Adjourned Meeting
Aspen Planning & Zoning
January 20, 1970
Meeting was called to order by Temporary Chairman Robin Molny at 5:15 p.m.
with Francis Whitaker, William Tharp and James Breasted.
Also Present City Administrator Leon Wurl and City Attorney Albert Kern.
Leased Parking
Leased Parking - Administrator Wurl questioned the
feelings of the Commission as relates to leased parking
spaces fo r those buildings unalbe to provide on site
parking.
In the past have accepted the policy of leased parking
spaces either on a private basis or with the City.
Due to the building season approaching, the City is
receiving requests for the leasing of spaces. To date
there are no agreements with the City for spaces.
Previous research by Administrator Wurl and Robin Molny
found that in order to come up with a sound fee to
,harge would require a parking expert to review the
situation as to sites and fees. This would require a
preliminary study amounting to a cost of $6500 or
$7000.
Attorney Kern recommend to the Commission to obligate
the City to furnish parking spaces by a lease would
also require an actual plan for a parking structure or
parking spaces.
Commission agreed there should be no private leasing
but require leasing with the City only and the funds
received should be escrowed or earmarked for the
eventual construction of a parking stru.ture orspace.
Whitaker moved that the public hearing on February 9th
include a hearing on including Hillyard Park in the
Master Plan and an amendment to Section 11-1-9 of the
City Code relating to leased parking spaces in commercial
zones to the City only. Seconded by Breasted. Roll
call vote - Tharp aye; Whitaker aye; Breasted aye;
Molny aye.

Mr. Breasted to work with Attorney ern on the drafting
of the proposed ordinance.
Density
Density - Whitaker submitted a zoning code showing
the changes necessary for changing the density and also
the requirement of 15% open space.
Commission questioned Attorney Kern if an ordinance
ould be put into effect for a certain length of time.
Mr. Kern reported that it could be done but would have
to show and stated the reasons for the limitation.
Also caustioned the Commission on making constant
changes in the zoning code thus weakening the code.

Density
Temporary Chairman Molny stated the reason for the
limitation is the feeling of the Commission is to
lower the density requirements for one year thus
giving the P & Z time in which to study further the
densities and to slow down the building boom. Also
reported Attorney Gary Woodman of California has been
contacted to see if he would be willing to make
recommendations on the wording of such an ordinance.
Mr. Whitaker and Mr. Breasted to work with Attorney Kern
on the drafting of an ordinance to re-instate the
original densities as outlined in the Master Plan.
Commission agreed to have Jerry Brown and D. R. C.
Brown at the Public hearing.
Temporary Chairman Molny reported there would be a
meeting of the City Council, County COmmWssioners,
and both City and County Planning and Zoning Commissions
on Wednesday, 21st, 4:00 p.m., City Council Chambers
to discuss a regional planning Commission and planner.
Old Business
Commission agreed on the following priorties as relates
to old business, and commission members or member to
work on each item:
1. Buildings resembling signs or trademarks - Robin
Molny
2. - Stream Margins - Robin Molny
3. - Planned Unit Developments in Commercial Zones -
James Breasted , Ross Griffin
4. - Trash storage areas for new buildings - William
Tharp
5. - Set backs in C-C and C-l Districts and Density -
James Breasted and Francis Whitaker
6. - Service and Storage yards fencing - William Tharp
7. - Flood light regulations - James Breasted
8. - Review Preliminary Park Plan ) Hold
Trail Rights of way or scenic easements) in
Open Space ) Abeyance
Suggestion was made on #8 to have the firm of Schlupp
and Ferguson expand their park plan to include the items
mentioned under #8.
Street Plan
Tharp moved the City Administrator and City Engineer
be instructed to prepare a street plan for all annexed
territories not covered by the original street plan.
Seconded by Whitaker. Roll call vote - Whitaker aye;
Breasted aye; Molny aye; Tharp aye.
Temporary Chairman Molny suggest each member working
on a project pull in citizens of the community for help.
Absenteeism
Absenteeism of Commission Members - Tharp moved to
recommend the City Council review the requirement..of
possible termination of appointment on the Commission
following 3 unexcused absences defined as illness or
out of town. Seconded by Breasted. Roll call vote -

Temporary Chairman Molny request the secretary send
copies of the by-laws to all members.
Vio lations
Discussed the enforcement problems of non-conforming
signs, exposed lights and spotlights on signs.
Whitaker moved the P & Z make a formal request to the
Building Inspector to take action on the non-conforming
sign on Dr. Crandall's building and at the Hutch,
exposed tubes at Texaco and Chevron and spotlights on
signs at Carl's Pharmacy and the Winter Shop.
Seconded by Tharp. Roll call vote - Tharp aye;
Breasted aye; Whitaker aye; Molny aye.
Tharp moved to adjourn at 7:00 p.m., seconded by
Breasted. All in favor, meeting adjourned.
