, 1977, by and between Lyle D. Reeder ("Subdivider"),
and The Ci ty of Aspen, Colorado, a Municipal Corpora tion ("Ci ty").
WITNESSETH:
WHEREAS, Subdivider is owner and subdivider of a tract of
land within Pitkin County, Colorado, consisting of Lots A, B arid C
Block 70, City and Townsite of Aspen, County of Pitkin, State of
Colorado.
WHEREAS, Subdivider has submitted to City for approval, execution,
and recording a Subdivision plat of the above described property,
such Subdivision to be known and designated as"Aspen Wild Condominiums";
and
WHEREAS, the City has fully considered such subdivision plat, the
proposed development and the improvement of the subject property
shown thereon, and is willing to approve, execute, and accept said
plat for recordation upon the agreement of Subdivider to the matters
hereinafter described, which matters are deemed necessary to protect,
promote, and enhance the public welfare; and
WHEREAS, Subdivider and the Ci ty wish to reduce said agreement
to writing,
NOW, THEREFORE, in consideration of the premises, the mutual
covenants herein contained, the parties hereto hereby agree as foll~ws:
I. Subdivider covenants and agrees to and with the City that
they will affirmatively consent to and join in the for!mation of
any special improvement district, encompassing all or any part
of Aspen Wild Condominium.;Subdivision.., tha t ma y hereafter be
proposed or formed for the construction of streets, alleys and
drainage improvements or buried electrical improvements. Sub-
divider hereby waives and further covenants and agrees to waive
any right of protest against the formation of any such district.
2. Owner and subdivider, for itself, its successors in interest,
grantees and assigns, covenants and agrees that in the event the

City undertakes street improvements (including paving, curb and
gutter, and sidewalks) without the formation of a special
assessment district when such street improvements include im-
provements in the right of way abutting Lots A, Band C, Block
70, it will pay the actual cost of any such improvements abutting
the boundary of said Lots A, Band C such payment to be made to
the City within ninety (90) days after completion of the im-
provements and on receipt of written notice and demand for such
payment.
3. The improvements shown on the Final Subdivision Plat including
curb, gutter, sidewalks, and landscaping shall be completed as
a condition for the issuance of the Certificate of Occupancy.
4. Subdividers agree to execute a Promissory Note satisfactory
to the City in accordance with Sec. 20-l8 (a) (10). Prior to the
issuance of a Certificate of Occupancy, the Promissory Note shall
become due and payable. The sum of Nine thousand eiqht hundred
one dollar and no/100--'Dolla rs (9,801. 00 ) shall be con-
sidered full payment for all obligations for payment of cash in
lieu of land dedication as required by the provisions of Section
20-18 of the Aspen Municipal Code.
5. Upon execution of this Agreement by all parties hereto, City
agrees to approve and execute the final plat of the Aspen Wild
Condominium Subdivision and accept the same for recording in
the real property records of Pitkin County, Colorado, upon pay-
ment of recording fees and costs to City by Subdivider.
6. The covenants and agreements of the Subdivider herein shall
be deemed covenants that run with the land, shall burden the land
included within the Aspen Wild Condominium Subdivision,
and shall bind and be specifically enforceable against all
subsequent owners therof, including Subdivider, its grantees,
successors in interest and assigns.

DATE: March 23, 1977
This is a request by Lyle Reeder for Final Subdivision approval
for the Aspen Wild Condominium Subdivision located on Lots
A, B andC, Block 20, Aspen Townsite (the southeast corner
of Cooper and Garmish Street). The project consists of
nine (9) studio units of approximately 960 square feet in
size. The property contains 9,000 square feet and is
zoned R-MF. The City Engineer has reviewed the final plat
and Improvements Agreement and recommends approval. The
City Manager has approved the land value figure of $90,000.00
which calculates to a park dedication fee of $9,801.00
The Planning Office recommends final subdivision plat approval.
We note that a minimum six-month lease restriction applies
to this project by virtue of its location in the R-MF zone.

RE: Aspen Wild Subdivision - Preliminary Plat Public Hearing
DATE: December 2, 1976
This is a public hearing to consider the application by Lyle Reeder for
preliminary plat approval of the Aspen Wild Subdivision which consists
of nine (9) studio condominium units. The project is located on Lots A,
B, and C, Block 70, Aspen Townsite. The studio units would be 960 square
feet in size. The property consists of 9,000 square feet in size and is
zoned R-MF. Each studio unit is required to have 1,000 square feet of
lot area (9,000'square feet).
The comments of the Planning Office are as follows:
1. This development should be restricted by the six month
lease provisions to ensure use by long term occupants.
The building is located in an area of mixed residential
and tourist use and is very susceptible to tourist use
pressures.
2. The studio units are large (960 square feet) but we know
of no restriction on size for the studio units in the zoning
code. The units, as shown, do not appear to be easily
divideable intocone bedroom units.
3. We are inquiring as to the comment of the Electric Department
and the City Engineer as to possible electric transformer
difficulties in the area and will report to you as to our
findings.
4. The City Engineer recommends approval subject to certain
technical corrections on the plat and the adequacy of the
electric transformer.
5. The Planning Office recommends preltminary plat approval
subject to satisfaction of the above concerns.

Re: Aspen Wild Subdivision - Preliminary Plat Review
The engineering department comments are directed pri-
marily to discrepancies in the boundary description,
right-of-way widths and existing utilities.
The survey problems can be clarified with the surveyor.
The adequacy of the existing electric transformer for
the new project must be verified with the city electric
department. A storm runoff detention system must be
incorporated into the development plan and more detail
is needed for proposed landscaping. These last two
items can be readily solved. Subject to the above
comments the engineering department recommends
preliminary plat approval.

This is a request for conceptual subdivision approval by Lyle Reeder
for a nine (9) studio unit condominium project located on Lots A, B,
and C, Block 70, Aspen. The studios would be 960 square feet in size.
The property consists of 9,000 square feet and is zoned R-MF. Since
this is a condominium project, detailed building plans will be submitted
for review at Final Plat stage.
The Planning and Zoning Commission on October 5, 1976 recommended
conceptual subdivision approval.
The City Engineer recommended conceptual subdivision approval.
The Planning Office recommends conceptual subdivision approval. We want
t6.. point.out that the project is located in an area of mixed exisiting
use of apartments and lodges. No current means appears available to us
to guarantee the long-term residential use of this development.
