August 22, 1972
Meeting was called to order by Chairman Robin Molny at 5:15 p.m. with James
Breasted, Charles Collins, Anthos Jordan and Charles Vidal.
Meeting called to draft recommendation to Council of water line extension
(Barnard) .

Chairman Molny stated for the record, although he and Dr. Barnard had locked
horns on several occasions, he felt he could be objective in making a de-
cision on this request.
James Adams arrived.
City/County Planner Herb Bartel explained the recommendation to Council
should include a brief summary of what has been discussed at previous meet-
ings on this subject. Meeting of July 25th, City Manager explained the
water master plan. Items of significance mentioned at the meeting were:
what the City really needs is an offically adopted water plan so the P&Z
is not in a position of having to review individual lines; also as a part
of this there should be phasing, so it would be known which areas are in-
tended to be served first.
Meeting of August 17th included discussions with Mr. Rea and Attorney
Balcomb. Items of this meeting having significance were: water engineer
felt they were just responding to land use decisions; 18"line on a loop can
serve a lot of'people, over-all plan shows a looped line; proper place to
end the line is at Woody Creek and it be placed on the railroad right of way;
Balcomb stated very strongly that to protect the water rights need to store
water, water line extensions do not cover protection of water rights over
all; sewer should be planned along with planning for water; as relates to
private individuals, feel the City is responsible to determine that there
will be water to serve them before a subdivision etc. is approved; water
lines can be completely controlled by the City.
Mr. Bartel explained he had talked to County Attorney Oates and the pending
law suit with the County, may have a decision within 7 months. Law also
provides for a 90 day appeal period.
Chairman Molny stated he felt the water line should not be extended if the
court does not uphold the zoning.
Mr. Bartel stated the significant points are: (1) the pending law suit; (2)
water lines have to relate to current master plan of the area that is adopted,
there exists a general plan that needs to be up-dated for that area; and
(3)utilities have to be planned together. If the court upholds pitkin County,
the conditions for water line extension should include the following: Plan
for the area; Plan for sewer service; agreement with County with respect to
the city's approval of development projects so the City could have some
control; transportation considerations. If the zoning is upheld or not up-
held, that parcel will be developed whether the water is extended or not.
Vidal stated he felt there is no basis for making a decision on this request
without an up-dated land use map plus the pending litigation.
Vidal moved that the Commission recommend to City Council that extension of
any water transmission mains into Pitkin County not be permitted until such
time as an official master water plan and an official sewer plan are adopt-
ed which are based upon an up-dated land use master plan and an acceptable
agreement is arrived at between City and County regarding review of all de-
velopment plans in the County that lie within the adopted City water service
area. Seconded by Adams. Roll call vote - Breasted aye; Vidal aye; Collins
aye; Jordan aye; Adams aye; Molny aye. Motion carried.
Adams moved to adjourn
