Special Meeting
Aspen Planning & Zoning
February 3, 1970
Meeting was called to order at 5:10 p.m. by Chairman Robin Molny with
William Tharp, Francis Whitaker, James Breasted, John Gilmore and Tom Wells.
Past Members
Chairman Molny request Mayor Homeyer send letters of
appreciation to past members of the commission for
their services on the commission.
Swimming Poo 1
Swimming Pool - City Administrator Leon Wurl gave a
synopsis of the history on the location of the pool at
Bavaria Park.
Charles Vidal arrived.
Mr. Gilmore questioned the size of the pool, it being
smaller than the present pool at the Hotel Jerome.
Commission members also questioned the site location
at Bavaria Park as relates to one perhaps being con-
structed on Wagner Park, Herron Park, Ruby Park or the
lots across from the Crystal Palace.
Letter from Richard Lee, Superintendent of S hools was
read by Chairman Molny relating the schools full
cooperation in this matter.
Discussed at a later time perhaps the necessity for two
pools, one at Bavaria Park and one downtown.
Administrator Wurl reported to the Commission, there is
not restriction in the deed of the land from Mr. Moore
that this land be used for a pool only refers to this
land being used for park purposes.
Administrator Wurl reported all material has to be sub-
mitted to the State prior to March 10th in order for this
project to be considered in this grant period.
Commission request Kay Roy head of the swimming pool
committee and Ted Armstrong of the Department of Parks
and Recreation appear at the next meeting of the Commission
Expenses - Chairman Molny request all members contact
Commission Expenses City Administrator Wurl's office prior to making telephone
calls to see if the information has already been obtained.
Also there is a section on planning in the City Hall
library. Postage should be run through the City Hall.
Ruby Park - Mayor Homeyer reported Attorney Nelson re-
Ruby Park Purchase presenting the new owners of Ruby Park would be in town
tomorrow to discuss with the Mayor and other interested
persons informally the purchase of Ruby Park by the City.
Mr. David Hopkins, Architect and Planner with Fritz
Densities Benedict's office, was present and showed to the
commission a comparison of the densities now on the books
and the densities as proposed in the Aspen Ar~General

Densities
Plan using as an example the Aspen Alps Complex. Suggest
perhaps the densities should be even lower than the
figures called for in the Master Plan. Also stated
the commission should look at the total picture as
relates to open space, density, height, set backs,
terrian etc.
Material relating to land use was submitted by Charles
Vidal and Chairman Molny suggest all members read this
material.
Francis Whitaker stated the rough draft of the ordinan e
pertaining to open End density would be ready by the
next meeting of the Commission.
Signs
Signs - Building Inspector Meyring reported last October
and November letters were sent to 22 people that had
signs that did not conform. Todate seven owners have
complied, eight submitted evidence that their signs
can remain till April 3,1972, seven that have not
complied or ignored the letter of request and one
case is now scheduled to appear before the Board of
Zoning Adjustment. In che<king back records have found
4 others that were not listed and letters were sent
to these last month.
Francis Whitaker request the Building Inspector check the
sign at Jon Chapman's place of business on East Hopkins.
Bldg. Analysis
Chairman Molny request the Building Inspector make
an analysis on the number of units and floor area ratio
in the C-C, C-l and AR-l zones by taking a samplying
of building types.
By-laws
By-laws - Mr. Whitaker stated he had gone over the by-laws
with the City Attorney and the following amendments should
be made: in Section I substitute the new ordinance;
under Arti le 6 section relating to employees shuuld
be deleted since this is established by State Statutes;
and a prepared resolution for the City Councils consid-
eration at their next meeting was read by Mr. Whitaker
relating to unexcused absences. Mr. Whitaker suggest
part of this resolution appear in the by-laws so that a
new member will be aware of the rule as follows:
"any member of the Planning and Zoning Commissiun who
has three or more unexcused absences from regular meetings
during the calendar year may be subject to removal from
said Commission by the Mayor and City Council of the
City of Aspen. An unexcused absence shall be defined
as one in which a member has failed to give advance notice
to the Secretary of the Commission when said member will
be either (1) out of town at the time in which the
regular meeting is to be held, or (2) is physically unable
to attend the meeting due to ill ness".
Whitaker moved that the by-laws be so amended. Seconded

Following reports were made: Chairman Molny reported
he had talked to one of the railroad officials who
Com. Member Reports stated they were willing to work with the planning
of the City for their 18.3 acres located in the City.
James Breasted reported he would have information relating
to planned unit development by the next meeting. Letter
from the firm of John Dempsey and Associates was read by
Chairman Molny. Commission request the Secretary send
a thank you letter to this firm thanking them for
the letter and inform them their letter would be put on
file. James Breasted reported he had heard from the
lighting consultant for the Holiday Inn. Chairman Molny
reported Mr. Backus of Adams County is sending us
information on how to figure the high water mark for
stream margins. Francis Whitaker reported he had talked
to the City Attorney as relates to streets and annexations
and Attorney Kern has requested time to re-read the
legislation that relates. Commission request the
Secretary show on each agenda outstanding business of
the Commission.
Mr. Vidal mentioned the Commission should consider
and confer with the administrative people involved
as relates to policy, financial ability, enforcement
etc before recommending legislation that cannot be
handled by the City.
Vidal moved to adjourn at 6:40 p.m., seconded by Well.s.
All in favor, meeting adjourned.
