you. First of all, there.are a couple of deed restricted units located at 517 E. Hopkins. They
were approved by City Council on April 13, 1982. These minutes reflect that the category
should be "low". I am going to contact Chuck Torinus and tell him that he needs to write a
letter to Community Development to request a change in the category. I will tell him that a pre-
ap conference might be best first so that you can tell him what he needs to provide and how
many copies. I would think that the. Housing Office would be the only referral body to City
Council. He wants to increase the Category, but since the City Council approved "low", which
is now Category 1, he would need to get their approval to change it. The Housing Board
would make a recommendation to City Council. The deed restriction was recorded at Book
464, Page 319. Let me know if you have questions. .

Request:
The applicant received a 1982 commercial development allocation
for 18,000 square feet for the City Plaza Office Building.
The applicant is currently pursuing the additional approvals
that are required by the City -- GMP exemption for the
employee units and special approval for the .5:1 bonus FAR
in the CC zone district. The applicant received final
design approval for the project from HPC on March 23, 1982.
Engineering
Comments:
The Engineering Department commented that the project meets
the requirements of the bonus FAR by designating the proper
amount of space to employee housing. The Engineering Department
also stated that the creation of four employee residential
units in the Commercial Core without on-site parking, although
permitted under the Code, is not a good idea.
Planning

Review:
The applicant is requesting GMP exemption for four employee
studios pursuant to Section 2~11.2(h) of the Code. This
section exempts employee housing from GMP competition subject
to special approval by the City Council upon P & Z's recommendation
with such approval determined by community need considerations.
Employee housing is a recognized community need and therefore
approval is recommended by the Planning Office with the
units to be deed restricted according to the City's housing
low income guidelines.
The applicant is also requesting approval from P & Z for an
FAR bonus of .5:1 pursuant to Section 24-3.4 Area and Bulk
Requirements, item (10) external floor area ratio. This
section requires that .3 of the .5:1 bonus FAR be used for
employee housing deed restricted to the City's low, moderate
or middle income guidelines. The City Plaza project proposes
the maximum floor area allowed with the bonus which is shown
below:
Lot Size 9,000 sq. ft.
Allowed FAR - 1.5:1 13,500 sq. ft.
Bonus FAR - .5: 1
Employee Housing - .3: 1 2,700 sq. ft.
Additional Commercial Floor Area .2: 1 1,800 sq. ft.
Total Allowed FAR with Bonus - 2: 1 18,000 sq. ft.
Since the applicant has agreed to deed restrict the four
employee units to the City's low income guidelines and since
the proposal meets the code requirements for bonus floor
area ratios, the Planning Office recommends that P & Z grant
the approval of the Bonus FAR.

inspection, the Engineering Department has the following

special review.

Dear Alan:
On behalf of our client Alan Shaffer, I request that the Planning
Department establish the necessary agenda to allow further developoont
approvals related to this 1981 G.M.P. application and as provided by
Section 24-11.5(f) of the 1bnicipal Code.
Specifically:
1. Employee Housing which is exempted according to Section 24.11.2
paragraph h and allowed by Section 24.11.10 as amended.
2. F.A.R. Bonus Approval, as provided under Section 24-3.4 Area and
Bulk Requirements for the C-C district item (10) external floor
area ratio.
3. [I.P.C. final approval as provided by Section 24-11.3(d) as repealed
and reenacted.
I have contacted Colette Penne and she agreed to write the public hearing
notice allowing for our appearance before the H.P.C. on the twenty
third (23rd) of March.
At your suggestion I v.ould like to schedule our hearing before the Planning
Comnission for the sixth (6th) of April and the City Council on the twenty
sixth (26th) of April.
Enclosed is our check for $700.00 i.e., $475.00 fee for the Housing Review
and $225.00 fee for the F.A.R. Review.

pursuant to Section 24-3.4 of the Code.
The Engineering Department's only comment was
that the creation of four employee residential
units in the Commercial Core without on-site
parking, although permitted under the Code, is
not a good idea.
Section 24-l1.2(h), which addresses GMP exemptions
for employee units, exempts such units from GMP
competition subject to special approval by City
Council upon the recommendation of the Planning
and Zoning Commission. Special approval is to
be determined through community need considera-
tions, including an analysis of the number of units
proposed, the type of units proposed and the ren-
tal/sale mix of development. Since the applicant
is proposing four, low income rental studio units
which meet the critical shortfall of employee hous~
ing need at the present time, and which meet the
minimum size requirements of the Code, the Planmng
Office recommends that you approve the request
that they be exempted from the GMP.
The Planning and Zoning Commission agreed with
the Planning Office, with both recommending
that Council grant GMP exemption for the four
employee studios at the City Plaza Office Build-
ing subject to the applicant deed restricting
these units to the City's low income housing
price guidelines.

Better late than never. I am confused about one thing. Is this a
1981 GMP allotment already granted, as the applicant's letter
seems to suggest, or a 1982 GMP application as your memo seems to
indicate? On the requested review itself, it seems standard to
me. Both FAR bonus and GMP employee housing exemption require
special review. Presumably, the criteria and ultimate conditions
on approval will essentially be compliance with housing office
guidelines.
