AN ORDINANCE OF THE CITY OF ASPEN CITY COUNCIL GRANTING MAJOR
PUBLIC PROJECT REVIEW AND RELATED LAND USE APPROVALS FOR THE
PITKIN COUNTY AMBULANCE DISTRICT FACILITY LOCATED AT 403 CASTLE
CREEK ROAD ON THE CAMPUS OF THE ASPEN VALLEY HOSPITAL, LEGALLY
DESCRIBED AS: LOT 1, PARCEL A, THE ASPEN VALLEY HOSPITAL DISTRICT
SUBDIVISION, ACCORDING TO THE PLAT THEREOF RECORDED AUGUST 30,
1989, IN PLAT BOOK 23 AT PAGE 34 AS RECEPTION NO.314687 AND AMENDMENT
THERETO RECORDED JULY 25, 1991 IN PLAT BOOK 27 AT PAGE 6 AS RECEPTION
NO. 334895, CITY OF ASPEN, COUNTY OF PITKIN, STATE OF COLORADO.

WHEREAS, the Community Development Department received an application for the
land use review of a new ambulance facility (the Application) from Pitkin County on behalf of the
Ambulance District (Applicant) for Major Public Project Review ; and,
WHEREAS, all code citation references are to the City of Aspen Land Use Code in effect
on the day of initial application—January 3, 2018, as applicable to this project; and,
WHEREAS, this property is located in the Public (PUB) zone district; and,
WHEREAS, as a governmental agency, the Applicant has requested this Application to
be reviewed as a Public Project, pursuant to Chapter 26.500.030 of the City of Aspen Land Use
Code; and,
WHEREAS,the Community Development Department referred the Application to Aspen
Consolidated Sanitation District, City Engineering, Building Department, Fire Protection District,
Environmental Health Department, Parks Department, Aspen/Pitkin County Housing Authority,
Public Works Department, and the Transportation Department, and received comments as a result
of the Development Review Committee meeting; and,
WHEREAS, said referral agencies and the Aspen Community Development Department
reviewed the proposed Application and recommended approval with conditions; and,
WHEREAS, all required public noticing was provided as evidenced by an affidavit of
public noticing submitted to the record, a summary of public outreach was provided by the
applicant to meet the requirements of Land Use Code Section 26.304.035, and the public was
provided full access to review the Application; and,
WHEREAS, the Planning & Zoning Commission reviewed the Application at a duly
noticed public hearing on April 3, 2018, during which the recommendations of the Community
Development Director and comments from the public were heard by the Planning & Zoning
Commission, and recommended approval with conditions by a vote of five to zero (5 — 0).

WHEREAS, City Council has reviewed and considered the development proposal under the
applicable provisions of the Municipal Code as identified herein, has reviewed and considered the
recommendations of the Community Development Director, the Planning and Zoning Commission;
the applicable referral agencies, and has taken and considered public comment at a public hearing;
and,
WHEREAS, on April 9, 2018, the Aspen City Council approved Ordinance No. 9, Series
of 2018 on First Reading by a five to zero (5 —0) vote; and
WHEREAS,during a duly noticed public hearing on April 30,2018 City Council approved
Ordinance No. 9 Series of 2018, by a three to zero (3 — 0) vote, approving Major Public Project
Review,
WHEREAS, City Council finds that the development proposal meets or exceeds all the
applicable development standards; and,
WHEREAS, City Council finds that this Ordinance furthers and is necessary for the
promotion of public health, safety, and welfare.
NOW, THEREFORE BE IT ORDAINED BY THE CITY OF ASPEN CITY COUNCIL AS
FOLLOWS:
Section 1: Approvals
Pursuant to the procedures and standards set forth in Title 26 of the Aspen Municipal Code, the
City Council hereby grants the Pitkin County Ambulance District facility approval of the following
land use approvals, subject to conditions identified below in Section 2:
• Major Public Project review; 26.500
a Subdivision. Minor Amendment: 26.480
e Planned Development, Project and Detail, Combined review; 26.445
Y 8040 Greenline Review; 26.435
• Parking and Transportation Management, Special Review; 26.515
The proposed project includes the construction of a new ambulance facility and the reconfiguration
of adjacent parking and multi-modal circulation. The approved dimensions are described below in
Section 4.
Section 2: Conditions of Approval
The ambulance facility is subject to the following conditions of approval:
1. The Applicant shall submit for review an amended plat within 180 days of approval (and
prior to any permit submission).
2. The Applicantshall submit for review within 180 days of approval (and prior to any permit
submission) for review, an Approved Plan Set, pursuant to Land Use Code Section
26.490.040.D, that includes the following plans:

