William D. Snare (covenantor), for himself, his heirs,
executors, administrators, and assigns hereby covenants with
the City of Aspen, Pitkin County, Colorado, that:
1. He is the owner of the following described property
together with the improvements thereon: The east half of Lot E,
,
all of Lots F & G, Block 61, City of Aspen, County of Pitkin,
Colorado. Also described as 113 West Hyman Street (Unit 1),
and 113-1/2 West Hyman Street (Unit 2).
2. The abovecdescribed 113-1/2 West Hyman Street (Unit
2) shall be restricted to rental and sale price terms within
housing price guidelines as the same may be amended from time to
time by the City Council of the City of Aspen, Colorado within
the provisions of Section 24-10.4(b)(3) of the Municipal Code of
the City of Aspen, Colorado. The above-described 113-1/2 West
Hyman Street (Unit 2) shall be a one bedroom, one bath apartment,
containing approximately eight hundred square feet.
3. The above-described 113-1/2 West Hyman Street (Unit
2) shall be restricted to occupancy limitations within Housing
Income-Eligibility Guidelines as the same may be amended from time
to time by the City Council of the City of Aspen, Colorado within
the provisions of Section 24-10.4(b)(3) of the Municipal Code of
the City of Aspen, Colorado. Currently, the unit shall be rented
under the moderate income guidelines.
4. The covenants contained herein may be changed,
modified or amended by the recording of a written instrument signed
by the record owners of the property and the Mayor of the City of
Aspen pursuant to a vote taken by the City Council.
5. The covenants contained herein are to run with the
land and shall be binding on all parties and all persons claiming
under them for a period of fifty (50) years from the date these
covenants are recorded, after which time, the covenant contained in
paragraph two (2) shall be automatically extended for successive
periods of ten (10) years, unless an instrument signed by the record
owners of the property and the Mayor of the City of Aspen pursuant
to a vote taken by the City Council has been recorded which changes
said covenants, in whole or in part, or which releases the same, and
the covenants contained in paragraphs three (3) and six (6) shall
be released.
6. Each unit of the duplex shall be restricted to six (6)
month minimum leases with no more than two (2) shorter tenancies
per year.
IN WITNESS THEREOF, this Declaration has been duly
executed this 1st day of December, 1980.

APPROVED AS TO FORM FOR CITY COUNCIL: ~
Given the City's current position to encourage the geographical dispersion
of employee housing and the excellent location of the unit in question, the
Planning Office recommends approval of the applicant's request subject to the
fo 11 owi ng:
1. The deed restriction of the one bedroom employee unit for a period of
fifty years under the City's moderate income guideline, said restriction
to be executed prior to the issuance of a building permit.
2. The submission and approval of an appropriate site plan to the Engineering
Department indicating the required four parking. spaces and the provision thereof.
P & Z Recommendation
The Planning and Zoning Commission concurred with the Planning Office recommenda-
tion at its regular meeting on September 16, 1980 and moved to recommend to City
Council the proposed employee housing unit at 113 West Hyman Avenue be exempted
from Growth Management subject to the conditions outlined above.

Should you concur with the Planning and Zoning Commission's recommendation,
the appropriate motion is as follows: . "I move to exempt the proposed employee
housing unit to be located at 113 West Hyman Avenue from compl iance with Growth
Management allotment procedures subject to the following conditions: 1) The

Snare Special Review

The Housing Office is supportive of the Snare application for
Special review. I am assuming this application is similar to
the earlier one by Ed Baker and that the zoning would allow the
additional density.
My recommendation is the unit be deed restricted for the 50 year
period and designated a moderate priced unit for both rental and
purchase.

Having reviewed the above application for the addition of
a one bedroom unit to a three bedroom unit in the row Zone
through special review, and having made a site inspection, the
Engineering Department has the following comments:
The only area left unclear by the application under the
special review criteria is that of on-site parking. While it
is apparent that adequate space exists on the site for the
four required off-street spaces, I have not seen a site plan
showing a suitable configuration.
Therefore, the Engineering Department recommends approval
of the Snare Special Review subject to the owner/applicant
supplying a site plan to this office indicating a suitable
four space arrangement.

Dear Mr. Chairman and Members of the Planning and Zoning Board:
This letter is being written on behalf of William D. and Margaret W. Snare,
owners of the dwelling under construction at 113 West Hyman Avenue, Aspen,
Colorado. We ask that you grant permission under the special review provisions
of the ordinances of the city of Aspen for the completion of a one bedroom and
controlled rent employee housing unit in the lower level of the residence under
construction. As the plans show, the requested apartment will contain approxi-
mately 800 square feet of space, including one bedroom, separate four piece bath,
kitchen complete with all appliances including dishwasher, living room and
dining area with a separate outside entrance.
The requested unit will be identical to the employee unit contained in my one-
half duplex next door at 117~ West Hyman which was built under the special
review provisions in 1979. It is our understanding that the requested employee
unit will fall into the moderate rent category and will be rented within the
guidelines established under the ordinances of the city of Aspen for moderate
housing and further understand that if condominiumized and sold, that it would
be subject to the same moderate housing price guidelines. It is the intention
of the applicants that the employee unit be priced at such a level to encourage
no more than two people to live therein and provide certain caretaking duties on
the premises. Under this circumstance, such residents would be fully able to
carry out duties of other full time employment in addition to the minor caretaking
duties on the premises.
The apartment which would be designated 113~ West Hyman is located on a regular
bus route to the various ski areas and in addition, is only two blocks from
Main Street where Aspen Transit is available to all parts of the city. Being
within three blocks of the downtown area puts the property within walking distance
of major employment centers.
If there is any further information that is required, I will be happy to give it
during the oral presentation before your group. Should any additional exhibits
or written narrative be required, please let me know at the earliest possible
date. We would like to complete this employee unit for occupancy prior to the
1980/81 ski season. Thank you very much for your favorable consideration of this
application.
