The Club is proposing to remodel an existing racquet ball court by adding a second level to a currently vaulted space. The additional space will be utilized for exercise equipment. The remodel will result in no additional floor area as the space is completely subgrade, however, the remodel will increase the existing net-leaseable square footage by approximately 240 square feet. FINDINGS: Section 26.102.040(A)(1)(c) of the Aspen Municipal Land Use Code allows for an exemption from the Growth Management Competition by the Community Development Director for expansion of existing commercial use in a building by not more than 250 net leaseable.square feet if it is demonstrated that the expansion will have minimal impact upon the city. A determination of minimal impact shall require a demonstration that a minimal number of additional employees will be generated by the expansion, and that employee housing will be provided for the additional employees generated. The applicant has stated that the proposed remodel will result in a more efficient and safe operation and will not require any additional employees. Staff agrees with that conclusion and feels that the proposed remodel will not require mitigation for increased employees. RECOMMENDATION: Staff recommends that the Community Development Director approve the Growth Management Exemption for the interior remodel at the Aspen Athletic Club finding that the criteria in Section 26.102.040 (A)(1)(c) have been met. We are requesting approval to construct a second floor deck in Racquetball Court #2 which is currently used as a racquetball court. The resulting two floors would then be used to accommodate our weight training equipment currently located in Racquetball Court #1. With the relocation of our weight training equipment, we would return the use of Racquetball Court #1 back to racquetball. What we are in effect doing is relocating our existing, cramped weight training facility into a two - level space that will result in a more efficient and safe operation, while continuing to offer racquetball, albeit in a different location. Our decision to "flip-flop" racquetball courts is based on much better circulation, access, and supervision for weight training activities when Racquetball Court #2 is used as the court converted into the two level space. As the net increase in leaseable square footage approximates only 250 SF, we would not be altering the concept or scope of our existing operation. The small gain in square footage provides an improved experience for our members by simply allowing better spacing of existing equipment. Consequently, we will not require any additional employees to operate within this new floorplan. 2. Plan drawings have been submitted. 3. A Building Permit was issued in November, 1995, conceming the remodeling of our indoor climbing wall. The installation was a prefabricated system that required building department approval only as related to structural and safety concerns. The project was approved in December, 1995. 4. 1 am not aware of any recorded documents which affect the proposed development. We are requesting an exemption by the Community Development Director from Growth Management requirements according to section 26.102.040 A. 1. c. This section allows the Director to exempt commercial or office expansion for uses that do not increase net leasable square footage. Although our planned expansion does result in an increase in net leasable square footage, because the increase is less than 250 square feet, we believe that it is insubstantial and this exemption is still applicable. In addition, the next level of exemption, section 26.102.040 B. 1.a. provides for exemption by the Commission for the expansion of commercial or office uses where the increase in net leasable square footage is 251 to 500 square feet. Therefore, the definition for no increase in square footage seems to imply a range from a decrease to an insubstantial increase of 250 square feet. APPLICANT understands and agrees that City of Aspen Ordinance No. 53 (Series of 1995) establishes a fee structure for Planning applications and the payment of all processing fees is a condition precedent to a determination or application completeness. 3. APPLICANT and CITY agree that because of the size. nature or scope of the proposed project. it is not possible at this time to ascertain the full - extent of the costs involved in processing the application. APPLICANT and CITY further agree that it is in the interest of the parties to allow .APPLICANT to make payment of an initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis. APPLICANT agrees he will be benefited by retaining greater cash liquidity and will make additional pavments upon notittcation by the CITY when they are necessary as costs are incurred. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect full fees prior to a determination of application completeness, APPLICANT shall pay an initial deposit in the amount of $ which is for hours of Planning staff time, and if actual recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse the CITY for the processing of the application mentioned above, including post approval review.
