Regular Meeting
Aspen Planning & Zoning
August 12, 1969
Meeting was called to order by the Chairman at 5:10 p.m. with the following
members present:
Chairman George Heneghan
Robin Molny
Francis Whitaker
Dale Mars
Absent:
Mayor Robert Barnard
Councilman John Benninghoff
Norman Clasen
Minutes
Motion was made by Whitaker, seconded by Molny to
approve the minutes of June 24th and July 15th as
prepared and mailed by the Secretary. All in favor,
motion carried.
Bleeker St.
Re-zoliing
Re-zoning request - Attorney Oates was present represent-
ing Paul Saurel and Max Marolt and request the feelings
of the Commission of initiating re-zoning of the south
side of Bleeker from Mill to 6th from R-6 to AR-l which
would allow higher density and lesson the non-conforming
uses in that area. Mr. Oates stated it seemed more
logical to have a break in the zoning by a street rather
than the alley.
City Engineer Mahnke suggest chaning the zoning to RMF.
Mr. Whitaker stated he would be reluctant to set a
precedent of initiating zoning under these circumstances
and also would be against the zoning as outlined in the
Master Plan.
Commission agreed not to initiate this change in zoning.
Legal Opinions
Legal Opinions - Chairman Heneghan stated to the City
Attorney that the Commission is concerned in that they
are not getting their legal opinions which have been
requested.
Service Yards
City Attorney Kern stated he did not submit a written
legal opinion on service yards as the definition of such
already existed in the zoning ordinance. Mr. Whitaker
stated the building inspector is still not that clear
on how to interpret the definition such as trash
containers. Attorney Kern to discuss this with the
building inspector.
Subdivision-County
Street plans for subdivisions outside City limits but
within the 3 mile radius. Commission questioned what
can the City do if a street plan does not exist.
Attorney Kern stated although the County did not adopt
the major street plan in the Master Plan, the City did,

Mr. Kern referred the

Procedures for obtaining legal op~n~ons to be discussed
by Mr. Heneghan, Mr. Kern and City Administrator Wurl.
Commission questioned City Attorney Kern if a public
hearing is required on additions and amendments to the
Master Plan. Mr. Kern stated this is required.
Mr. Kern stated he would write a formal request to the
County Planning and Zoning requesting all subdivision
plans within the 3 mile radius of the City be presented
to the City Planning and Zoning.
South Side Annexation Street Plan - Mr. Whitaker outlined
the plan as prepared by the Engineering Department.
Committee recommends the Commission request the City
Engineering Department draw and submit a larger scale
map with explanations, the Commission review the plan
and travel the site.
Molny made a motion to have the City Engineering
Department draw up a larger scale map on the proposed
street plan with brief notes of explanation. Seconded
by Whitaker. All in favor, motion carried.
RSA - Molny reported he had attended the RSA meeting
and they had agreed to provide in their respective
budgets for a planner and staff.
Electric Stop Lights - Mr. Mars commented that the City
needs electric stop lights in order to control the
traffic. Mr. Molny stated the State feels that stop
lights cause more collisions. Mr. Whitaker stated he
felt that an officer on duty at certain times of the
year and at certain locations could handle the situation.
Discussed the $500 in the 1969 budget for professional
services which has not been expended. Suggestion was
made to have Trafton Bean work on the traffic entrance
to the City, traffic in general and the re-zoning request
made by Attorney Oates.
Chairman Heneghan to discuss this with City Administrator
Wurl.
Commission request Planning Assistance appear on the
next agenda.
Molny moved to adjourn at 6:05 p.m., seconded by Whitaker.
All in favor, meeting adjourned.
