Aspen Planning and Zoning
May 18, 1971
Meeting was called to order by Chairman Robin Molny with Chuck Vidal, Jim
Adams, William Tharp and Chuck Collins present. Also present Herb Bartel,
City/County Planner and his assistant, Fred Wooden.
Jim Adams left Council Chambers.
Sunday Street
Closing
Sunday Str~et Closing - Chuck Collins moved that the
Planning and Zoning Commission recommend to Council a
general approval of the Sunday Street Closing. Seconded
by Tharp. All in favor, motion carried.
Mr. Bartel distributed the Sunday Closing Proposal to
Commission members. (See attached.)
Comments were: 1 - The word "mall" should be delelled in
the proposal and in no way should it be associated with the
Sunday Street ClBsing. Too much controversy over the mall
idea.
Jim Adams returned to Council Chambers.
2-Increase in air pollution due to people looking longer
for parking places was discussed. Wondered why the Sanitar-
ian felt this Sunday Street Closing would actually increase
air pollution in the downtown area.
3-Felt the City should do a re-evaluation after several
weeks of Sunday Street Closing.
4-Would like paragraph Ie (as rewritten) as the preamble
in the proposal.
The Commission studied the map of the area to be considered
for the Sunday Street Closing.
Streets involved would be Cooper, Galena, Mill and Hyman.
Access to Sinclair Filling Station would be from Durant
to Galena. Alternative proposals to accomodate Sinclair,
Tom's and Aspen Drug were presented my Mr. Bartel.
Discussed the possibility of the City being taken to Court
by the Sinclair Station.
Tom's Market and Aspen Drug will also be open on Sunday.
Would like to have parking as close as possible for these
businesses. Would rather not use intersections for parking-
could make turn arounds anywhere else in the street. A
number of alternative routes and parking to accomodate
these three businesses were discussed.
Will take alot of manpower to help duplicate the Earth Day
Street Closing. Someone to put up signs, barricades, etc.

Will have to contact people who live in the proposed

want to move them after 7:00 a.m. Sunday. Suggested they
park their cars in Rubey Park Saturday evening. Also post
notices on the doors of all apartment buildings and rooming
houses in the area.
Decided to recommend the hours of Sunday Street Closing
be from 7:00 A. oM. to 7:00 P. M.
Will try to get as much information as possible to as
many people. Herb Bartel will contact the Sinclair Station,
Tom's Market and Aspen Drug.
Mr. Bartel introduced Fred Wooden as his assistant for the
summer months.
Mr. Bartel read the letter he had written in answer to
the petition from a' group of businessmen. (See attached.)
Recommend to Council to hours of Sunday Street Closing be
from 7:00 A. M. to 7:00 P. M. Also that they hold a
special meeting for the purpose of a public hearing on the
Sunday Street Closing on Planning and Zoning recommendation
prior to final decision. Would like to have the first Sun-
day Street Closing June 6th.

Change of Date of Meeting - Tharp moved to amend the by-
laws of the Aspen Planning and Zoning Commission with
reference to meeting date, changing it to the first and
third Tuesday of each month. Seconded by Collins. Roll call
vote - Collins aye; Tharp aye; Adams aye; Vidal aye; Molny
aye. Motion carried.
Revised City of Aspen Zoning Resolution - Will consider at
next meeting.
Recycling
Recycling - Barbara Baker of the Environmental Task Force
was present and requested a resolution from the Planning
and Zoning Commission backing up the Mayor's resolution to
study solid waste.
Have two buildings donated by the County for storing re-
cyclable materials.
Chuck Vidal moved that a definite benefit can be derived
from the study of possibilities of recycling and would
relate to the problems of Aspen and the RoaDing Fork Valley
studying the feasibility of it. Seconded by Tharp. Roll call
vote.- Collins aye; Tharp aye; Adams aye; Vidal aye; Molny
aye. Motion carried.
Fothergill-
Cutting Annex
Fothergill-Cutting Annexation - Emergency situation exists
since the water to both properties has been condemned. The
county water tap fee would be $1500 compared to the City
water tap fee of $750.00
Manager Wurl showed the Commission a map of the proposed

area to be annexed; property lies west of Garrish Park and
south of King Street. Manager Wurl explained that one of
the reasons for not annexing more property in this area was
due to a problem with property lines. Is now zoned County
R-6.
Tharp moved that the Planning and Zoning recommend this
property be annexed as desired by the property owners.
Seconded by Collins. All in favor, motion carried.

Change of Date of Meeting - Tharp moved that the new
schedule of meeting begin in June. Seconded by Adams. Roll
call vote - Collins aye; Tharp aye; Adams aye; Vidal aye;
Molny aye. Motion carried.

Leased Parking - Leased parking in the C-C zone is wrong
and should be discouraged.
Manager Wurl reported businesses were asking where the
leased parking is going to be and how much is it going to
cost.
The Planning and Zoning Commission's main criteria was no
leased parking but in the interim recommend Manager Wurl
with the aid of City Attorney Kern determine a fee.
Tharp moved that a public hearing be scheduled for June
22nd to amend zoning ordinance relative to parking. Seconded
by Vidal. All in favor, motion carried.
Tharp moved that a public hearing be scheduled for June 15
on the zoning for the Fothergill-Cutting annexation.
Seconded by Adams. All in favor, motion carried.
Stream"Margins - Planning and Zoning Commission will meet
at 4:00 P. M. on the 25th of May to visist the sites of
the Maddalone and Worth requests.
Collins moved to adjourn at 7:20 P. M. Seconded by Tharp.
All in favor, meeting adjourned.

