Regular Meeting Aspen Planning and Zoning September 3, 1974 The meeting was opened at 4:10 p.m. by Chairman Spencer Schiffer with members Jack Jenkins, Robert Barnard and Janet Landry. Also present were City/County Planner John Stanford, City Attorney Sandra Stuller and Yank Mojo of the Planning Office. Approval of Minutes Chairman Schiffer mentioned that the Commission would like more complete minutes in the future. The concern was over the minutes of the August 20th meeting in which the trail plan was discussed. Schiffer wished that that particular section be revised to include his reasons for voting. Motion Motion was made to approve the minutes from the followinS meetings: Continued of July 9: Regular of July 16: Regular of July 23: Regular of August 6: Public Hearinge of August 8 & 15: Special of August 13: Regular of August 20 and the Continued of August 22, 1974 by Dr. Barnard and seconded by Jenkins. Motion carried. Old Business The Commission was shown a letter to the City Council stating the P & Z's position on the rezoning proposal. In essence, the P & Z felt that they had not been given enough time after the maps were finished to analyze it properly, that the concept of "Zoning to use" along with designation of non-cumulative zoning districts is not acceptable, and that the map and code failed to accom- plish the objectives of restricting new development whilE encouraging permanent long term housing. Motion Motion was made by Jenkins to send it to the City Council. Motion carried. approve the letter and to Seconded by Barnard. Resolution Resolution on Trails System Plan Amendments been discussed at the August 20th meeting. Hallam Street in the Resolution. which had This excludec Motion Jenkins moved to adopt the Resolution on the Trails System and Landry seconded. Motion carried. Exemption from Subdivision - Mt. View Studios Mr. A.C. Nicholson was present to explain his plan to the members. Nicholson said that he wished to condominimize his studios and provide long term units for sale. He noted that many of his current tenants would probably buy their units. He was asked if he could provide eight parking spaces and also put protect- ive covenants in the condominium declarations restrictins to six months or longer tenancy. Motion Barnard moved to grant exemption from subdivision to the Mt. View Studios conditional on providing eight parking spaces and having a clause in the covenants to cover long term leasing only. Jenkins seconded. Motion carried. Ordinance 19 - Exemption Institute Architect Ellen Harland wished to have on the record that the Institute was not playing the "door game" in that the units would either be eight two bedroom or twenty four separate but would not have the doors positioned so that any other arrangement could be made. Motion carried. This was a request to put in a maids' quarters in an already existing tunnel. Only one of the two variancee was granted by the Board of Adjustment who drew up a Resolution stipulating conditional approval based on: construction is limited to one unit of not more than 500 square feet to house not more than four maids and a small office, laundry and storage area: one condo- minium unit be designated for the manager: that the manager be housed in another unit on the premises should the unit be sold: that the Association purchase a manager's quarters: no building permit be issued until a lease is drawn up for the manager's quarters or a purchase agreement for the same be approved by the City Attorney: finally that the applicant would be excused from providing the two additional parking spaces lost by the development. The applicant agreed to this Resolution and was also asked to join any future sidewalk improvement district. Barnard moved that they give preliminary and final approval conditional upon the applicant's agreement to abide by the Resolution and also to join any future sidewalk improvement districts. Landry seconded. Motion carried. Chairman Schiffer disqualified himself from voting since the applicant is a client of Schiffer's firm. Jenkins temporarily presided. Mr. Koutsoubos asked that he be allowed to take the Old Snowmass Grocery Store and move it next to the Pitkin County Grainery. He explained that he was the sole owner of the land on which the Grainery stands and would make the old grocery into an office using the facilities of the Grainery. Exemption was asked because of three trees that would have to be cut down should the move be delayed until construction begins of the Shellman-Daggs building next to the Grainery. Dr. Barnard expressed his concern over not having any facilities in the building and although the Building Inspector had ruled that one need not be put in due to use and space, he thought one should be provided. The applicant agreed to put in a bathroom in the building. Barnard moved that the Commission grant that a hardship existed due to the trees and that conceptual, prelim- inary and final plans be given approval. Landry seconded. Motion carried. Motion was made by Barnard to approve conceptual plans conditional that the miner's cabin remain employee housing and that the new duplex being built also be designated for employee housing. Regular Meeting Aspen Planning and Zoning September 3, 1974 Patterson Duplex Originally scheduled under Ordinance 19 Exemption but City Engineer did not have time to make his recommendations so only conceptual could be voted on. Applicant has 6,600 square feet of land on the corner of Cleveland and Waters that he is using for employee housing. During the season he has thirteen employees in two two bedroom units. Mr. Patterson would like to build another bedroom unit so that employees wouldn't be cramped and also enable him to hire another employeE for the season. Landry wanted to see that the lease be long term if possible. Applicant said he usually hires to the Music School people or else on a six month basis durins the off-season. Motion Motion was made to grant conceptual approval condition- alan long term leasing by Barnard, seconded by Jenkins. Motion carried. Motion was made to adjourn by Barnard, seconded by Jenkins.
