I am delivering to you with this letter one (1)
original Subdivision Improvements Agreement duly executed
by Hans Cantrup and June Cantrup,and twO (2) original
mylars of the project duly executed by everyone except
the city officials. .
I am delivering these to you, pursuant to instructions
from Kathy Hauter, so that the remaining signatures may be
obtained.
I have spoken to Lois Butterbaugh and she has informed
me that Hans will be required to sign a Promissory Note for
his Park Dedication fee prior to his obtaining a building permit.
Please contact me if you have any questions, as the plat
should be recorded by April 15th at the latest.

CANTRUP, and THE CITY OF ASPEN, COLORADO, a municipal corporation

WHEREAS, Subdividers hold record title to a parcel of
land situated in the City of Aspen, County of Pitkin, State
of Colorado, to-wit: the North 10 feet of Lot 16, all of Lot
15, and the South 20 fe.et of Lot 14, Block 1, Connor 's Addition,
to the City and Townsite of Aspen: and,
WHEREAS, Subdividers have submitted to the City for
approval, execution and recording a subdivision plat of the above-
described property, such subdivision to be known and designated
as "651 Monarch Condominiums": and,
WHEREAS, the City has fully considered such subdivision
plat, the proposed development and the improvement of the
subject property shown thereon, and is willing to approve,
execute and accept said plat for recordation upon the agreement
of Subdividers to the matters hereinafter described, which
matters are deemed necessary to protect, promote and enhance
the public welfare: and,
WHEREAS, Subdividers and the City wish to reduce said
agreement to writing.
NOW, THEREFORE, in consideration of the premises, the
mutual covenants herein contained, and the approval, execution
and acceptance of said subdivision plat by the City for record-
ing, the parties hereto hereby agree as follows:
1. Subdividers covenant and agree to and with the City
that they will affirmatively consent to and join in the formation
of any special improvement district, encompassing all or any part
of the 651 Monarch Condominiums subdivision, that may hereafter be

proposed or formed for the construction of street improvements,
drainage improvements or buried electrical improvements. Sub-
dividers hereby waive and further covenant and agree to waive
any right to protest against the formation of any such district.
2. In the event the City, at any time or from time to
time, shall construct or install any street improvements which
improvements service or improve a general area including the lands
within the 651 Monarch Condominiums subdivision, Subdividers agree
upon demand, to payor reimburse the City for that portion of the
actual cost of such improvements which is properly allocable to
said subdivision, provided, however, that the City shall be
entitled to such payment or reimbursement only if such improvement
are constructed over an area which includes at least the following
described minimum area, to-wit: Monarch Street from Dean Street
to Summit Street.
Subject always to the minimum area requirements set
forth above, the City shall have the right to install or con-
struct such improvements in phases or increments, ~, curbs
and gutters in one year and sidewalks in a subsequent year, and
Subdivider shall payor reimburse the City for each successive
phase or increment. Provided, however, that improvements install-
ed during the initial construction, i.e., sidewalk, shall not be
charged to the Subdividers.
3. The Subdividers agree to implement the recommenda-
tions of Dick Miller, Fire Chief of the City of Aspen, to-wit:
That a first quality smoke detector be placed
in each unit of the building, and one in the
building's main stairway, and that all of the
detection units be connected to Protective
Systems, Inc., in Aspen, or to Aspen Security
Patrol; and that a permanent fire easement
be established along the South property line
of the above-described property, between
Monarch Street on the East and the area labeled
"Common Pool Yard" on the final plat on the West.
This permanent easement shall consist of a three
foot wide, snowmelted concrete walkway.
4. The covenants and agreements of the Subdividers
herein shall be deemed covenants that run with the land, shall
burden the land included within said subdivision, and shall bind

specifically enforceable against all subsequent owners thereof,
including Subdividers, their heirs, personal representatives,
successors in interest and assigns.
5. City acknowledges receipt from Subdividers of the
sum of Five Thousand six Hundred Fifty Dollars ($5,650.00) as
full satisfaction and discharge of Subdividers' obligations
under the applicable subdivision ordinance to pay cash in lieu
of the conveyance of land to the City for public use purposes.
6. City acknowledges the minor impact of the development
and waives the cash escrow requirements of Section 20-16(c) of
Ordinance 22 (Series of 1975). In lieu of cash escrow, the
Certificate of Occupancy shall be withheld until completion of
the improvements shown on the final subdivision plat.
7. Upon execution of this agreement by all parties hereto,
City agrees to approve and execute the final plat of 651 Monarch
Condominiums and accept the same for recording in the real prop-
erty records of pitkin County, Colorado, upon payment of recording
fees and costs to City by Subdividers.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement as of the day and year first above written.

