Regular Meeting
Aspen Planning & Zoning Commission
November 10, 1970
Meeting was called to order by Chairman Robin Molny at 5:05 p.m. with James
Adams, Irwin Harland and Vic Goodhard. William Tharp excused. Also present
City Manager Leon Wurl and Planner Herb Bartel.
Minutes
Harland moved to approve the minutes of October 27th as
prepared and mailed by the Secretary. Seconded by
Adams. All in favor, motion carried.
Rezoning, Block 8
Riverside Add.
Rezoning Request - Pre-hearing - Chairman Molny reported
this property has been involved with two other rezoning
requests, formally heard one other time. Block 8,
Lots 1 through 8, Riverside Addition.
Chairman Molny reported he has a conflict of interest as
relates to this request and would abstain from direct
discussion and abstain from voting.
Mr. Don Fleisher and Mr. John Doremus were present as
the applicants on this request.
Mr. Fleisher made the following points to the Commission:
Property is 21,000 sq.ft.; requesting RMF zoning;
maximum number of units could be 14 of any size, planning
on building 10 to 12 units in order not to build too
close to the highway and feel a reasonable return can be
made with 10 to 12 units; adequate sewage and water
facilities are available for multiple use in this area;
property is contiguous to RMF property; west of the
Roaring Fork River is developed in condominiums for
tourist use; proposed units would be used for permanent
people, apartment house; willing to make a committment
to the City, the units would be used for apartments only;
property lies between RMF zoning and non-conforming
uses; feel the Rio Grande Right-of-way is a better
dividing line than what now exists.
Mr. Doremus added the following comments: There is a
need for this kind of housing, cannot pay the tourist
zone prices to build this type of housing; scarcity
of RMF land; feel the RMF zone should be extended in
this area since this type of use now exists in this
area.
Mr. Fleisher reported noting more than rezoning would be
required.
Mr. Herb Bartel, Planner informed the Commission they
should discuss the future of this area as relates to
additional requests. If this request is granted, the
Master Plan will have to be amended. Master Plan calls
for single family dwellings in this area.
Mr. Fleisher reported they have an option on the property
which will be exercised if the rezoning is granted.
Mr. Adams questioned the applicants as to what restrict-
ions they would accept: Mr. Fleisher stated - number of

units, number of bedrooms and restrict the use to
apartments. Mr. Doremus suggested the restrictions
be enforced by covenants going with the land. It was
pointed out the local government does not enforce
covenants unless they are a party to the covenants.
Question was raised that there maybe too much AR-l land
and not enough RMF. Commission to discuss this request
at their next week study session.
Harland moved to schedule a public hearing on this re-
zoning request for December 8th. Seconded by Adams.
Roll call vote - Harland aye; Adams aye; Goodhard aye;
Molny aye.
Ten foot alley setbacks in commercial zone - Manager
Wurl reported he had walked the alleys this date with
the City Engineer, Planner and Mr. Goodhard of the trash
service and discussed the possibility of 1 or 2 locations
in the alleys for trash only. The parking requirements
have caused congestion in the alleys.
Commission to discuss at the study session.

stated in the City Council minutes of November 9th.

Manager Wurl reported he and the Council are concerned
with the requirement of off street parking. When the
business owner proceeds to follow the requirement,
objections are received. Referred to Carl's Pharmacy
in that Mr. Bergman purchased land across from the Hotel
Jerome and this last week proceeded to clear the land
for parking. Objections were raised over the cutting
of the trees on this land.
Planner's Report - Mr. Bartel reported he would be
meeting with the people in Redstone on November 11th
to informally discuss zoning for that area.
Also reported, while in Boulder at the Planning Institute
talked with Bob Leigh of Voorhes Associates and they
will be sending three proposals as relates to transport-
ation.
Further reported, at the joint meeting of the City
Council and County Commissioners the Contractors
Association reported they would be willing to provide
equipment and fill to do the Buttermilk and Airport
turn-offs this year.
Mr. Bartel explained he had talked to the State on
cost estimates of turn-offs and it is estimated to cost
approximately $30,000 per area. Questionable at this
time as to whether paving would be required.

Further reported, the County Planning and Zoning
Commission has visited the Airport Business Center.
The general permissiveness under which the zoning was
granted, has lead the County Planning and Zoning
Commission to research their records in order to suggest
to Mr. McBride what they would like to see developed
in this area.
Rezoning Criteria - Copies of the criteria used for
previous requests was submitted. Commission request
the Secretary indicate to applicants, this criteria
will be used in reviewing requests.
It was reported a carry-out restaurant is being con-
structed between the Hotel Jerome and the First National
Bank, restaurant called the Food Factory.
Commission agreed to meet for a study session on
Wednesday for lunch to discuss the rezoning request and
alley setbacks.
Adams moved to adjourn at 6:20 p.m., seconded by Harland.
All in favor, motion carried.
