Regular Meeting Aspen Planning and Zoning Commission September 22,70 Meeting was called to order by Chairman Robin Molny at 5:05 p.m. with William Tharp, Irwin Harland and Victor Goodhard. Charles Vidal excused. Also present: Herb Bartel, Planner, Clayton Meyring, Building Inspector. Chairman Molny welcomed new member, Victor Goodhard, to the Commission. Tharp moved to approve the minutes of September 8th as prepared and mailed by the Secretary. Seconded by Harland. All in favor, motion carried. Re-Zoning Request MeadowsTlnstitute Re-zoning Request - Mr. Bartel submitted to the Commission a certified copy of the Pitkin County Zoning Map dated January 1963 outlining the zoning as existed prior to annexation to the City. A buffer zone appears on this map. Buffer strip is 100' and ISO' wide. Charles Collins and James Adams arrived. Discussed whether a distinction should be made between the First Aspen Company Subdivision and Second Aspen Company Subdivision and now appears on all maps as the Second Aspen Company Subdivision. Discussed back zoning the entire area in question and at such time as the Meadows/Institute present land descript- ions and plans proceed with the re-zoning of this area at that time. Mr. Woodward stated the Institute does agree with this action. Mr. and Mrs. Markalunas were also present and stated they had no objections. Mr. Woodward further stated, if Council is acceptable to this, the Institute will continue as soon as possible to present plans for the Meadows/Institute properties, available by the end of this year. Feel it will be better to plan for this area by reverting to the old zoning which existed for many years. Tharp moved to recommend to the City Council that the total package re-zoning request be returned to the previous zoning as shown on the Pitkin County Certified Map dated January 1963 using City zoning terminolgy. Seconded by Collins. Roll call vote - Adams aye; Tharp aye; Harland aye; Good- hard aye; Collins aye; Molny aye. Motion carried. West Aspen Co., Filing it2,Partit2 Annexation West Aspen Company Subdivision, Filing #2, Part #2 Annex- ation public hearing on zoning was opened by Chairman Molny. Commission reviewed Master Plan, previous County zoning and adjacent zoning, all indicating R-15 zoning class- ification for this annexation. Seconded by Tharp. Roll call vote - Collins ays; Goodhard aye; Harland aye; Molny aye; Tharp aye; Adams aye. Motion carried. Fence Regulations Fence Regulations - Clayton Meyring, Building Inspector submitted his recommendations for changes in Title XI. Recommendation included the criterbb for measuring fences where retaining walls are involved. Discussed design criteria and the purposes for which one might build a fence (privacy, esthetics to the property, etc.) Molny, Meyring and Goodhard to work out a proposal for the Commission's consideration. City Concerns The following concerns were stated and Commission request the same be so indicated to the County Planning and Zoning Commission by Mr. Bartel, Planner. 1. - Concern that a retail shopping center will be allowed which in turn would perhaps destroy downtown Aspen. 2. - Concern that i~ businesses are allowed, will set a precendent for additionl business classification requests along Highway 82. 3. - Do not feel neighborhood business areas that are incompatible should be allowed. 4. - Do not want to see decentralizing of the central business district. 5. - Shopping Center businesses would add to the traffic congestion in this area. 6. - Concerned about the appearance of this development from the highway and approach to Aspen. 7. - Concerned that incompatible uses may be allowed. (Light industrial, retail shopping center and residential.) 8. - Recommend light industrial be allowed only, to satisfy a community need. Mr. Bartel reported the County Planning and Zoning Commiss- ion has acted upon this plat as a final plat. Mr. Harland questioned if it is possible in an industrial area to build business if it is not precluded and can this be circumvented with PUD. Mr. Bartel explained that it could as a part of the zoning include a range of allowed uses under PUD. Construct acceleration-deceleration and turning lanes at the following instersection: a) Cemetery Lane b) Sterners Turnoff c) Buttermilk d) Airport e) Woody Creek 2. Improve Highway 82 from Original Street east to the City limits. A continuation of the Original Street cross section is recommended to the Cooper Street Bridge. East of the Cooper Street Bridge, a cross section compatible with the semi rural character of the area is recommended. Highway Designation Designate the road paralleling the Frying Pan River as a state highway. Planning Projects Independence Pass - evaluate alternative highway align- ments crossing the Continental Divide which will relieve traffic yolumes and thereby preserve the scenic and historic value of the pass. Commission request the following be added to the draft: lighting for the intersections as stated in #1; bus loading zones; pedestrian crossing at Cemetery Lane and Highway for school students. Mr. Bartel explained under Highway Designation the County has a problem with this road as there is a large amount of traffic which is not local in origin, plus there are three different counties involved. Further explained under Planning Projects we are looking at how to handle potential traffic over the Continental Divide in case the Highway Department does not have the authority to designate scenic highways. Mr. Harland stated the signs installed at the top of Independence Pass are unsightly. Tharp moved to submit the preliminary draft, plus Planning and Zoning's additions to the City Council. Chariman Molny read master list and explained each item to the Commission. Mr. Molny to prepare same for distribut- ion to Commission members.
