(SERIES OF 2000) A RESOLUTION OF THE CITY COUNCIL OF ASPEN, COLORADO, APPROVING A AMMENDMENT TO RESOLUTION 75-1998, EXTENDING THE NORDIC TRAIL LEASE BETWEEN THE CITY OF ASPEN AND UTE MOUNTAINEER, INC., AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACT ON BEHALF OF THE CITY OF ASPEN WHEREAS, there has been submitted to the City Council an amendment to the lease agreement between the City of Aspen, Colorado and Ute Mountaineer, Inc., a copy of which is annexed hereto and part thereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN. COLORADO. Section One That the City Council of the City of Aspen hereby approves that an Amendment to the Lease Agreement between the City of Aspen, Colorado, and Ute Mountaineer, Inc., regarding Nordic Center operations, a copy of which is annexed hereto and incorporated herein, and does hereby authorize the City Manager to execute said Professional Service Contract on behalf of the City of Aspen. FIRST AMENDMENT TO AGREEMENT FOR THE LEASE AND OPERATION OF THE NORDIC CENTER AT THE CITY OF ASPEN GOLF COURSE THIS FIRST AMENEMENT entered into at Aspen. Colorado, this day of a~w-~.,_~-C , 2000, by and between the CITY OF ASPEN, COLORADO, a municipal corporation and home-rule city ("hereinafter "City"), and UTE MOUNTAINEER, INC., Colorado corporation (hereinafter "Operator"). WITNESSETH: WHEREAS, the City and Operator desire to extend the term of that certain Agreement for the Lease and Operation of the Nordic Center at the City of Aspen Golf Course, for a period of one additional season; and WHEREAS, the parties hereto agree to amend the rental amount for said lease. NOW, THEREFORE, in consideration of the mntua/terms, covenants and conditions contained herein, the parties agree as follows: 1. That certain Agreement for the Lease and Operation of the Nordic Center at the City of Aspen Golf Course by and between the parties hereto is hereby amended as follows: a. The term of the lease agreement is extended for the period of November 1, 2000, m April 1, 2001. b. The amount of rent shall be $8,000.00 for the entire rental period, payable as follows: $2,000.00 shall be due and payable on the ftrst day of November, December, January, and February. 2. All other terms and conditions of said Agreement for the Lease and Operation of the Nordic Center at the City of Aspen Golf Course shall remain in full force and effect. Nordic Lease Agreement Summary: Staff requests approval ofa 1 year extension to the lease agreement with Ute Mountaineer Inc. CNovember 1 2000- April 1 2001 ~. Discussion: Ute Mountaineer. Inc. holds the existing lease agreement with the City for Nordic Center operations. Staff recommends that this lease be extended for one ski season. The new Golf, Nordic, Tennis, Restaurant facility will be complete in May 2001, Staff intends to bid out the new facility this November for a four to five year lease agreement for Nordic Center operations. Criteria will be developed to insure that the successful bidder is qualified, and will provide the type of operation that has been provided in the past. Financial Implications: The previous lease agreement for use of the golf shop for Nordic Center operations was ~7,000.00 per season. The amended agreement will be $8,000.00 for the 2000-2001 sk~ season. Alternatives: Ifcmmcil does not approve the 1 year lease amended with Ute Mountaineer for Nordic Center operations, the lease would need to be put out to bid. Timing of the bidding process would yield a less desirable lease agreement for the City and the lease holder. Proposed Motion: I move to approve the amended lease agreement between the City of Aspen and the Ute Mountaineer,Inc. City Manager Comments:
