Study Session Aspen Planning & Zoning Board of Zoning Adiustment August 10, 1971 Members present: Planning & Zoning Commission James Adams, Vice Chairman James Breasted III Victor Goodhard Anthos Jordan Board of Adiustment Eleanor Hubbard, Chairman Jerry Hobgood Remo Lavagnino Charles Paterson Also present Clayton Meyring, Building Inspector and Herb Bartel, City/County Planner. Meeting to discuss problems recognized by the Board of Zoning Adjustment in carrying out the spirit, intent and criteria established under the zoning ordinance. Height Variances Height Variances - Adjustment Board has difficulty in trying to determine how far they can carry the guidelines of the Board as relates to steep lots and dealing mainly with multiple family dwellings i.e. visual pollution. Robin; Molny, Chairman of the Planning and Zoning Commiss- ion arrived. Planning and Zoning Commission stated they would take note of this fact and in the planning stage at this time is the process of working out guidelines on sight lines. It was noted the City in measuring height uses the street as the guide, whereas the County uses a reference point of the site itself. Question was asked if the Board of Adjustment can consider density, congestion etc. when considering a height variance. It was pointed out if the Board of Adjustment is concerned about density in a certain area, this should be referred to the Planning and Zoning Commission and this falls under the jurisdiction of the Planning and Zoning Commission. Intent and purpose of the zoning ordinance refers mainly to the planning process. Charles Collins of the Planning and Zoning Commission arrived. Planning and Zoning Commission informed the Board of Adjustment an ordinance is now in the mill allowing Planned Unit Development which may eliminate some of the problems of the Board of Adjustment. Mr Bartel pointed out, as a guide to the Board of Adjustment, that if there is any obher means of accomplishing what the applicant is re- questing other than a variance, these avenues should be investigated first. Discussed those areas, mainly bottom of the mountain, that perhaps should be reviewed as relates to being un- developable, and put into a certain zone. ."....-----.. ~ RECORD OF PROCEEDINGS 100 Leaves FOil'" ~l C. Study Session, Aspen P & Z, Board of Adiustment, S/lO/7l Planning and Zoning Commission agreed they would study and review the requirements as relates to height, AR zone south of Durant etc. prior to the next construction season. lO% Open Rear Service Yard lO% Open Rear Service Yard - Board of Adjustment questioned under the intent of the oridnance is this entire area to be set aside for trash storage. The space required by ordinance is more than is needed. Planning and Zoning Commission pointed out this area can also be used for parking and deliveries. Planning and Zoning will be reviewing this under the recodification of the entire zoning ordinance. Isolated Lots Isolated Lots - Main problem is when such a lot does not abut upon a public street but does abut upon a private road. Mr. Bartel pointed out residential areas are not nearly as important as an industrial site. Planning and Zoning request the Board of Adjustment use good judgement where residential lots are concerned to see that safety is not impaired. A single family dwelling or duplex see no objection to the granting of a variance. Stream Margin Regulation Stream Margin Regulation - Mr. Bartel explained briefly the stream margin regulations. It was requested the City furnish the Board of Adjustment all new ordinances relating to zoning. Parking Parking - It was pointed out presently under consideration is the C-C and C-l a requirement for leased parking only and small parking lots until such time as the City is able to come up with an over all solution to the parking problem. Chairman Molny request the Secretary amend the last study session minutes to include under the concensus on Zolin~ the following words "and apply for annexation at this time." ORDINANCE NO. (Series of 19~ AN ORDINANCE AMENDING SECTION 8, CHAPTER 1 OF TITLE XI OF THE MUNICIPAL CODE OF THE CITY OF ASPEN ENTITLED "PARK" TO INCLUDE PROVISION FOR AF-AGRlCULTURAL/FORESTRY ZONED DISTRICTS BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1. Section 8, Chapter 1 of Title XI of the Municipal Code of the City of Aspen is hereby amended by adding a new zoning district entitled "AF-Agricultural/Forestry" to read as follows: "11-1-8: PARK AND AF-AGRICULTURAL/FORESTRY (a) P-PARK: Intention - to insure that land intended for recreation use is developed in such a manner to serve its intended use while not exerting a disruptive influence on adjacent uses of land. Open-use recreation facilities are permitted and recreation club buildings are included - subject to approval. (b) AF-AGRlCULTURAL/FORESTRY: Intention- to allow utilization of land for agricultural/forestry and low density residential purposes with customary accessory uses. Recreational, institutional, public and other com- patible uses customarily found in proximity with those uses permitted by right are included, subject to approval of the Board of Adjustment. Uses-Permitted l. One family dwellings, two family dwellings, access- ory buildings and uses, home occupation; 2. Farm, ranch and agricultural buildings and uses-- provided that all such buildings and storage areas are located at least lOO feet from any property line; 3. Nurseries and green houses; 4. Identification sign, directional sign, for sale sign--subject to requirements under Supplementary Regulations of this Chapter. Uses-Conditional - subject to the approval of the Board of Adjustment. l. Public buildings, schools, churches, hospitals, radio towers; 2. Sewage disposal areas, water treatment plants, water storage and reservoir areas; 4. Electric substations, gas regulator stations (not including buildings for business offices, repair or storage). Minimum Lot Area l. Unsubdivided land 5 acres 2. Subdivided land . 2 acres Minimum Lot Width l. Unsubdivided land 300 feet 2. Subdivided land 200 feet Minimum Front Yard l.
