Aspen Planning & Zoning
February 17, 1970
Meeting was called to order by Chairman Robin Molny at 5:05 p,m. with William
Tharp, Francis Whitaker, John Gilmore, James Breasted and Charles Vidal. Tom
Wells was excused. Jerry Brown, Consultant was also present.
Bavaria Park
Chairman Molny opened tLe public hearing relating to the
addition of land to Bavaria Park and its acceptance to be
included in the Master Plan. City Administrator Wurl sub-
mitted plats showing the land donated and map showing the
location relative to the City of Aspen. Also reported this
is the location for the swimming pool.
The following Resolution was read in full by Chairman
Molny:
RESOLUTION #7
Series of 1970
WHEREAS, the City of Aspen has been conveyed a
tract of real property, by way of gift, for use as public
park, which land is adjacent to Bavaria Park; and,
WHEREAS, The City of Aspen Planning and Zoning
Commission has been presented with a map of an addition
to Bavaria Park, attached hereto, for amendment to the
Aspen Area General Plan for the City of Aspen.
NOW, THEREFORE, BE IT RESOLVED that the Aspen Area
General Plan of the City of Aspen be amended to include
said tract of land as an addition to Bavaria Park.
Whitaker moved to adopt Resolution #7, Series of 1970 as
read in full. Seconded by Tharp. Roll call vote - Gilmore
aye; Whitaker aye; Breasted aye; Tharp aye; Vidal aye;
Molnyaye.
Hillyard Park
Chairman Molny opened the public hearing on the donation
to the City of Hillyard Park and its acceptance to be in-
cluded in the Master Plan. City Administrator Wurl reported
this property is located at the north side of Bleeker be-
tween Fourth and Fifth Streets. Further stated Mrs. Hillyard
donated the 4 lots - M, N, 0 and P. Map showing the park
location was submitted by Administrator Wurl.
Chairman Molny read the following Resolution #8, Series of
1970.
RESOLUTION #8
Series of 1970
WHEREAS, Barbara Johnson Hillyard has offered as a
gift to the City of Aspen, Lots M, N, 0 and P, Block 29,
City and Townsite of Aspen, for dedication and use ex-
clusively as a public park and as garden area for the en-
joyment of the citizens of the City of Aspen; and,
WHEREAS, the City of Aspen Planning and Zoning
Commission has been presented with a map for amendment
to the Aspen Area General Plan for the City of Aspen,
NOW, THEREFORE, BE IT RESOLVED that the Aspen Area
General Plan of the City of Aspen be amended to include
said tract of land.
Whitaker moved to adopt Resolution #8, Series of 1970 as
read in full. Seconded by Breasted. Roll call vote - Vidal

Ute Children's Park Ute Children's Park public hearing was opened by Chairman
Molny calling for the acceptance in the Master Plan of this
addition to the park.
City Administrator Wurl pointed out the location of the
park on the map submitted which is at the south side of the
park.
Chairman Molny read Resolution #9, Series of 1970 as follows:

WHEREAS, the City of Aspen has been conveyed a

Park; and
WHEREAS, the City of Aspen Planning and Zoning
Commission has been presented with a map of an addition to
Ute Children's Park for amendment to the Aspen Area
General Plan for the City of Aspen.
NOW, THEREFORE, BE IT RESOLVED that the Aspen Area
General Plan of the City of Aspen be amended to include
said tract of land as an addition to Ute Children's Park.
Whitaker moved to adopt Resolution #9, Series of 1970 as

Leased Parking
Space
Leased Parking Space - Chairman Molny opened the public
hearing and explained the hearing was called to delete the
option of leasing from private sources. Leased parking
from the City only.
It was pointed out that the required parking spaces would
have to be with the City, additional spaces could be either
provided on the premises or leased through private arrange-
ments.
Mr. C. M. Clark was present and stated he felt it would be
inequitable to have to lease from the City.
Mr. Whitaker pointed out the reason for this is to begin
receiving revenue from spaces and ear mark the funds for the
acquiring of land for parking or parking structure.
Mr. C. M. Clark questioned what would happen if private
enterprise wanted to come in and do this.
Mr. Wurl pointed out two problems, (1) when the City
Attorney approves the lease he is only approving the form
as to its legality, enforcement of the lease is another
problem when leasing by private arrangement. (2) availabilitj
of spaces by the City.
Chairman Molny pointed out with private arrangement leasing,
the ground can be used for anything but building.
Councilman Walls pointed out with private arrangement

