HOPKINS AVENUE, LOTS L, M, AND N, BLOCK 87, CITY AND TOWNSITE OF ASPEN, PITKIN COUNTY, COLORADO RESOLUTION NO.2, SERIES OF 2007 PARCEL ID: 2737-073-30-006, -01 I and -012 WHEREAS, the applicant, Isis Property Group, LLC, represented by Haas Land Planning, Klein, Cote, and Edwards; and Charlcs Cunniffe Architccts, has requested approval for Minor Developmcnt, Commercial Design Rcview, and a Parking Variance in order to remodel The Isis Theater, 406 E. Hopkins Avenue, Lots L, M, and N, Block 87, City and Townsite of Aspen, Pitkin County, Colorado; and WHEREAS, Section 26.415.070 of the Municipal Code states that "no building or structure shall be erected, constructed, enlarged, altered, repaired, relocated or improved involving a designated historic property or district until plans or sufficient information have been submitted to the Community Development Director and approved in accordance with the procedures established for their review;" and WHEREAS, for Minor Development Review, the HPC must review the application, a staff analysis report and the evidence presented at a hearing to determine the project's conformance with the City of Aspen Historic Preservation Design Guidelines per Section 26.415.070.D.3.b.2 and 3 of the Municipal Code and other applicable Code Sections. The HPC may approve, disapprove, approve with conditions or continue the application to obtain additional information necessary to make a decision to approve or deny; and WHEREAS, for approval of Commcrcial Design Review, HPC must review the application, a staff analysis report and the evidencc presented at a hearing to determine if the project conforms to the criteria of Section 26.412 of the Municipal Code; and WHEREAS, for approval of a parking variance, the IIPC must review the application, a staff analysis report and the evidence presented at a hearing to determine if Section 26.415. I 10.C of the Municipal Code is met; and WHEREAS, Amy Guthrie, in her staff report dated January 10, 2007, performed an analysis of the application based on the review standards and the "City of Aspen Historic Preservation Design Guidelines, and recommended approval with conditions; and WHEREAS, at their regular meeting of January 10, 2007, the Historic Preservation Commission considered the application and continued the review to January 16, 2007, at which time they found the application was consistent with the review standards and the "City of Aspen Historic Preservation Design Guidelines" and granted approval with conditions by a vote of 4 to O. 11111111111111I1 111111 ::~~~~:;~ ~ I : 08F Ji=lNICE K vas CAUDILL PITKIN COUNTY CO R 11.00 0 0.00 NOW, THEREFORE, BE IT RESOLVED: That HPC approves Minor Development, Commercial Design Review, and a Parking Variance for 406 E. Hopkins Avenue, Lots L, M, and N, Block 87, City and Townsite of Aspen, Pitkin County, Colorado, with the following conditions: I. The approved elevation is as drawn by the applicant, provided to the board at the January 10, 2007 meeting, and labeled as "Proposed Staff Elevation." The drawing depicts one retail entry into the west bay, one in the center bay, and the theater entrance in the east bay. If only one retailer occupies the ground 1100r space, the retail entry may occur through the central bay, with the windows in the western bay left as they were at time of HPC application. 2. Detailed drawings of the new storefront doors, windows, and trim elements must be submitted for review and approval by staff and monitor. 3. No additional on-site parking is required for the proposed project. 4. There shall be no deviations from the exterior elevations as approved without first being reviewed and approved by HPC staff and monitor, or the full board. 5. the conditions of approval will be required to be printed on the cover sheet of the building permit plan set and all other prints made for the purpose of construction. 6. The applicant shall be required to provide the contractor with copies of the HPC resolution applicable to this project. The contractor must submit a letter addressed to HPC staff as part of the building permit application indicating that all conditions of approval are known and understood and must meet with thc I (istoric Preservation Officer prior to applying for the building permit. 7. The General Contractor and/or Superintendent shall be required to obtain a specialty license in historic preservation prior to receiving a building permit.