• Planned Development Project and Detail Review
e Architectural Character Plan
• Illustrative Site Plan
• Landscape Character Plan
• Existing and Proposed Site Topography and Drainage
• Public Infrastructure Plan (for parking lot and related circulation)
3. The Applicant shall submit, for review by the City Attorney, a development agreement
within 180 days of approval (and prior to any permit submission) that satisfies the
requirements of Land Use Code Section26.490.050.
4. The existing Ambulance Facility, when vacated by the Ambulance District shall be
included,for evaluation of future employee generation, in the required employee audits for
the Aspen Valley Hospital.
5. A building permit shall not be issued unless the project is in compliance with policies and
codes as currently adopted and amended per Title 8 (Building and Energy Codes) of the
Aspen Municipal Code.
6. The approved project at building permit issuance shall satisfy the requirements of Title 29,
The City of Aspen's Engineering Design Standards—including but not limited to approval
of required plans (including the Urban Runoff Management Plan.)
7. The Level 2 Transportation Impact Analysis from 2012 conducted for the redevelopment
of Aspen Valley Hospital submitted by the applicant is accepted. The following are the
TDM/MMLOS mitigation requirements for the project:
• On-site mobility and access improvements, including a raised
crosswalk, a sidewalk bisecting the new parking lot, and a connector
ramp between the parking lot and the loop road pedestrian walkway.
• Appropriately sized bicycle parking, and upgraded trash/recycling
facilities at the on-site RFTA stop.
• Already completed concept design work and continued Pitkin County
participation in efforts to reconfigure RFTA circulation as it relates to
Castle Creek Rd., Doolittle Dr., and the existing RFTA bus stop.
8. The applicant will work with City Environmental Health staff to design and implement a
compliant trash, recycling and compost enclosure.
9. The applicant shall request from the Aspen Consolidated Sanitation District, Commitment
and Conditions to Serve Letters and will work with ACSD to identify the most appropriate
sewer service option for the new facility.

Section 3: Employee Generation
City Council has reviewed the project as an essential public facility pursuant to Land Use Code
Section 26.470.050.C, and has determined that the applicant's current calculation of 13.96 FTE at
the existing facility will remain consistent in the proposed new facility. The Applicant shall
provide an employee audit to the Aspen Pitkin County Housing Authority (APCHA) prior to
issuance of a Certificate of Occupancy (CO) to confirm current employees and again at five (5)
and ten (10) years following issuance of a CO. Additional subsequent audits may be requested at
the discretion of APCHA. Any additional employees generated, as shown in any future audit, shall
be subject to the provision of affordable housing mitigation pursuant to the provisions of the City
of Aspen Land Use Code.
Section 4: Planned Development - Approved Dimensions
The following dimensions are approved for the amended subdivision/Planned Development:
Min. Lot Area: 2.871 acres Min. # of Off Street Parking Spaces: 57
(to be verified with amended Plat)
Min. Front Yard Setback: 10 feet Min. Side and Rear Yard Setbacks: 10 feet
Min. Lot Width: 115 feet Max. Height: 33 feet
Max. Height of Accessory Structures:12 feet
Maximum Floor Area of Floor Area Ratio for parcel: 0.5:1
Ambulance Facility: 13,000 square feet
Maximum Floor Area of New Accessory Building
Trash, Recycling and Storage: 620 square feet
Specific Approvals
1) Up to a 10% increase of the Floor Area of the ambulance facility may be approved
administratively for development that does not increase the mass or scale of the approved building.
2)On the ambulance facility, there is no height exception for roof top mechanical equipment. Any
necessary top of building mechanical equipment shall be internal to the roof structure.
3) Two retaining walls located in the front yard setback are approved: 1) an L-shaped wall in the
Northeast corner of the parcel is necessary to retain grade for the parking lot improvements; and
2)a wall that retains the hillside of the west side of the parcel,adjacent to the stair is also approved.
(See Site Plan in Exhibit C)
Section 5. Improvements to Existing Trail
The County and Aspen Valley Hospital shall enter into a multi-year primitive trail easement that
depicts access to the site from an existing trail that connects to the Twin Ridge Subdivision to the
west. The easement shall be depicted on the recorded amended Plat. A staircase that is proposed
to connect to the trail is depicted on drawing for this project, but is located on an adjacent parcel.

change (the addition of the stairway and related retainage) to the Aspen Valley Hospital Planned
Development.
Section 6•
All material representations and commitments made by the Applicant pursuant to the development
proposal approvals as herein awarded, whether in public hearing or documentation presented
before the Community Development Department, the Planning and Zoning Commission, or the
Aspen City Council are hereby incorporated in such plan development approvals and the same
shall be complied with as if fully set forth herein, unless amended by other specific conditions or
an authorized authority.
Section 7:
This Resolution shall not affect any existing litigation and shall not operate as an abatement of any
action or proceeding now pending under or by virtue of the ordinances repealed or amended as
herein provided, and the same shall be conducted and concluded under such prior ordinances.
Section 8•
If any section, subsection, sentence, clause, phrase, or portion of this Resolution is for any reason
held invalid or unconstitutional in a court of competent jurisdiction, such portion shall be deemed
a separate, distinct and independent provision and shall not affect the validity of the remaining
portions thereof.