Administrator Wurl pointed out to require parking on the
site, is the opposite of what we are trying to do with
pedestrian malls, Also to wait for private enterprise
may take a long time. This would not preclude private
enterprise from also providing parking spaces. Under project
pYiorties from the Council, the Planning and Zoning has
been asked to review the parking situation.
Whitaker suggest the Planning and Zoning do further work
on this prior to submitting a recommendation to Council/
James Breasted pointed out the ordinance creates a fund to
build a structure but at the same time enduces people to
put parking on their own land.
Councilman Walls stated he felt the leased parking has to be
in close proximity to the buildings which would be leasing
the spaces for it would for it would mean something. So a
distance ~hould be included in the recommendation.
Whitaker pointed out if you solve the problem in one area,
this will help allover.
Administrator Wurl stated if you settle on 4 locations you
cannot construct all of those at one time. Follow this
through and set a distance would require building them all
at the same time.
Tharp questioned how many spaces could the City make
available at this time. Administrator Wurl reported 19
spaces on land the City owns and could provide on-surface
parking.
Bob Stevens suggested the City not think about a structure
at this time, but provide the parking with on surface with
gravel and get the revenue coming in and work towards the
acquiring of land.
Adm!nistrator Wurl reported in working with Chairman Molny
on this, did come up with a recommended fee for guaranteed
spaces and a seperate fee for those which are not 6~aranteed.
Chairman Molny stated on site parking is a bad solution.
This requirement created building with holes on their lots
or constructing on the parking site or landscaping the
parking area. Also suggested giving the option of merely
paying a fee to the City. Charles Vidal reported this is
done, accepting pre-payment for the spaces when they are
ava::.lable.
Mr. Tha:cp suggested creating a parking district which
would include not only new buildings but the old as well.
Administrator Wurl stated he felt this would come about in
time, but this is not the time mainly due to financing.
Such a small percentage of the people downtown are residents
of the City to vote for such a district.
Bob Stevens pointed out the City has to find a solution to
the parking problem. There are many buildings that are non-
conforming relative to this requirement.
C. M. Clark suggested in the same ordinance provide for a
trade off whereby if you lease from private source. when
the Cities spaces are available you are not bound..,by the
present lease.

Chairman Molny closed the public hearing. Commission
agreed to table this item for additional study.
Chai.rman Molny read excerpts from an article to the
Boulder City Planning Board relative to zoning in general.
Density and
Open Space
Density and Open Space - Chairman Molny read the reco=
mmendations of C. M. Clark as stated in the hearing, also
read letters received from the following: Jerry Hewey,
Robert Stevens, and Dorothy Rutherford.
Councilman Walls stated the Planning and Zoning Commission
should think deeper into the proposals and question fi the
pLanning and Zoning will get the end result they desire
with this proposal. Does the Planning and Zoning under the
definition of open space really want the ground open from
the ground to the sky. The buildings built will reflect
what the ordinance entails. You need some flexibility as
well as control. This proposal rules out employee housing.
Planning and Zoning should consider the keeping of ice off
the streets. Whitaker pointed out the Aspen Square
building is set back 10', then got permission to cover it.

Mr. Walls stated he felt the purpose of density regulations
is to limit the number of people.
Jerry Brown questioned the following: (1) Under building
frontage it does not say how far back, (2) Definition of
building site, does this apply to total lot area. (3)
Question putting in the amount in the definition of floor
area ration; (4) Open space is short of a yard so do you
really need a definition fro open space. (5) Question
whether you want to change the 6,000 square feet under C-C
and C-l when we have 3,000 square foot lots, would be
creating non-conforming lots of ore cord.
Jerry Brown suggest keeping the density as it is in the AR-l
and reduce only the commercial density.
Whitaker moved to adjourn this meeting to Wednesday at 5:00
p.m. Seconded by Gilmore. Roll call vote - Gilmore aye;
Whitaker aye; Breasted aye; Vidal aye; Tharp aye; Molny aye.
