Regular Meeting Aspen Planning & Zoning January 27, 1970 Meeting was called to order by Temporary Chairman Robin Molny at 5:05 p.m. with Fran is Whitaker, William Tharp, James Breasted, John Gilmore, Charles Vidal. Absent Tom Wells. Minutes Whitaker moved to approve the minutes of the adjourned meeting held on January 20th as prepared and mailed by the Secretary. Seconded by Tharp. All in favor, motion carried. Election of Officers - Temporary Chairman called for nominations for Chairman. Chairman Whitaker moved to nominate Robin Molny for Chairman and the nominations be closed and unanimous ballot be cast for Molny. Seconded by Tharp. Roll call vote - Vidal aye; Tharp aye; Gilmore aye; Breasted aye; Whitaker aye; Molny abstain. Chairman Molny called for nominations for Vice Chairman. Vice Chairman Tharp moved to nominate Breasted. Mr. Breasted declined the nomination on the basis he was too busy at this time. Whitaker moved to nominate William Tharp for Vice Chairman and the nominations be closed and unanimous ballot be cast for Tharp. Seconded by Breasted. All in favor, motion carried. Absences Whitaker reported to the Commission, the City Council did consider the P & Z's request relative to three unexcused absences of members and this is being con- sidered as an amendment to the Commission's by-laws. Secretary also reported the by-laws need to be changed relative to the stru ture of the Board. Commission request the by-laws appear on the next agenda. Chairman Molny reported he would be out of town at next Tuesday's meeting. Bd. of Adj. Liaison Board of Adjustment, liaison member - Discussed a member of both board being objective on the Board of Adjustment when considering a variation of the law which may have been proposed by the Planning and Zoning Commission. Vidal moved the Planning and Zoning Commission recommend to the City Council, James Breasted, and also recommend the liaison member be an ex-officio member only and the Council appoint a citizen to fill the Board of Adjustment vacancy. Seconded by Tharp. Roll call vote - Vidal aye; Tharp aye; Breasted aye; Gilmore aye; Whitaker aye; Molny aye. Swimming Poo 1 Swimming Pool - Letters from the State Planning Office requesting comments of the Commission on the pool at BavARIA Park was read by Chairman Molny. At Bavaria Park there would be a parking problem and also traffic problem at the junction of Highway 82. Secretary Graves reported the RSA had approved the site upon recommendation of the swimming pool committee, many sites were considered prior to this site being picked. The City anticipates running buses daily to Bavaria Park in the summer time for the summer rec- reation program. Commission agreed to request the presence of Administrator Wurl at the next meeting to discuss the pool. Committee Reports Committee Reports - Breasted reported he had contacted the City Manager of Boulder relative to planned unit development. Boulder is going to adopt PUD for the entire downtown area. Material is being sent to us from the City Manager. Also the Colorado Municipal League will send us what material theyhave. Mr. Breasted also reported he had tried to contact by telephone the consultant on the lights at the Holiday Inn relating to flood light regulations. Mr. Breasted requested authorization to send a letter to the con- sultant requesting material or ideas on how the City might go about drafting regulations for flood light contro 1. Commission granted permission for the letter to be sent. Whitaker reported the draft on density and open space will be ready by the next meeting. Commission request the Secretary contact Jerry Brown and request his appearance at the February 13th public hearings. Chairman Molny reported on bui~dings that look like signs and read draft of what Attorney Delaney had prepared for the County. Mr. Vidal questioned if this might be a type of architectual control. Chairman Molny to check out. Stream Margins - Regulations relating to set back from the river for the County as prepared by Attorney Delaney was read by Chairman Molny. Questioned raised on how you define the high water mark. Commission request Chairman Molny contact the State Water Engineer and the City's water engineer for guidance. Mr. Tharp reported on service yards and fencing stating the problem of service yards and fencing is an old one still unresolved. Legally how far can you push people to take care of unimproved lots and by requiring certain types of fencing isn't this also a type of architectual control. Meeting, P & z, 1/27/70, continued. people to follow one of the designs. Mr. Vidal to work with Mr. Tharp on this problem. RPC Regional Planning Commission - Mr. Whitaker reported the committee established to work out the structure of a commission will be ready for Council's consideration by the next City Council meeting. Chairman Molny reported he had talked to Pueblo, Boulder and Colorado Springs relative to the structure of a regional planning Commissio~. In Pueblo 51% of the commission consisted of elected officials and 49% represen~ation from districts such as school etc. In Boulder its comprised of both the City and County Planning and Zoning Commissions. Colorado Springs suggested hiring a planner first and he then help in working out the structure of the commission. Street & Annex. Whitaker suggest he redraft his proposal on streets and annexations and put it on the next P & Z agenda. Gilmore suggest a letter of thanks be sent to the people who have removed their signs. Chairman Molny to send . letters to those people. Commission request the Building Inspector make a report at the next meeting relative to non-conforming signs. Whitaker request the proposal relating to sidewalks be sent to all members and appear on the next agenda. Signs Ruby Park Mayor Homeyer was present and reported Ruby Park has been sold, the new owners willing to sell to the City at their cost. Suggest the City buy this land. Commission request this appear on the next agenda. Vidal moved to adjourn at 6:40 p.m., seconded by Whitaker. All in favor, motion carried and meeting adjourned.
