ORDINANCE NO.
(Series of 1984)
AN ORDINANCE VACATING THAT PORTION OF THE ALLEY LOCATED BETWEEN
LOTS H AND R, BLOCK 33, ORIGINAL ASPEN TOWNSITE, AND RESERVING
EASEMENTS FOR UTILITIES
WHEREAS, the public use, convenience and necessity no longer
requires that portion of the alley located in Block 33 between
Lots H and R, Original Aspen Townsite,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That portion of the alley located in Block 33 between Lots H
and R, Original Aspen Townsite, as depicted on that map annexed
hereto and made apart hereof as Exhibit "A", shall be, and the
same hereby is, vacated as a public alley subject to the condi-
tions set forth herein.
Section 2
That there are hereby reserved by the City of Aspen and
excluded from the vacation the following easements for utility
lines including, but not limited to, sewer mains, gas mains, water
lines, electric power and telephone lines, and the maintenance
thereof. All rights-of-way or easements for the continued use of
existing sewer, gas, water or similar pipelines and appurtenances,
and for ditches or canals and appurtenances, and for electric,
telephone and similar lines and appurtenances as now exist or as
may be deemed necessary by the City Council in the future for
such purposes, including necessary easements for access and main-
tenance.
Section 3
If any section, subsection, sentence, clause, phrase or
portion of this ordinance is for any reason held invalid or

unconstitutional by any court of competent jurisdiction, such
portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portions thereof.
Section 4
A public hearing on the ordinance shall be held on the
day of , 1984, at 5:00 p.m. in the
City Council Chambers, Aspen City Hall, Aspen, Colorado.