651 Monarch Subdivision - Final Plat Review

This is a request for Final Plat subdivision approval for the 651 Monarch
Condominiums located on Lots 15 and 16 of Block 1, Aspen Townsite (just
below the Caribou Condominiums). The property is owned by Hans Cantrup.
The request is for four (4) one-bedroom units on 6,000 square feet. The
property is zoned L-2 which requires one parking space per one bedroom unit
and allows multi-family buildings. The four parking spaces will be built
underground.
The architect for 651 Monarch has designed the project to visually harmonize
with the existing Caribou Condominium project.
The Aspen Planning and Zoning Commission has conducted a site inspection on
June 15, 1976 and recommended preliminary plat approval on June 22, 1976.
The City Council originally considered the Final Plat on July 26, 1976 and
tabled the request until a provision requiring short-term rental could be
devised. The Planning Office has recommended that this requirement be re-
moved in that it is inconsistent with our goals of promoting R-MF uses vs.
tourist accommodations. Certainly the primary use of this building will be
for tourist use, but we see no reason to prohibit long term rental use,
The Final Plat and Subdivision Improvement Agreement in addition to certain
standard engineering items includes the following:
1. Specific suggestions of Aspen Fire Chief, Dick Miller for
smoke detectors and a permanent fire easement consisting
of a snowmelt concrete walkway.
2. Design of the foundation structure to accommodate and
protect the large Cottonwood which visually dominates the
site. Dave Boyle, County Extension Agent has reviewed
and approved this design.
3. The open space dedication fee of $5,650 has been reviewed
and approved by Mick Mahoney.
The Planning Office recommends Final Plat approval conditioned upon the
requirements of the City Engineer.

Dear Mick:
This letter is written in response to a request
from Patsy Malone that I provide you with some documentation
regarding the valuation of the 651 Monarch property.
I and Welton Anderson have found that one of the most
recent purchases of land in the area was the property upon
which the Aztec Condominium was constructed. Approximately
one (1) year ago, this property was purchased for approximately
seven (7) dollars per square foot. I feel that an assessment
of ten dollars ($10.00) 'per square foot would be a fair one
based on comparable zoning, location and use.
Based upon Section 20-18 of the City Code, the project
has a population of 5.2 residents (1.3 persons per one
bedroom unit time 4 units) multiplied by .0025 acres per
resident equals a deduction of .0013 acres or 565 square
feet. At ten dollars ($10.00) per square feet, the park
dedication feet would therefore equal Five Thousand, Six
Hundred and Fifty Dollars ($5,650.00).
I would appreciate it if you would see if this fee
meets with your approyal as quickly as possible, as this
is the last item which remains unconfirmed and we are
scheduled to go before the Council for final plat approval
on the 14th of February.

The revised plat is satisfactory and the revised
agreement is satisfactory except for item 3 of
my July 20, 1976 memo. The words "curb and gutter
and" should be deleted from the last sentence of

RE: 651 Monarch Subdivision - Preliminary Plat Review
The engineering department has the following comments on
651 Monarch after having inspected the site and having
reviewed the plat:
1) The plat must show the proposed drywells for
handling roof and driveway runoff.
2) The site is presently receiving natural runoff
from the land to the south and the westerly
stone wall on the site will obstruct the existing
drainage ditch. The Skier's Chalet has already
been detrimentally impacted by changes in natural
drainage patterns. To prevent further such im-
pacts provision must be made to continue this
existing drainage pattern through the site
without diverting water to the west.
3) The additional area required along Monarch for
construction of a 5 foot sidewalk must be indicated
as a public easement.
The items 1) and 3) as well as some other design requirements
have been discussed with the applicant and he has agreed with
them. Item 2) has not been discussed.
The engineering department recommends preliminary approval
by P&Z subject to the above conditons.
As a suggestion, should the applicant not have plans for
utilizing the considerable number of flowering shrubs, which
will be removed, the Parks Department maY-be able to use them.

14 days prior toa Council review date of July 12, 1976, however,
in fact this only gives you 7 days from today for review.
The applicant still. needs to finalize certain fire protection
requirements with Dicl< Miller, Aspen Fire Ch.tf.
We will schedule the Final Plat review before Council on July 26, .1916.

Re: Preliminary Plat of 651 Monarch.
Dear Sir:
We have reviewed the preliminary plat of 651 Monarch and
have found adequate utility easements.
May we suggest the following phraseology be used for the
dedication use of easements within.said subdivision.
"A perpetual easement for the installation and maintenance
of utilities and drainage facilities, including, but not
limited to, electric lines, gas lines, telephone lines,
is reserved and dedicated over and through the PRIVATE,
ROADS ~~ STREETS WITHIN THIS SUBDIVISION; together with
an UTILI~ EASEMENT being Ten (10) feet in width along side
and rear,lot lines as shown on plat, and Twenty (20) feet in
width along the exterior boundary line, together with the right
to trim interfering trees and brush. Together with the 'perpetual
right of. ingress and egress for installation, maintenance
'and replacement of such lines. Said easements and .rights
. shall be utilized in a reasonable and prudent manner."
We believe all preliminary,. as well as final plats should.
show the dedication, or reference to th~ particular
"Protective Covenants" which will run with the property.
Also, all "private roads" should be dedicated to the
utilities for the installation, operation and maintenance
of gas, lights, power and telephone lines. No easements
should be reserved to the property owners, cities or
counties exclusively.

