Regular Meeting
Aspen Planning & Zoning
March 31, 1970
Meeting was called to order by Chairman Robin Molny at 5:00 p.m. with
William Tharp, John Gilmore, Francis Whitaker and James Breasted. Tom
Wells excused.
Chairman Molny pointed out the pollution screening
device on top of the Little Cliff's Bakery roof.
Minutes
Minutes - Gilmore request the following correction:
"Commission would probably recommend an exception of
40' on the street requirements."
Molny corrected the minutes relative to the transporation
committee being one entire committee, those ecologically
oriented and others as named.
Whitaker moved
as corrected.

Seconded by Tharp. All in favor, motion
Environmental
Legislation
"An Act" was submitted by Chairman Molny to commission
members relative to establishing a national policy for
the environment, to provide for the establishment of a
Council on Environmental Quality and for other purposes.
Title XI - Supp-
lement
Title XI Supplement - Francis Whitaker suggest the
tabulation prepared by Jerry Brown be up-dated as soon
as possib le following the adoption of the ordinance on
density and open space. This should be done by either
the building inspector or City engineer.
Whitaker moved that after the Title XI is amended, that
this tab ulated form be brought up to date and included
as a supplement with each Title XI. Seconded by Tharp.
Charles Vidal arrived.
Roll call vote - Tharp aye; Whitaker aye; Gilmore aye;
Breasted aye; Molny aye; Vidal abstain. Motion carried.
Committments
Chairman Molny request the following be added to the list
of committements:
Supplement Title XI
North Side Annexation Street Plan
South Side Annexation Street Plan
Sneaky Lane Street Plan
Annexation Policy
priorities
Priorities - Chairman Molny read the list of priorites
passed down from the City Council. Breasted and Molny
to work out a total list of priorities combining the list
from Council and the list of committments of the P & z.
Annexation Policy - Whitaker to work on this.

Brownell Annex.
Chairman Molny opened the public hearing on the zoning
of the Brownell Annexation. City recommend the zoning
as outlined in the Master Plan.
Commission reviewed the Master Plan and the regu lations
relating to residential - medium density under the
zoning code as RMF. Commission stated they were
concerned with zoning of RMF as this zoning classification
provides for mobile trailer parks with approval of the
Board of Adjustment.
Whitaker moved the P & Z recommend R-6 for the Brownell
Annexation exclusive of Garrish Park which recommend
Park zoning. Seconded by Breasted.
Chairman Molny closed the public hearing.
Roll call vote - Vidal aye; Tharp aye; Breasted aye;
Whitaker aye; Gilmore abstain; Molny aye. Motion carried.
Street and alley vacations - Administrator Wurl was
St. & Alley Vacation present and outlined recent requests and future requests
for vacations. Request the P & Z set down some guide-
lines for recommendation to Council.
Whitaker suggest as a general policy on street and alley
vacations, P & Z recommend unless it can be shown that
their is no possible use to the City for right-of-way
or access or circulation - or that an exchange beneficial
to the Community can be demonstrated or arranged, such as
stream margins, open space etc., requests be denied.
Each proposal be carefully studied on its own merits and
P & Z would like the opportunity to study and recommend
on each request.
Whitaker moved this statement be sent as a general
recommendation to the City Council on street and alley
vacations. Seconded by Breasted. All in favor, motion
carried.
Annex. Policy
Annexation Policy - Administrator Wurl to give a
written recommendation at the next meeting.
Highway
Chairman Molny reported Breasted, Wells and Chairman
made the presentation to the County P & Z on the
highway as suggested at the last meeting. They did not
accept the proposal and re-affirm their previous
decision believed to be 4 lanes directly on to Main St.
by-laws
Chairman Molny requ~t the by-laws be amended during
the duration of the Charter Convention to require
regular meetings fall on Wednesday.
Molny moved for the duration of the Home Rule Charter
Convention, the P & Z by-laws be amended relative to
meeting time of the 2nd and 4th Wednesdays of the month
till the end of May, 1970. Seconded by Tharp. All in
favor, motion carried. - 2 -

Reg. Meeting, P & z, 3/31/70, continued.
Whitaker gave a report on the Planning Institute which
Planning Institute he had attended in Boulder. Commission request Mr.
Whitaker submit a list of the items discussed at the
conference in writing.
PUD PUD - Breasted moved the next regular meeting be a study
session. Seconded by Whitaker. All in favor, motion
carried.
Whitaker moved to adjourn at 6:15 p.m., seconded by
Tharp. All in favor, meeting adjourned.
