ORDINANCE NO. ~ (Series of 1
AN ORDINANCE AMENDING SECTION 5-68(c) OF THE MUNICIPAL CODE OF THE
CITY OF ASPEN TO ESTABLISH NEW PENALTY ASSESSMENTS FOR THIRD AND
FOURTH OFFENSES OF A DOG RUNNING AT LARGE
WHEREAS, the City Council desires to establish the possibil-
ity of community service in connection with a third offense and to
increase the fine for a fourth offense of a dog running at large
to encourage people to obey the law.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That subsection (c) of Section 5 of the Municipal Code of the
City of Aspen, Colorado, is hereby amended to read as follows:
"(c) The penalty assessment and the nature of the violation
for which the penalty assessment may be accepted and
paid by the violator under the privileges of this secton
shall be as follows:
(1) Failure to display tags . $10.00
(2) No dog license . $15.00
(3) No rabies vaccination . $20.00
(4) Dog running at large, first offense:
Altered dog . $10.00
Unaltered dog . $20.00
(5) Dog running at large, second offense:
Altered dog . $40.00
Unaltered dog . $60.00
(6) Dog running at large, third offense:
Altered dog . $80.00
Unaltered dog. .$100.00
(A third offense reqUires a court appearance and
possible community service).
(7) Dog running at large, fourth offense:
Altered dog .$160.00
Unaltered dog ....... - . . $200.00
(A fourth offense requires a court appearance and
possible community service).
(8) Failure to remove excreta,
for each offense $20.00
(9) Illegal hitching . $10.00
Section 2
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or
unconstitutional by any court of competent jurisdiction, such

portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 3
A public hearing on the ordinance shall be held on the
