HISTORICAL PRESERVATION REGULATION
Historical Society asked to present views:
1. - Historical Building and Sites Committee:
Society's power limited in area of old buildings and sites.
Place emphasis on certain buildings and sites, not all need
to be saved.
Charles Brandt of the Society stated he welcomed the first draft by
the Planning Department. Draft was reviewed and the following are
recommendations of the Society:
Ordinance is good and has teeth in review procedures.
Procedure rules - Three Society members may not be to communities
best interest. Society would like to submit a list of six names
of interested people, members of the Society or not.
Mr. Bartel commented the bylaws may include this procedure and not
write this into the ordinance.
Mr. Brandt stated he agreed with that.
The Society recommends that the removal and demolition section maybe
of too much concern to property owners.
Repainting paragraph could be an area which might discredit ordinance.
Suggest this requirement be deleted, Society could act as consultant
in this area.
Society would like to participate in selectionof historical zones or
areas. Planning Commission may have the use of the Society's historical
information.
Suggest only public or quasi-public buildings be considered and a part
of the first ordinance.
Question was asked by the Commission if the Society had an inventory
of areas where views could be preserved, certain open spaces of his-
torical value and of course buildings.
Suggestions were made by Mr. Brandt of the lower terminal of the old
number 1 lift, Opera House, some sections of blocks with old houses on
them, Silver Queen should be preserved.
Question was raised that is there a good defense for retaining the his-
torical zone if a change in property owners occurs and new owner does
not concur with the zoning.
It was pointed out each Historical zoned area must be very thoroughly
documented to support the historical zoning. The Society will assume
responsibility at public meetings of providing arguments for the ord-
inance, where it has worked, how it increases property values, how it
does not deprive owners, etc.

Robin Molny reopened meeting at 5:10 p.m. Present: James Breasted,
James Adams, Anthos Jordan and Charles Collins.
Stream Margin Request -
presented a plan of the
End Avenue and Hopkins.
Herb Bartel introduced Dick Fitzgerald who
proposed building to be constructed at West
Consisting of 16 studio units.
Victor Goodhard arrived.
Dick Fitzgerald showed the corner of the property that was the subject
of his stream margin request. Mr. Adams asked if he had considered
moving the building forward and making it two story instead of one,
to better protect the river and leave more space open. Mr. Fitzgerald
said that they had thought of moving the buildings forward but that
would cut down on the parking spaces in front. He felt that two
stories would only bring more attention to the structure.
Mr. Bartel stated he had not seen the plans that were just presented
this evening before and that he did not like the looks of the housing
unit. He reviewed the requirements for application of stream margin
variance and said all was in order except for where the building
touched the hook on the river.
Fred Wooden took over and explained that he had seen the property and
that the property line was just over the bank of the river. The platt
showed the building staying on the same contour to the western most
corner of the property and that some sort of fill would have to be
used to level the corner. He was concerned that some spillage would
fall into the river. He recommended that the building be moved forward
and then backfill the corner. He also said that a survey plat should
be submitted and viewed by the commission before a decision was reached.
Dick Fitzgerald said a survey plat should and would be submitted.
Mr. Adams asked that the survey plat show contours of the property.
Herb Bartel said that it would only be necessary to show contours
in the corner in question and not of the entire property.
Robin Molny asked that the plat show elevations on the corner and
contours on the rest of the lot.
Mr. Adams stated thatit looked to him that only a m~n~mum of effort
had been put forth on this request and that he felt that all the
requirements should be met first before this request was moved upon.
Jordan suggested tabling the request until all the information was
submitted by Mr. Fitzgerald.
Mony said that he had a per sonal comment to make and that Mr. Fitzgerald
might not like it but he was going to say it anyway. He said
that this was one of the worst set of plans for a proposed building
that he had ever seen. And he would personally vote against such a
poor looking structure and one so cheaply constructed.
Dick Fitzgerald defended his plan by saying that that is one of the

reasons for moving it so far back on the lot. That something worse could
be built on that spot. And that he intended to plant much foiliage
around the structure so that eventually you would not see it at all.
He then asked if the commission would refuse the request because of
the design. Mr. Adams said no. Also Mr. Breasted said that they could
not do this. Robin Molny reiterated that the commission had not such
right.
Dick Fitzgerald further defended the proposed building by saying
that it would be long term rental only. That these studios units were
badly needed in the community. And it filled a very important need.
Units would rent at $155.00 per month.
Breasted moved to table the request until the survey and contour
plats were submitted and studied. Jordan seconded. All in favor,
motion carried.
Molny moved to adjourn at 5:45 p.m., seconded by Breasted. All in favor,
meeting adjourned.
