Continued Meeting Aspen Planning & Zoning Commission May 24, 1973 Meeting was reconvened at 5:15 p.m. by Chairman Adams with Charles Collins, Barbara Lewis, and Charles Vidal. Also present City/County Planner Herb Bartel and Assistant Planner Fred Wooden. Stream Margin Request - Charles Worth The Planning & zoning Commission recommended approval of request last year pending study on flood hazards by the Corps of Engineers. Build- ing date in November was specified but Worth did not build at that time. Letter from the Corps indicates the water in Castle Creek adjacent to Lot 10 would reach depths of about 3' from Intermediate Regional Flood flow (lOa-year) and 4' from Standard Project Flood flow. Under these conditions Lot 10 would be flooded. Worth has amended his building site to correspond with these figures. Plan is to have the house out of any of the floods that are shown on the Corps' map; however, Worth does plan an art studio within the area of the Standard Project Flood. Collins feels the City should receive a letter from Worth releasing the City from damages incurred by flooding. Collins moved to approve the issuance of a build- ing permit with the condition of the letter of release from the owner. Lewis feels there should be the stipulation that the studio cannot be used later for living purposes. Collins amended the motion to say that any building on the site be located above the Inter- mediate Regional Flood (lOa-year flood plane) as set forth by the Corps of Engineers. Also the letter of release be submitted. Seconded by Lewis. All in favor, motion carried. Hotel Jerome - View Plane Herb Bartel asked the Commission for approval to set public hearing for the second P & Z meeting in June to discuss a view plane from the Hotel Jerome toward Aspen Mountain. Commission all in agreement to ask Planning Office to set the hearing. Master Plan Amendment Resolution - Roaring Fork Greenway Proposed resolution is to be adopted as an addition to the General Plan to be used as the basis for the stream margin review and not to become law. Resolution must be accepted by the Planning & Zoning Commission to be passed on to the City Council. No restrictions will be placed on buildings along the Greenway.