DATE: April 22, 1976
This is a request for conceptual subdivision approval for the
651 Monarch Condominiums located on Lots 15 and 16 of Block 1,
Aspen Townsite (just below the Caribou Condominiums). The
property is owned by Hans Cantrup. The request is for four (4)
one-bedroom units on 6,000 square feet. The property is zoned
L-2 which requires one parking space per one bedroom unit. A
plat will be available at the Council meeting for your inspection..
The Aspen Planning and Zoning Commission has approved the con-
ceptual subdivision conditioned upon the comments of the City
Engineer which are attached hereto.
The project is architecturally designed to surround a large
cottonwood tree. The Planning Office has asked the architect
to consult with Dave Boyle, the County Extension Agent, to
determine proper building foundation techniques to Be used to
protect the root structure of the tree. Mr. Boyle has advi.sed
by the attached letter th.at due to the shallow root system of the
cottonwood, foundation structures should Be set back from the tree.
The architect has redesigned the foundation structures bY'l'i.!
"cantilevering" the building. Such redesign is acceptable to Mr.
Boyle. At prel imioary and final subdivision stages, the Pl anning
Office will ascertain that the Building design is in accordance
with the suggestions of Mr. Boyle.
The ctty Council at their Arpil 12, 1976, meeting tabled the
request pending commitment of the project to short term lodging
use and an interview with the owner of the property, Mr. Hans
Cantrup.

Dear Bill and Hal,
The problems brought up concernIng 651 Monarch at the AprIl
12th Aspen CIty CouncIL meeting were the result of a misunderstanding
on my part concerning the management aspects of the project.
Mr. Cantrup had made no decision "on what type of units 651
Monarch should be and is quite flexible in this matter. I feel
my client will be very receptive to any ideas the planning office
or ,city may have.
Of the options we have discussed, one is that the four units
be condomlniumized under one ownership and be managed by the
Aspen Inn (or other lodge) as purely short term to.urist rental,
with maid service and maintenance provided by the lodge's own
staff. Another option would be that the four units be sold
separately and managed through a lodge or other property
management company dealing in short term rentals.
If the city feels that tourist accomodations are more desirable,
we are certainly agreeable to that. What we are not agreeable to
is a lodge of eight to ten rooms simply because of the physical
constraints of the site.
I\bc!"pe this makes my client's position a little more clear and
that we can come to an agreement on this matter.

Wilton Anderson asked me to confirm by memo to you,
my analysis of the potential damage to the existing
cottonwood at 651 S. Monarch. From the present
construction plans it appears that considerable
damage will be done to the root system of the tree.
Some of the damage may be mitigated by a proposed
design change to do no excavation below the present
grade on the south side of the tree. The necessary
driveway excavation on the north side of the tree
will remove a majority of the root system in that
area and this will have to be compensated for by
considerable top pruning, such as removal of 1 or 2
of the main trunks depending on the extent of the
root damage.

This isa request for Final Plat subdivision approval for the 651 Monarch

The request is for four (4) one-bedroom units on 6,000 square feet. The

and allows multi-family buildings. The four parking spaces will be built .
underground.
The architect for 651 Monarch has designed the project to visually harmonize
with the existing Caribou Condominium project.
The Aspen Planning and Zoning Commission has conducted a site inspection on
June 15, 1976 and recommended preliminary plat approval on June 22. 1976.
The City Council originally considered the Final Plat on July 26, 1976 and
tabled the request until a provision requiring short-term reIltal could be
devised. The Planning Office has recommended that this requirement be re-
moved in that it is inconsistent with our goals of promoting R-MF uses vs.
tourist accommodations. Certainly the primary use of this building will be
for tourist use, but we see no reason to prohibit long term reIltal use.
The Final Plat and Subdivision Improvement Agreement in addition to certain
standard engineering items includes the. following:
1. Specific suggestions of Aspen Fire Chief, Dick Miller for
smoke detectors and a permanent fire easement consisting
of a snowmelt concrete walkway.
2. Design of the foundation structure to accommodate and
protect the large Cottonwood which visually dominates the
site. Dave Boyle, County Extension Agent has reviewed
and approved this design.

3. The open space dedication fee of $5,650 has been reviewed
and approved by Mick Mahoney.
