In Mr. Guy's absence, Mr. William Campbell, architectural partner of Mr. Guy and myself made an on-site inspection of the storm drain work on your property. In response to your questions and problems, I will offer the following. .. 1. You expressed concern about flood water coming down your driveway. Our engineers have assured us that this will not be the case. The City Engineering Office has inspected the final plat and agree with our engineers. I will agree to have a 2" or 3" asphalt lip constructed on the edge of the roadway (Park Avenue) where your driveway joins, in the event that your concern happen.;; to be correct. I will be available throughout the winter and will ask that you call me to the si'ce if flooding into your driveway occurs. If flooding into your drive- way occurs this winter I will have the asphalt curb constructed immediately next spring. " 2. The size of the pipe (18" diameter) is specified by the engineers for cleanout purposes. The 6urveyers determined an error in the location of your property line, therefore the alignment of the pipe had to be moved accordingly. If ~he pipe would have to be moved or if it became an obstacle in the event of utility installations to your property, the County Housing Authority would ag~ee to pay any expenses incurred on behalf of the pipe. It is quite likely that the City would have required you to install the same pipe as part of your duplex project, had your duplex been built prior to Midland Park. The drainage responsibility through one's property is that person's own liability. In this case, since Midland Park is above your property and we were required to provide proper drainage to the river, we were required to do all of the work. o o l~r. Dieter Bibbig September 1, 1978 Page Two f""', , ~. .~ Also, if you are to encounter a building location problem due to the pipe creating a setback greater than the build- ing code setbacks, the Housing Authority will then absorb any relocation of the pipe. 2b. I am not aware of the exact plan with regard to the irriga- tion ditch below the pipe outlet. I agree with your position. I will meet with Ted Guy and the engineers upon Mr. Guy's return (September 11, I believe) and you, and I'm certain we can work out a solution satisfactory to you. I don~t believe any additional improvement would be unattractive or detrimental to the value of the property. 3. I would like the opportunity for Ted Guy (or Nilliam Campbell) and I to meet with you and your contractors' claims "that inevitably I (you) will experience very adverse effects as a result of this pipe and right-of-way." I would like to discuss details of the claim with these people. My hunch is that any potential problems would be minor and could be easily overcome. If that proves to be the case, the Housing Authority will assume any financial liability incurred by you in development of your duplex. 4. In any potential dealings with the Midland Park owners, that would be done with the elected officers of the Condominium Association not with all 37 owners. The Housing Authority can assume liability for the items under discussion in this letter. I would expect that legal representation will not be necessary. I feel that your concerns can be worked out right now. " 5. I don't feel that insurance funds of $10,000 for anticipated costs is necessary. If I give you a guarantee by the County Housing Authority on the above items, I'm certain that you will feel that that's adequate insurance. I have asked that City Engineer, David Ellis, send you a letter assuring you that the pipe in no way affects your building permit for your duplex. Underground utilities do not impair upon the lot size for construction of your duplex. I would like to meet with you as soon as is reasonably possible. Please call my secretary at 925-5232, and she will arrange a time for us to meet. In -~esponse to your letter of 0:-22-7<3, conc!:rning an agreement for a right away of a drain pipe across my Sisters property, I have the following thougnts for both of us, o 1. We believe that the constr;uction of this drainage, system is unnecessary, and should there ever be a flood water, I feel there will be most of it coming down the subdivi- sion road right into my driveway and very little will be i in the new pipe. 2. The ditch beeing dug and the pipe used,is mu.ch larger thwl I wae advised about and does not fit and fo~low the eight foot spacing along the fence. Also, since the owners of the irrigation ditch,that traverses the slope, fear that your waters could destroy it, a pipe has to be ~ laid across that ditch. This will be highly ~~attractive and therefore all of the above, will be highly detrimental to the value of the property~ ~ 3. It is my intention to build a duplex on this lot. r had builders look at the pipe and the alignment and they ad- vised me, that inevitably I will experience very adverse effects as a result of this piptl and right of way. Depen- ding on how the utilities will have to be routed for said d)lplex and the complicated City Building Code I may very well run into much addi tio~lal expense because of the pipe having to dig under it for various reasons. o 4. Since this right of way ,is for a condominium project, I could not have a clause in the eas'e:aent that all ft;.ture costs relative to my project and your pipe be borne by the Housing Authority, as of course, I do not careto deal w~th 50 or so ol/mers in tile f1.<ture.
