March 3, 1970
Meeting was called to order by Chairman Robin Molny at 5:05 p.m. with Francis
Whitaker, James Breasted, William Tharp. Tom Wells excused.
Minutes
Whitaker moved to approve the minutes of the Commission
of February 13th, 17th and 18th as prepared and mailed
by the Secretary. Seconded by Breasted. Roll call
vote - Whitaker aye; Breasted aye; Molny aye; Tharp aye.
Height of Fences
Chairman Molny opened the public hearing on height of
fences.
Francis Whitaker infomed the Commission this regulation
was left out in the drafting of the new zoning ordinance
of 1967.
Clayton Meyring, Building Inspector suggest the Commission
use the original regulation and just insert this in the
ordinance.
John Gilmore arrived.
Mr. Whitaker suggest including the C-2, C-C and AR-l at
the sametime with the requirement of 6' or 7' maximum
height of fences under supplementary regulations.
Mr. Meyring stated under the definition of a structure
that anything over 6' is considered a structure and would
have to abide by the set back requirements etc.
Whitaker moved that a draft ordinance be prepared cov-
eting the matter that has been discussed today and draft
ready by the next meeting for consideration. Seconded by
Tharp.
To clarify, Whitaker stated

Minutes, February 24th correction - Page 2, Paragraph 2 _
Charles Vidal stated he felt there may be a problem
in going out for a significant amount of funds to solve
this specific highway problem as it relates to again
at some future point and time going to the same types
of people for a significant amount of dollars to solve
our total planning problem. Just concerned that the fund
raising capability might be diluted by this dual activity.
Whitaker moved to approve the minutes of February 24th
as corrected, prepared and mailed by the Secretary.

Highway
Chairman Molny informed the Commission there would be
a public meeting at the Aspen Institute, March 4th
7:30 p.m. with Mr. Prosence of the State Highway Dept.
Chairman Molny opened the public hearing relative to
Highway 82 and its deletion from the Master Plan.
Chairman Molny outlined recent action of the City Council
rescinding the stand taken by the previous Council.
James Breasted questioned if in deleting this from the
Master Plan, would something have to be put in its place.
Mr. Whitaker stated no, and suggest we insert the
present 2 lane highway.
Francis Whitaker and Robin Molny to work on a draft
ordinance with the City Attorney.
Chairman Molny closed the public hearing.
Signs & Trademarks
Chairman Molny opened the public hearing on buildings
resembling signs or trademarks.
The following draft recommendation prepared for the
County was read by Chairman Molny:
I~ny structure, reproduction, facsimile, statue, or
device used or intended in whole or in part, for
advertising, promotion or identification purposes shall,
for the purposes of this resolution, be a sign and
shall be subject to applicable provisions of this
reso lution.
No statue, facsimile, or physical reproduction, or
advertising device or structure, except as may be within
permitted showcases, and window displays, shall be
installed, erected or used, except by approval of the
P & Z".
Discussed for example stained glass windows in churches
or the Crystal Palace being considered as a trademark
and at the sametime are acceptable. It was pointed
out there is a danger in the passing of ordinances
where you build in the granting of variances. It was
suggested the definition of a sign should be reviewed
and clarified.
Vidal to work with Chairman Molny on a draft ordinance.

Stream Margins public hearing was opened by Chairman Molny.

Stream Margins
Chairman Molny pointed out the Roaring Fork River
passes through all zones with the exception of C-l and
C-C. Mr. Molny suggest a set back be established
from the high water mark and read the recommendation
submitted to the County P & Z as follows:
'With the exception of crossing bridges, structures for
irrigation, drainage, erosion and flood control, water
diversion and stream regulation, no structures,
embankments or fills shall be placed so as to obstruct
or impede flows below the high water line of any defined
stream channel and no above ground structure shall be
placed closer than ten feet from the high water line of
a defined natural stream channel."
Mr. Molny also suggest that a bonus be built in so that
for every foot of set back you would be allowed
additional square footage in building area. Discussed
for what purposes the set back area could be used for.
Mr. Whitaker suggest investigation trail-right-of=way
and pedestrian easements. Further discussed how the
high water mark could be established, and it was felt
due to the change from year to year in this regard, this
should be left up to the discretion of the building
inspector. Hal Clark, County Building Inspector,
stated the County P & Z this date discussed a revision
on the set back for stream margins from 10' to 20'.
Breasted to work with Chairman Molny on a draft ordinance
on the basis of 20' set back and leaving this up to
the discretion of the building inspector as to the
cal culation.
Chairman Molny closed the public hearing.

County P & Z
Liaison Member
Chairman Molny asked for a volunteer as a liaison member
to the County P & Z. James Breasted volunteered.
Density, Open Space Resolution - Chairman Molny read the
draft resolution prepared by Attorney Kern. (See
Density & Open Space Attached)
Discussed whether the C-2 zone is included in this
draft ordinance. Chairman Molny to check with Attorney
Kern to see if the C-Z zone is covered.
Chairman Molny request all members review the draft
ordinance and phone comments to him.
Discussed Secti on 5, Page 3 as relates to dormitories
and changing this from 500 sq.ft. to 375 sq.ft.
Mr. Vidal reported in Snowmass they are requ~r~ng for
every 10,000 sq.ft., 100 sq.ft. per person be devoted
to employee housing.

Clayton Meyring suggest a definition of floor area be
included in this ordinance, this is not clear as to
whether this includes inside gardens, staircases or
balconies.
Discussed Barnard's proposal made at the City Council
public hearing relating to enlarging the C-C zone.
Commission request this be listed on the P & Z list of
committments.
Tharp moved to adopt Resolution #7, Series of 1970 as
read. Seconded by Vidal. Roll call vote - Whitaker aye;
Breasted aye; Tharp aye; Vidal aye; Molny aye.
James Breasted submitted a report on Planned Unit
Development.
Tharp moved to adjourn at 6:35 p.m., seconded by Vidal.

Series of 1970
WHEREAS, the Planning and Zoning Commission for the City of Aspen
has determined through reports and investigation a need to further
control and limit the densities in AR-l, C-C, C-l and C-Z zoned
areas within the City of Aspen; and
WHEREAS, the Planning and Zoning Commission for the Cityof
Aspen has determined a need to provide for open spaces within the
~ned areas of C-l and C-C of the City of Aspen; and
WHEREAS, a public hearing before the Planning and Zoning Com-
mission of the City of Aspen has been held in accordance with C.R.S.
1963, 139-59-8.
NOW, THEREFORE, BE IT RESOLVED by the Planning and Zoning
Commission for the City of Aspen that the '~ensity of Dwelling
Units", as outlined in the 1966 Aspen Area General P1anl; be amended
to provide densities as set out in the recommended zoning ordinance,
attached hereto.
BE IT FURTHER RESOLVED that the Planning and Zoning Commission
for the City of Aspen recommend to the City Council of the City of
Aspen the adoption of the proposed zoning ordinance, attached hereto,
requiring open spaces in C-1 and C-C zoned areas of the City of Aspen,
and changing density requirements and floor area ratios in C-1,
C-C and AR-1 districts within the City of Aspen.
