AN ORDINANCE APPROVING THE TERMS AND CONDITIONS OF AN AGREEMENT
BETWEEN THE ROARING FORK LAND AND CATTLE CO. d/b/a THE T-LAZY-7
AND THE CITY OF ASPEN, COLORADO, AND A LEASE AGREEMENT BETWEEN THE
ROARING FORK LAND AND CATTLE CO. d/b/a THE T-LAZY-7 AND THE CITY
OF ASPEN, COLORADO, PROVIDING FOR THE CONSTRUCTION, OPERATION AND
MAINTENANCE OF A HYDROELECTRIC POWER GENERATING PLANT ON MAROON
CREEK WITH ALL NECESSARY PIPES AND ELECTRIC POWER LINES TO BE CON-
STRUCTED ON LAND OWNED BY ROARING FORK LAND AND CATTLE CO. AND
AUTHORIZING AND DIRECTING THE MAYOR TO EXECUTE SAID AGREEMENTS ON
BEHALF OF THE CITY OF ASPEN
WHEREAS, there have been submitted to the City Council an
Agreement between the Roaring Fork Land and Cattle Co. d/b/a the
T-Lazy-7 and the City of Aspenxfor the construction, operation and
maintenance of a hydroelectric power generating plant on Maroon
Creek with all necessary pipes and electric power lines and a
Lease Agreement between the Roaring Fork Land and Cattle Co. d/b/a
the T-Lazy-7 and the City of Aspen for the parcel of land on which
said hydroelectric power generating plant is to be located.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That the City Council of the City of Aspen does approve the
Agreement and the Lease Agreement between the Roaring Fork Land
and Cattle Co. d/b/a the T-Lazy-7 and the City of Aspen, which
agreements are attached hereto and incorporated by this reference;
and does further authorize the Mayor, on the effective date of
this ordanance, to execute said agreements on behalf of the City
of Aspen.
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent

provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3
A public hearing on the ordinance shall be held on the
