Regular Meeting
Aspen Planning & Zoning
October 27,1969
Meeting was called to order by Vice Chairman Molny at 5:15 p.m. with Mayor
Robert Barnard, Councilman Benninghoff, Francis Whitaker, Dale Mars, Norm
Clasen and Michael Garrish - new member.

Signs
Non-Conforming Signs- Building Inspector Meyiring was present
and reported letters have been sent to about 22 persons requesting
the removal of their signs. Approximately 4 or 5 have complied
to date although the time limit stipulated has not elapsed.
Clasen suggested the building inspector with sign permits attach
a copy of the code relating to the design of signs.
Commission agreed this was an enforcement problem and a problem
for the building inspector. Attorney Hodges was present and
representing Irene Taggert who had received a letter. She does
not desire to remove her sign that she has had for 20 years and
reluctant now when she is on the fringe of selling her business.
Service Yards - Barnard reported we are making headway there has
been a fence installed between the Fire Station and Isis Theatre
Service Yards and also next to Design Primarily. Discussed the type of
fencing used and construction yards.
Mr. Garrish reported next to his property there is a fence which
is a sight and also the owners are installing a septic tank
less than 100' from his well and recommend that when a fence
is constructed it meet the code.
Whitaker made a motion to set a public hearing to revise the
definitions and regulations of service yards, construction
yards, junk yards and include regulations in the C-C zone.

Street Plan
NSA
Major Street Plan - N.S.Annexation - Whitaker made a motion to
instruct the City Engineer to proceed with a preliminary plan
and recommendations for a major street plan for the North
Side Annexation. Seconded by Mars. Roll call vote -
Garrish aye; Benninghoff aye; Barnard aye; Whitaker aye:
Clasen aye; Mars aye; Molny aye.
Mr. Garrish stated the Planning and Zoning Commission should
take another look at the zoning from the hospital area over
to Midland Avenue.
Whitaker made a motion to obtain a legal oplnlon from the City
Attorney on the validity of the City zoning on the North Side
Annexation. Seconded by Clasen, Roll call vote - Clasen aye;
Barnard aye; Mars aye; Benninghoff aye; Whitaker aye; Garrish
aye; Molny aye.
Sewer Study
Regional Sewer Study - Barnard made a motion to schedule a public
hearing on November 25th to consider including the Regional
Sewer Study in the Master Plan.

Commission request Admin. Wurl handle representation of Parker
and Associates to attend the next meeting of the P & Z and
also the public hearing.
Street Names - Admin. Wurl submitted to the Commission a list
Street Names of street names arrived firom mining claims in the area.
Suggestions were made that streets could be named after trees
in the area and composers. Commission requests Norm Clasen
work with the Historical Society on this.
Vice Chairman Molny request buildings that look like signs be
placed on the next agenda.
Election-
Chairman
Election of Chairman - Vice Chairman Molny opened the
nominations for Chairman. Dr. Barnard nominated Michael Garrish,
seconded by Mars. Whitaker nominated Robin Molny, seconded
by Clasen. Whitaker moved that the nominations be closed,
seconded by Clasen. All in favor, nominations closed.

Mr. Garrish stated he would be glad to accept the position
but would like to make clear from the beginning that he would
not tolerate anyone on the Commission trying to benefit
themselves by being on the Commission. The laws of the
Planning and Zoning will be applied to all citizens.
Whitaker moved to adjourn at 6:15 p.m., seconded by Clasen.
All in favor, meeting adjourned.
