne said the plan will retain an open green space with a
park area with benches, which may be more used by people than it
is now. The public zone requires area and bulk requirements to
be set by an SPA overlay. Ms. Penne said this is not a full SPA
plan, it is just to show the placement of structures and set the
area and bulk requirements. Ms. Penne suggested 28 feet as

maximum height. The percent of open space calculates to 15
percent, and the external FAR at maximum build out would be
1.25:1. In the CC zone allows 1.5:1 with a bonus. The permitted
uses for this SPA should be the same as those for public zone, if
P & Z agrees the Thrift Shop is a quasi-public entity.
Ms. penne said this site is currently in the CC zone but it has
been a public use for years. It is also within the vicinity of
other public uses, the city hall and courthouse. Ms. Penne said
staff feels the goal of community balance is retained by this
plan and is legitimizing this as a public area. The rezoning
will allow the expansion of two uses which do benefit the
communi ty. The planning off ice recommends P & Z recommend
approval of rezoning to public/SPA and special review approval be
given for the 5 parking space. J. R. McCarthy told the
Commission there is 1400 square feet on the ground floor with a
basement. McCarthy said the building is designed to accommodate
1,000 as a second story for the fire district for a future fire
chief's housing as well as offices.
Pardee said he would prefer to have the building across the back
of the lot and have more open space fronting the street.
McCarthy said parking is a concern and the 5 spaces on the alley
have to be retained. Re-locating the building on the back of the
lot would obliterate the parking. McCarthy said the building is
designed diagonally to give as much open space as possible. Ms.
Tygre said she does not have a problem with calling the Thrift
Shop a quasi-public use but does have a problem designing the
space as a retail use.
The Board discussed the site plan. Pardee wanted more park on
the building across the back of the site. Ms. Fallin said after
hearing the constraints, she would go along with this plan. Ms.
Tygre shared the concern about taking open space, would approve
the rezoning to public/SPA and set a stringent area and bulk
requirements. Hunt said he would prefer to have the building re-
oriented toward the back of the site and have more open space on
the front. Hunt said this is the proper place for the fire
department, and there is no point to limit the FAR because this
is where the expansion should occur. Blomquist said this land
was probably purchased for the fire department and not for open
space purposes and that the vacant land was being retained for
expansion of fire department purposes. Blomquist said the park
zoning is probably is mistake. Blomquist said this plan is
conservative and well thought out. Blomquist said there is a
timing constraint. Pardee said the P & Z is being asked to
approve a plan based on the fire department's wish list.
McCarthy said this is designed on the diagonal to allow as much
open space as possible. It is also designed for the flexibility
of expanding the fire department to include offices and housing.

Anderson opened the public hearing.
Karen Kashinski, representing the Thrift Shop, said they have
been working with the City Council for a location for their shop.
There has been no objection to the Thrift Shop using city land.
Pardee said he is not objecting to the Thrift Shop but only to
losing green space. Anderson said he feels the plan is very
good.
Anderson closed the public hearing.
Blomquist moved to recommend to Council the rezoning of the fire
station property to public/SPA and that the area and bulk
requirements and permitted uses be as outlined in the planning
office memorandum and that special review approval be given for 5
parking spaces; seconded by Ms. Fallin. All in favor, with the
exception of Pardee and Ms. Tygre. Motion carried.
HPC CODE AMENDMENTS
Colette Penne, planning office, told P & Z the HPC is requesting
changes to two section of 24.9. One is the creation of the
Committee which has 7 regular members and 3 alternates. The
section states that the regular member if absent will choose the
alternate. Ms. Penne said this does not function as a practical
matter and the HPC is recommending that be dropped. Ms. Penne
said the thrust of the HPC is to function as a design review
board. In order to function as a design review board, the
members should be familiar with design and should have an
archi tect, lawyer, real estate, hi story. Ms. Penne said she
would like to see this become a more professional board.
Hunt moved to have the planning office draft a resolution for
approval for these code amendments; seconded by Pardee. All in
favor, motion carried.
Ms. Tygre moved to adjourn at 6: 45 p. m.; seconded by Blomquist.
All in favor, motion carried.
