Although 90% of the approved project is complete, one lodge building remains unbuilt. The building is to sit between the Health Club and the existing lodge units. This request will extend the vested -rights to June 21, 2000, however the GMQS exemption that was granted for the development as an essential public facility may only be extended for a period of six months, until ' December 21, 1997. The application is attached as an exhibit. Staff recommends that Council approve an extension of vested rights and GMQS exemption for this property, finding that the applicant has substantially completed the project and that is in the interests of the City that the project be completed as it has been identified as an essential public facility. APPLICANT: The Aspen Institute, represented by Gideon Kaufman. BACKGROUND: Council approved the Aspen Institute's development of 50 new lodge rooms, a parking garage, renovation and expansion of the health club, and renovation of the restaurant building through Ordinance No. 14, Series of 1991. Since that time one extension of vested rights has been granted through Ordinance #31, Series of 1994 and 90% of the approved project has been completed. The Institute requests another three year extension of vested rights and a six month extension of GMQS exemption to undertake a fundraising effort to construct the last of the lodge buildings. Exhibit A 0 • STAFF COMMENTS: Section 26.100.100 of the Aspen Municipal Code states that a development allotment and all other development approvals shall expire on the day after the third anniversary of the latest date of project approval, unless a building permit is obtained and project is developed, or unless an exemption from or extension of the approval is obtained. GMQS allotments may only be extended for six months while other development approvals may be extended for three years. For developments other than a subdivision, •,an application for extension shall be submitted prior to the third anniversary of the date of approlval of a site specific development plan which shall demonstrate to the satisfaction of city council that: (a) Those conditions applied to the project at the time of its final approval which were to have been met as of the date of application for exemption have been complied with; and RESPONSE: All conditions of approval associated with the SPA agreement and subsequent extensions have been completed. (b) Any improvements which were required to be installed by the applicant prior to construction of the project have been installed; RESPONSE: All the improvements which were required under the SPA Agreement have been completed with the exception of construction of "Lodge Building Number 3." (c) The project has been diligeridy' 'pursued in all reasonable respects, and the extension is in the best interest of the community. RESPONSE: The applicant has spent $16 million dollars on improvements to the property. The lodge requires an additional fundraising effort to complete the project. RECOMMENDATION: Staff recommends that a six (6) month extension of the GMQS exemption and a three year extension of vested rights be approved. Section 4• This Ordinance shall not affect any existing litigation and shall not operate as an abatement of any action or proceeding now pending under or by virtue of the ordinances repealed or amended as herein provided, and the same shall be conducted and concluded under such prior ordinances. As you know, per Ordinance No. 91-14 and the SPA Agreement, The Aspen Institute secured approvals from the City of Aspen for major renovations and additions to its campus at the Meadows. The vested rights period was extended to June 21, 1997, per Ordinance No. 31, a copy of which is attached hereto. During the past years, The Aspen Institute has spent considerable funds to implement modifications and changes to its campus. These changes have been extensive. Rooms have been completely renovated, and new rooms have been built. The health club and the restaurant have been renovated. A new parking structure has been built. The utilities and the new road have been installed. Just recently, The Aspen Institute completed the acquisition of the Trustee Townhomes, 1hili ch had been a prior it'y for the Institute and its future. Every aspect of the application has been completed, except for one small building which has not been built. Given the tremendous outlay of funds, and the major steps that have been taken towards implementation and completion of the overall plan, The Aspen Institute's actions could easily be construed as having vested all its approvals under common law vesting. In order to complete the last phase, the Institute needs to undertake an additional capital fundraiser. The Institute feels that timing for a new fundraiser is not appropriate at this time, and therefore, would like to confirm its vested rights for an additional three years. I believe this request is justified, given the immense work which has been done towards the Exhibit B 0 • Mr. Stan Clausen May 27, 1997 Page 2 implementation of the campus improvements and reliance upon the approvals, the wonderful benefits that the community is beginning to see through the renovation of the campus, and the fulfillment of the spirit of the approvals that The Aspen Institute has secured. SIion 21 That the establishment of a vested property right shall not preclude the application of ordinances or regulations which are general in nature and are applicable to all property subject to land use regulation by the City of Aspen including, but not limited to, building, fire, plumbing, electrical and mechanical codes. In this regard, as a condition of this site development approval, the applicant shall abide by any and all such building, fire, plumbing, electrical and mechanical codes, unless an exemption therefrom is granted in writing.