This office has received a petition expressing your
opposition to closing downtown streets to vehicular
traffic. Planning currently underway for the central
area is the result of concern to maintain the vitality
of the dovmtown area as a center of attention for resi-
dents and visitors, and the need to keep the 1966 Gen-
eral Plan current.
The approach to updating the central area plan will be
to prepare the plan openly in a series of elements that
can be discussed thoroughly prior to final plan develop-
ment. The open planning approach will be used to develop
a better public understanding of the problem and alterna-
tive solutions. It will permit the consideration of inter-
est group opinions, encourage citizen participation, and
avoid suspicion of governmental planning activities. Pre-
liminary conclusions will be submitted to interested parties,
however considerable study is required to make these con-
clusions and such study is best accomplished at the staff
level.

It is intended to consider any proposed changes to the
central area plan as an amendment to the 1966 General Plan
following a carefully considered public hearing approach.
In order to keep you up to date on recent downtown area
development ideas, we have ordered a publication dealing
with the matter which we hope to distribute to interested
individuals.

The Sunday street closing, ,,,ith little or no detrimental
effect on area businesses, will give the community at large
an experience to relate to in deciding of the pedestrian
concept is desirable and worthy of further study.
In order to implement such a proposaJ- certain considerations
must be taken into account.
1. It is important to consider the basic reasoning behind

Sunday is the best day for a beginning, because very few
businesses relying upon customer pick up and delivery are
opcn, and the specialty shops and testaurants should not

d) Closing the area on any other clay would be premat1Jre

2. Protection from fire and crime must remain undiminished,
and therefore, all emergency vehicles 1/]Quld have free access
to all closed streets and alleys.

vehicles needed to service businesses and collect trasb in the
closed area. These vehicles should use the most direct alley
access to their destinations.

6. Keeping intersections clear of automobile traffic should
be a major objective of this proposal.
Alternative Parking
1. Adjacent streets east, west and north of the area pro-
posed for Sunday closing should be able to handle the bulk
of extra parking made necessary by parking not being allmved
in the project area. Sunday street parking in these areas is
generally sparse and must be utili:ced until additional off
street facilities are made available. Specifically:
a) Mill Street parking will transfer west to Monarch.
b) Galena Street parking \ViII transfer east to Hunter.
c) Hyman Street parking '>Jill transfer north to Hopkins.
d) Cooper Street parking \ViII transfer to the Center
lot and T)urant Street in front of North of NelL
2. Temporary off street parking areas needed to facilitate the
Sunday closing could possibly be located on the following
locations.
a) On present Center parking lot.
b) At SF corner of Hunter and Hopkins.
c) At SW corner of Hunter and Hyman.
d) On Rubey Park.
e) On vacant plot at Hyman and Monarcb.
f) At City Hall parking lot.
3. Residents of the closed area should be allo\Ved parking space
in the ]<.ubey Park parking area in order tbat they not have to
move their cars early on Sunday morning. It is important that
these people receive this information prior to the closure.
4. Traffic patterns \ViII shift in tbe area out of necessity,
\vith Hunter and Monarch Streets carrying the bulk of traffic
generated by Main Street.

2. Notices outlining the project's intent, with attached
map should bG clearly posted on the Clrea fringe and through-
out the project area. Distribution should be made to the
A.C.V.B., lodge owners, botb papers and tbe radio stations.
Leaflets should be 'videly distributed in the community.
3. Angle-in parking spaces will be available for Aspen Drug
and Tom's Harket customers on '2 block of Galena Street south
of Hopkins, and access to Tom's will be gaLned through the
alley in that same block.
4. The Ci ty T)ispatcher should be available to handle inquirie'3
and relay messages to officials in case of emergency.
5. Hajor conferences scbedules sbould be consulted in order
to determine peak Sundays and any special preparation necessary.
6. The closing could begin on Sunday June 6th and terminatE'
on Sunday, September 6th. The daily hours "lOuld be from 7 a.m.
until 7 p.m.
7. Initially, volunteers might be availablG at key access
points to explain tbe project, help \vith directions and moni-
tor comment.
8. Encouragement should be given to proprietors "Jithin the
area who wish to innovate and enhance the proposals, i. e. ,
side\Valk cafes, side,,,alk displays and sales. In all likeli.-'
hood a City permit w2uld be required in order to operate on
municipal land. This concept would enable 2dequate controL
9. Special activities should be encouraged on Sundays at
the intersection of Hill and Cooper adjacent to Hagner Park.
10. City bicycle rack locations should be indicated on the
proposal map.
11. The enforcement of this proposal must be of an official
nature.
12. The A.C.V.H. sbould be asked to solicit cmmnents concerning
the effectiveness of the Sunday closure from visitors and tourists.
