Regular Meeting
Aspen Planning & Zoning
February 10, 1970
Meeting was called to order at 5:05 p.m. by Chairman Robin Molny with
William Tharp, James Breasted, Charles Vidal and Tom Wells.
Minutes
Tharp moved to approve the minutes of January 27th and
February 3rd as prepared and mailed by the Secretary.
Seconded by Vidal. All in favor, motion carried.
Francis Whitaker arrived.
Swimming Poo 1
Swimming Pool - Kay Roy, Chairwoman of the Citizen
Swimming Pool Committee and Ted Armstrong head of the
Parks and Recreation Department were present and
explained the history behind the pool and the structure
o c the pool.
John Gilmore Arrived.
Mrs. Roy explained Bavaria Park was chosen as the site
for the pool, (1) lights for night swimming, (2) daily
buses to the park, (3) close proximity to the school
for utilization by the school, (4) City Rerreation
Department is able to administer the running of the
pool and (5) land is presently owned by the City. A
public body has to own the land and maintain the pool
in order to receive financial assistance.
Mr. Armstrong pointed out the pool size is 75'1" x 42'
which is regulation size for competive swimming meets.
Also reported the pool will be large enough for Aspen
till Aspen's population reaches 4,250 people.

Mr. Gilmore stated the Commission should be given more
time in the future to consider items before the Commission.
Should not have to compromise on last minute items.
Consultants
Consultants - Mr. Whitaker informed the Commission the
City Council at their last meeting approved $300 to
obtain the services of Jerry Brown on a consulting basis.
Mr. Whitaker also reported the Council did approve a
resolution pertaining to absences of members of the
Commission.
Chairman Molny reported the RSA would be meeting on
Thursday at 4:00 p.m. and the agenda includes planner.

Density
Density Controls - Mr. Whitaker submitted to the Commission
the draft ordinance for the Commission to review prior
to the hearing to be held on Friday. Mr. C. M. Clark
was present and also suggest the Commission consider
the incentive ordinan' e whi.h was approved by the
Commission a year ago and turned down by the City Council.
Chairman Molny request the Secretary submit copies of
this ordinan e to the members. (Ordinance #5,Series 1969)
Clayton Meyring, Building Inspector, submitted an
analysis of buildings built in 1968jand some which have
applied at this time. <--~ L1b9
Mr. Tom Benton also pointed out a definition of height
of buildings should be considered.
Aspen Transit
Correspondence - Letter from Aspen Transit System was
read by Chairman Molny requesting to appear on the agenda.
Chairman Molny request this appear on the February 24th
agenda. Secretary instructed to send copies of the
brochure to the members.
Planning Inst.
Planning Institute - Chairman Molny request the Secretary
send copies of the letter to all members. Francis
Whitaker request authorization to attend this institute,
permission granted by Chairman Molny.
Wildcat
Copy of letter sent to the County Planning and Zoning
from Fitzhugh Scott relating to Wildcat was read by
Chairman Molny.
Chairman Molny explained the present status of the
RPC formation of a regional planning commission.
Memo and study from Fitzhugh Scott III relating to an
Environmental Study environmental study was submitted to the Commission.
Commission request the Serretary make a copy of the
study for the Planning Library.
Memo from James Breasted was submitted to the Commission
relating to new concepts in zoning.
Golf Course
Municipal Golf Course - James Breasted requested
authorization to send a letter to Tipco's planner re-
questing their planner work with the City and County
Planning Commissions for this area. Chairman Molny
granted permission for Mr. Breasted to write such a letter.
Fences
Height of Fences - Mr. Whitaker stated he was informed
there are no height regulations in the code for fences
in the AR-zones.
Mr. Whitaker moved to schedule a public hearing on height
of fen es in the AR-zones, stream margins, amend Master
Plan re-highway 82 and buildings that are signs or trade-
marks for March 3rd, 5:00 p.m., Seconded by Tharp. Roll

Sidewalks - Areas
Mr. Whitaker reported he would like authorization to
have the City Attorney draft an ordinan e relating to
sidewalks, park strips and parking areas, as per
recommendation submitted to the P & Z, for Coun il
consideration.
Mr. Whitaker moved to authorize Mr. Whitaker to work
with the City Attorney to draft an ordinance for Couneil' I
consideration on sidewalks, planting strips, parking
areas. Seconded by Breasted. Roll call vote -

Whitaker aye; Wells aye; Molny aye.
Ruby Park
Ruby Park - Mayor Homeyer reported Mr. Nelson is eagerto
work with the City and has offered to take the $85,000
now and if the bond issue fails he guarantees to pay
the $85,000 back.
Breasted moved to adjourn at 6:35 p.m., seconded by
Tharp. All in favor, meeting adjourned.

