I . o o MEMORANDUM TO: Bill Drueding, Zoning Officer FROM: Leslie Lamont, Planner RE: Christian science society - Conditional Use Amendment and GMQS Exemption for Enlargement of Historic Landmark DATE: May 13, 1991 ----------------------------------------------------------------- ----------------------------------------------------------------- SUMMARY: The applicants, the Christian science society, intend to convert a basement storage area into a nursery. A GMQS Exemption by Planning Director is requested for the expansion of an Historic Landmark that increases the building's net leasable but not the floor area and an amendment to the conditional use approval. ZONING: Office with Historic Designation Overlay LOCATION: 734 West Main Street, Aspen FINDINGS: The applicants propose to convert below grade storage space into a nursery. According to the application, the Society would like to provide a nursery space for children while services take place. The congregation' is so small that it is estimated that only one or two children will take advantage of the new space. The converted space is approximately 303 square feet. I I I I Pursuant to section 8-104 A.1.b. (2) the Planning Director may exempt the enlargement of an Historic Landmark which increases either the building's existing floor area ratio or its net leasable square footage, but does not increase both. The conversion of storage space to a nursery represents an increase in net leasable. But because it is an existing space and below grade the floor area is not increased. The proposal is therefore subject to a GMQS Exemption by the Planning Director. I section 7-307, provides for the insubstantial amendment of an approved development order for a conditional use by the Planning Director. The Society received a conditional use approval for a church in the Office zone in 1988. The 1988 conditional use discussed the provision of day care or a nursery, but recommended that any future nursery uses be brought to the attention of the Planning Department to determine whether review is required. The following standards shall apply for an insubstantial amendment to a conditional use: I I I 1. The change will not cause negative impacts on pedestrian and vehicular traffic circulation, parking or noise. RESPONSE: The proposed use is for nursery space during services. The space is not proposed as an additional use in the building o o e.g. creating a day school program. 2. The change will not substantially affect the tourist or local orientation of the conditional use. RESPONSE: The proposed nursery does not change the intent of the original conditional use which is a for a church and reading room for the society. 3. The change will not affect the character of the neighborhood in which the use is located. RESPONSE: The nursery is intended for those Society members that wish to attend services and place their children in a supervised play area. 4. The change will not increase the use's employee base or the retail square footage in the structure; and RESPONSE: Retail square leasable will be increased. enlargement of an Historic mitigation of employees. footage is not increased but net However, the GMQS Exemption for the Landmark exempts the increase from 5. The next step would be for us to talk to Roxann who is in charge of Historical Structures. She will make some judgement about parking.' The enclosed site plan will support her review. We could actually show one additional parking space in that the trash receptacle does not take up a space as shown. I am told that either she can make an administrative judgement (that our plan does not increase the parking requirement] or recommend one to her boss.
