Regular Meeting
Aspen Planning & Zoning
June 24, 1969
Meeting was called to order at 5:15 p.m. by the Chairman with the following
members present:
Chairman George Heneghan
Mayor Robert Barnard
Robin Molny
Francis Whitaker
Norm Clasen
Excused:
Dale Mars
Councilman John Benninghoff (see late arrival)
Minutes - Norm Clasen moved to approve the minutes of
the last meeting as prepared and mailed by the Secretary.
Seconded by Barnard. All in favor, motion carried.
Row House or Townhouse - Mr. John Doremus was present
and stated he did not have any plans on this but would
like to discuss with the Commission the minimum of 25'
in the code for townhouses or row houses. Stated he
felt that this type of housing could serve a purpose
in low cost housing but there is apparently a problem
since there have not been any built since the ordinance
was enacted. The 25' minimum would call for 4 bedrooms
and rules out the 2 bedroom and moderate priced housing.
FHA does have financing for this type of housing.
Councilman John Benninghoff arrived.
Mr. Doremus explained that a row house or townhouse has
contiguous side walls, its a row of buildings 2 or 3
stories in height, small front yards and either large
or small back yards, no side yards. When buying the
house you buy the land underneath the house.
Mr. Doremus stated he did not know the total implications
of ownership and financing as relates to condominiums
vs townhouse or row house.
Commission request Mr. Doremus look further into this and
if in researching finds sufficient difference, to come
back to the Commission.
Capital Improvements - Mr. Whitaker submitted a list which
had been prepared by Mr. Whitaker and City Administrator
Wurl showing groups of categories. Stated these are
the items which should be incorporated in the Master
Plan as a modification to the Master Plan. (See list
attached)
Councilman Benninghoff stated some of these items are
under the RSA so would need approval of the County also.
Mayor Barnard pointed out he could not see holding a
public hearing on the items listed that have already been

initiated by the City.
Whitaker made a motion that the Planning and Zoning
start with a public hearing on the capital improvements
all the way through as far as we can go inone evening
and if needed additional hearings be held.
Whitaker withdrew his motion.
Molny moved to obtain a legal op~n~on upon whether a
public hearing is required. Seconded by Barnard. Roll
call vote - Molny aye; Whitaker aye; Heneghan aye;
Barnard aye; Clymer aye; Benninghoff aye.
Legal Opinions - Whitaker moved that when the Commission
requests a legal opinion the Chairman be authorized ;to
meet or negoiate with the City Attorney or that the City
Attorney be authorized to attend the meeting when a legal
opinion is needed.
Mayor Barnard pointed out it would be very expensive
for the City to have the City Attorney attend planning
and zoning meetings at $35.00 an hour when perh?ps a
legal opinion is not required. Also state d it is seldom
that an attorney can give an instant opinion without
researching first.
Whitaker withdrew his motion.
Clasen made a motion that the Planning and Zoning write
a letter to the City Attorney requesting his presence
at the next meeting and outline the following reasons -
we ate not clear on the process of receiving legal opinions
and question of the time limit. Seconded by Barnard.
Roll call vote - Benninghoff aye; Clasen aye; Barnard
aye; Heneghan aye; Whitaker aye; Molny aye.
Highway 82 location - Chairman Heneghan stated he felt
a study session should be held on this plus transportation
in general which would take into consideration parking,
malls, transit system etc. Also stated he liad received
many telephone calls on Planning and Zoning's recommendatiol
as relates to the location of Highway 82.
Mayor Barnard stated the City Council acted on the
strength of P & Z's decision as relates to Highway 82.
Further stated if the P & Z reconsiders this and sends
another recommendation to the State Highway Department
this is going to confuse the highway separtment.
Roger Mahnke, City Engineer, stated the Master Plan guide-
lines for Highway 82 is in on Main Street. Street Improve-
ment districts were laid out along these lines. Feel that
in the future we may need a by pass route. A by pass
will cost a substantial amount of money to obtain the need-
ed right of way.

Planner - Discussed what can be done since assistance
from the State will not be forthcoming in the very near
future. Letter from James Miles of the State Planning
office was read by Chairman Heneghan.
Molny made a motion to hold a study session on planning
programing next Tuesday night at 7:00 p.m., seconded by
Barnard. Roll call vote - Benninghoff aye; Clasen aye;
Barnard aye; Heneghan aye; Whitaker aye; Molny aye.
Clasen made a motion to have City Administrator Wurl
send a letter to James Miles answering the questions
outlined in his letter. Seconded by Molny. All in
favor, motion carried.

Barnard moved to adjourn at 6:35 p.m., seconded by Molny.

various items into categories. The numbers indicate the
suggested priority of the various categories.
I feel the Master Plan should be revised to include the items
with an asterick.
