Planning and Zoning
December 18, 1972
Meeting was called to order by Acting Chairman James Adams with Charles
Collins, Anthos Jordan, Bruce Gillis and City/County Planner Herb Bartel.
Acting Chairman Adams opened the public hearings on amendment to the defin-
ition of Subdivision and Uses allowed in the A/F zone.
There being no comments, Acting Chairman Adams closed the public hearing.
Charles Collins moved to recommend to the City Council that the amendment to
the definition of subdivision and amendment to the A/F zone be adopted and
Mr. Bartel prepare a resolution to that affect. Seconded by Jordan. All in
favor, motion carried.
Barbara Lewis arrived.
Attorney Albert Kern was present to request consideration of access to a
potential subdivision located at the end of Riverside Avenue. Closing on
the property will be this week and prospective buyer wants to be assured
that he can develop the property without any problems as relate to access
to the lots. Reported the City has treated this street as a street although
it has never been dedicated: plowing, oiling, appears on south side annexation
plat, waterline constructed down the center of the street. The street width
at the beginning is 50' wide and then narrows down to an unknown width at
the start of the subdivision. Reviewed the Willits map and old Colorado
Midland map.
Commission discussed problems that may occur with development at the end of
the street and accessibility of equipment and emergency vehicles.
Attorney Kern pointed out it is not the owners responsibility to widen a
street outside of his property lines. The width of the street is not his
responsibility and the City has considered this a street and prior to being
in the City, the County has plowed this street for at least 20 years.
Commission requested Attorney Kern to obtain a legal opinion from the City
Attorney or the City Engineer that this is an approved street and purchaser
will not be responsible at the time of development.
Trueman Property - Proposed letter was submitted by Anthos Jordan relating
to uses for the property. Herb Bartel stated the Planning and Zoning Com-
mission should prepare a list of uses and submit this to the people who will
be working on management study of this property prior to their report going
to Council. January agenda consideration.
Mr. Bruce Gillis stated he felt the P & Z was not doing any planning only
putting out fires, need direction. Perhaps the duties of the Planning
Office should be redefined so that more planning can be done. Suggest
further that the City and County P & Z Commissions be combined, perhaps a
third administrator be hired to handle only the zoning matters, combine the
building inspection offices and establish priorities for the planning office.

Herb Bartel explained that the breakdown is caused by the master plan and
zoning codes not being up-to-date, therefore, planning is done when it hits
the Commissions as a problem i.e. subdivision plats etc. Specific action
could be recommended to the Council, Commissions are bogged down with ad-
ministrative detail. Could hold only one zoning hearing a year, and could
establish a long range planning commission. A proposal should be written
to obtain reaction to it first. Commission referred this to the January
agenda.
Master Plan Amendments - Herb Bartel stated he had met with the City Attorney
on preliminary recommendations on the Greenline regulations.
A formal resolution will be drafted for P & Z consideration.
River Study - The third draft was sent back to the students who will prepare
their final re-writes in January for P & Z consideration.
Trails - The amendment for trails will be before P & Z shortly for consider-
ation.
Herb Bartel reported the Council has requested the Planning and Zoning pre-
pare the view control ordinance that is essential to preserve the view
that dispersed parking would preserve.
Herb Bartel reported he has one rezoning request for the February hearing
and will submit preliminary information to P & Z in January.
Jordan moved to adjourn at 6:10 p.m., seconded by Collins. All in favor,
meeting adjourned.