ORDINANCE NO.
(Series of 1970)
AN ORDINANCE AMENDING AND REPEALING CERTAIN SECTIONS OF TITLE
XI, THE ZONING CODE OF THE CITY OF ASPEN, COLORADO, RELATING TO
DENSITY, FLOOR AREA RATIO AND OPEN SPACE IN AR-l, C-l AND C-C
ZONES, AND DECLARING AN EMERGENCY TO EXIST.
BE IT ORDAINED by the City Council of the City of Aspen,
Colorado:
Section l: Purpose: The purpose of this Ordinance is
to promote the health, safety, morals, convenience, order, pros-
perity and general welfare of the present and future inhabitants
.of Aspen, Colorado, by: the lessening of congestion in the streets
and roads; securing safety from fire and other dangers; providing
adequate light, air and space; classification of land uses and
the distribution of land development and utilization; protection
of the tax base; securing economy in governmental expenditures;
and the protection of urban and non-urban development.
Section 2: Authority: This Ordinance amendment is authorized
by Article 60, Chapter 139 of the Colorado Revised Statutes,
1963, as amended and is hereby declared to be in accordance with
all provisions of these statutes.
Section 3: Section ll-1-2 (Definitions) of the Ordinances
of the City of Aspen is hereby amended to read as follows:
"(rom) Building Frontage: That
portion of a structure or structures facing a street which runs
in an easterly and westerly direction.
(nn) Building Site: Area of lot
or lots upon which structure or structures may be erected, inclu-
ding open spaces and public arcades.
(00) Floor Area Ratio (F.A.R.):
Ratio of total floor area of structure or structures and total
area of building site; and for the purpose of this Ordinance shall
be 2: 1.

(pp) Open Space: A portion of
a building site, one side of which shall be open to the street,
unobstructed from ground level to sky; no part lying between a
structure and an alley."
Section 4: Subsection (a) of Section 6, Chapter 1, Title
XI (AR-l ACCOMMODATIONS RECREATION) of the Ordinances of the City
of Aspen is hereby amended to read as follows:
"Minimum Lot Area

above ground shall not exceed two (2) times the total lot area of the
lot on which the strucuture is located; further provided that for each
square foot of public way space or public arcade space created at

"two square feet of floor area in the structure over the allowable
2:1 ratio. The 37-1/2 foot maximum height limitation shall still
be observed in this latter instance; and further provided that no
building or structure shall be constructed higher than 25 feet above
grade within 10 feet of the front or rear lot line."

40 feet, not to exceed four stories above ground. The
total floor area of the structure above ground shall not exceed
two (2) times the total lot area of the lot on which the structure
is located; further provided that for each square foot of public
ways space or public arcade space created at ground level on the
lot, credit shall be given for an additional two square feet of
floor area in the structure over the allowable 2:l ratio. The 40
foot maximum height limitation shall still be observed in this latter
instance; and further provided that no building or structure shall be
constructed higher than 30 feet above grade within lO feet of any
dedicated street or alley adjacent to the lot. On a lot bordered
on two sides by intersecting streets or alleys, the owner need ob-
serve the 30 foot height limitation along only one street and/or one
alley and shall have a choice of which to observe. Where an entire
half-block is occupied, the owner need only observe the 30 foot
height limitation along the street frontage having the greatest
horizontal dimension, as well as the limitation along the alley.
Where an entire block is occupied, the owner need only observe the
30 foot height limitation along the two street frontages having the
greatest horizontal dimensions. For purposes of this section, a
story shall be considered above grade if over 50% of its clear
interior height is above the established street grade as defined
in 11-1-9(1) Height Provisions."

The City Council of the City of Aspen, Colorado hereby
determines and declares this Ordinance to be necessary for the
immediate preservation of the public peace, health and safety,
and thereby declare that an emergency exists.
