RESOLUTION APPROVING THE TRANSFER OF A PARCEL OF LAND FROM
THE CITY OF ASPEN, COLORADO, TO PITKIN COUNTY COLORADO,
WITH COMPENSATION FOR USE AT THE ASPEN-PITKIN COUNTY
AIRPORT PURSUANT TO AN AMENDED PETITION IN CONDEMNATION,
CASE NO. 00 CV 61-2, DISTRICT COURT, PITKIN COUNTY, COLORADO
WHEREAS, the Board of County Commissioners of Pitkin County, Colorado, has
filed an Amended Petition in Condemnation against the City of Aspen, Colorado, for the
purpose of obtaining a parcel of Burlingame located within the Airport Runway
Protection Zone, and
WHEREAS, the parcel located in Lot I of the Burlingame Ranch Subdivision and
Burlingame Seasonal Housing SubdivisionIPUD, Pitkin County, Colorado, and more
particularly described in Exhibit A attached hereto, was appraised by David Ritter of the
Appraisal Office-Aspen, Ltd., by Michael Nash, MAl of Nash-Johnson Associates, and
by the Aspen Appraisal Group, and
WHEREAS, the City and the County have agreed that $274,450 (two hundred seventy-
four thousand four hundred and fifty dollars) is a fair compensation for said parcel.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1.
That the City Council of Aspen, Colorado, hereby approves the settlement offer of
$274,450.00 by Pitkin County, Colorado, and authorizes the City Attorney to enter into
a Joint Motion for Entry of Rule and Order, which would provide for the transfer of
said parcel to Pitkin County, Colorado. The County will deposit its check to the City of
Aspen in escrow with a title company, with instructions to disburse upon recordation of
a certifi~ule and Order.
