AGREEMENT
THIS AGREEMENT made and entered into this ~ day of
June, 1977, by and between BAYARD HOVDESVEN, (hereinafter "Hovdesven"),
and THE CITY OF ASPEN, a Colorado municipal corporation, (herein-
after "City"), WITNESSETH:
RECITALS
1.1 Hovdesven is the subdivider of the Aspen Main
Condominiums located at 709 East Main Street, Aspen, Colorado.
1.2 The storage areas in said condominiums were not
constructed pursuant to the plans previously submitted to the
City, and a Certificate of Occupancy has not been issued as a
result thereof.
1.3 Hovdesven has now reconstructed said storage areas
to $ubstantially comply with the plans previously submitted, and,
as a condition for receiving his Certificate of Occupancy, is
willing to impose deed restrictions to insure that the storage
areas will not be used for residential purposes.

BASIC AGREEMENT
2.1
The parties mutually understand and agree that the
storage areas are to be used solely for that purpose and not for
any residential or other use. In order to insure that this purpose
is fulfilled, Hovdesven agrees that each and every instrument
by which title to any and all of the condominium ~~ts is conveyed
shall contain the fOllowing covenant:
"By his purchase and recording of the instant
deed, purchaser agrees that the storage area included
in his deed shall be used solely for storage puxposes."
2.2 This agreement shall be binding upon and inure to
the benefit of the heirs, executors, personal representatives,
successors and assigns of the parties hereto.

This is a request for conceputal subdi,vision approval for the Aspen
Main Condominiums consisting of six studio units and located on
Lots 2 and 3, Block 28, East Aspen Addition which is directly
west of the Original Curve Condominiums. Bayard Hovdesven is the
owner of the property and applicant for subdivision.
The Aspen Planning and Zoning Commission on June 22, 1976 recom-
mended approval of the conceptual subdivision, conditioned upon
a six month rental restriction and the comments of the City Engineer.
The Planning Office recommends conceptual subdivision approval
conditioned upon the comments of the City Engineer. The applicant
has already prepared a preliminary plat and we enclose a copy of
this plat in your packet for your convenience s~nce it contains
additional detail of the project.

There is some ambiguity as to who is owner and subdivider
since this is not stated anywhere. The title policy indicates
more than one interest in the property. According to the
survey and title policy the property is more correctly
Lots 2 & 3, rather than Lots B & C. The engineering depart-
ment will be requesting an electrical easement in the
easterly 5 foot sitle setback and there appears to be a
problem with trash pickup using the configuration of
'parking shown. The engineering department recommends

This is a request by Bayard Hovdesven for final plat approval for
the Aspen Main Condominiums consisting of six studio units (520 square
feet plus 60 feet of deck) and located on Lots 2 & 3, Block 28, East
Aspen Addition which is directly west of the Original Curve Condominiums.
The property is presently developed by an older single family dwelling
which is of questionable physical condition. The existing building
is not occupied.
The Aspen City Council on July 26, 1976 approved the conceptual sub-
division and suggested to the Plannipg and Zoning Commission that an
economic impact statement or a market feasibility analysis be done,
pursuant to Section 24-2.8 Mandatory Economic Studies of the City Zoning
Code. Such report would consider the suitability of the project and
possible costs to be incurred by the City as a consequence of develop-
ment of the project.

Dear Bill,
Attached are two copies of a market summary/description
of the Aspen Main Condominiums submitted in response to
the Aspen City Council's request for additional economic
information on this project.
Additionally, at this time I 'would like to request a
height variance from the existing 25' in the office zoning
area to a desired height of 28' for this project. The
additional 3' is needed in order to raise the bottom floor
units in this project above the parking area so that a
better view is available for them. As you may know, this
building site sits approximately 6' below the adjoining
two lots towards Aspen Mountain. Consequently the view
for the first floor units would be greatly enhanced by
permitting this additional 3' height increase. I hope
this variance can be accomplished in the August 17th
Planning and Zoning meeting.

The engineering department recommends preliminary plat
approval for the subject project conditioned upon the follow-
ing comments:
1) Existing curb and gutter on Main Street should
be shown.
2) Existing utilities include buried telephone,
cable TV and power on south side of alley as
well as overhead utilties on north. Service
connections should be made to buried system.
3) New five(5) foot sidewalk should be shown.
4) A five(5) foot electrical and communications

This is a public hearing to consider the Preliminary Plat for the
Aspen Main Condominiums consisting of six studio uo.i.ts and located
on Lots 2 & 3, Block 28, East Aspen Addition which is directly west
of the Original Curve Condo's. Bayard Hovdesven is the property
owner and applicant for subdivision. The property is presently devel ed
'. by an older single-family dwelling which is of questionable physical
condition. It is not known whether the building is occupied.
The Aspen City Council on July 26, 1976 approved the conceptual sub-
division and suggested to the Planning and Zoning Commission that an
economic impact statement or a market feasibility analysis be done,
pursuant to Section 24-2.8 Mandatory Economic Studies of the City Zoni g
Code. Such report would consider the suitability of the project and
possible costs to be incurred by the City as a consequence of develop-
ment of the project.
The City Engineering Office has not had sufficient time to prepare
their analysis of the preliminary plat and requests that the public
hearing be continued until August 17, 1976.
The Planning Office recommends tabling the hearing until August 17, 1976
and requiring the above described economic studies be prepared by the
applicant.
