Regular Meeting Aspen Planning & Zoning September 24, 1968 Meeting was called to order by the Chairman at 5:20 p.m. with the follow- ing members present: Chairman William Tharp Francis Whitaker George Heneghan Dale Mars Absent: Mayor Robert Barnard - excused Councilman John Benninghoff - excused Yvan Tache - unexcused Also Present: Building Inspector William Kestner Chairman Tharp request the Secretary notify the press, City Administrator and all members of the Commission of special meetings. MINUTES Whitaker made a motion to September 9th and special Heneghan. Roll call vote aye. approve the minutes of the regular meeting September 13th as mailed. - Mars aye; Whitaker aye; Heneghan meeting Seconded by aye; Tharp BUILDING REVIEW Little Bavaria Remodeling Mr. Rob Roy was present and stated the plans call for a new exterior face and adding a tower as a ymbol. Commission reviewed the plans, no problems. recommend approval to the building inspector Little Bavaria. Seconded by Whitaker. Roll Whitaker aye; Mars aye; Tharp aye. Heneghan made a motion to of the remodeling plans for call vote - Heneghan aye; Low Cost Housing - Esco It was pointed out this would include 42 low cost housing rental units located between Cooper and Hyman on the west side of the Roaring Fork River, some limited and some unlimited units. Commission reviewed recommend approval low cost housing. Heneghan aye; Mars the plans, no problems. Heneghan made a motion to to the building inspector on the plans for Esco of Seconded by Mars. Roll call vote - Whitaker aye; aye; Tharp aye. Garage - Esco Garage in the C-2 Zone located by the river. Whitaker pointed out there are no curb cuts shown on the plans. Representatives from Esco pointed out there is not a street there but there is access through Rio Grande property to this property, although nothing was submitted given Esco authority to use this access. Whitaker pointed out without access a permit cannot be issued for any build ings. Commission agreed an op~n~on should be obtained on the status of the property as far as access goes. Secretary instructed to obtain this opinion, Earl Schennum - Wall It was reported a stop order had been issued since this wall~or fence was not shown on the plans when they were approved. Chairman Tharp stated he would take it as a special favor that when Mr. Schennum submits plans to the Planning and Zoning they be complete. Do not add to your plans until you go through the proper procedure. Whitaker stated every time Mr. Schennum comes before the Commission there is a problem with his plans. Heneghan made a motion to recommend approval to for a wall for Mr. Schennum. Seconded by Mars. n~y; Mars aye; Heneghan aye; Tharp aye. the building inspector Roll call vote - Whitaker Joseph Herezeg - Addition to apartment It was pointed out the addition would include a bathroom and porch. Commission reviewed the plans and they were all in order. Heneghan made a motion to recommend approval to the building inspector of this addition. Seconded by Whitaker. Roll call vote - Heneghan aye; Mars aye; Whitaker aye; Tharp aye. Garage and Warehouse - Natalie Gignoux Mr. Ted Mularz was present and stated this would be located down near the Martin Bishop garage. First level would be used by Mr. Bishop, second level for leased storage space. Also replied that he had more than complied with the fire code, 4 hours on the 1st floor and 2 hours on the second, cinder block building. Commission reviewed the plans, no problems. Heneghan made a motion to recomend approval on the garage and warehouse to the building inspector. Seconded by Mars. Roll call vote - Mars aye; Whitaker aye; Tharp aye; Heneghan aye. Aspen Ski Corporation - Underground fuel storage tanks. Mr. James Adams reported they would like to put 2 - 1000 gallon storage tanks underground with 2 pumps above ground for their own use. Meeting, P & Z, 9/24/68, continued. Mr. Adams reported the pumps above ground could be hid on 3 sides. Commission request the Secretary obtain a legal opinion on this request. CORRESPONDENCE Commission request the Secretary follow up on the request for a legal opinion relating to the carrying of a vote when a person abstains. Legal opinion from Attorney Kern relating to the Continental Inn was read in part by Chairman Tharp. Height to be measured from Dean Street. Secretary reported Mr. Cantrup of the Continental Inn had obtained approval on the height from the Board of Adjustment on Friday. Whitaker questioned the qualifications of Yvan Tache on the Commission since the change in the by-laws and Tache being an employee of the City. Commission request the Secretary obtain a legal opinion on this. Signs - Heneghan made a motion to instruct the City Administrator to take whatever steps necessary to deal with the non-conforming signs. Seconded by Mars. Roll call vote - Heneghan aye; Tharp aye; Whitaker aye; Mars aye. Building Review - Discussed recent action by the City Council to eliminate building review from the Planning and Zoning. Whitaker stated he has changed his mind in that building review has been helpful to the Commission in locating problems in the zoning code. Better informed in what is happening. Mars stated he felt to put the responsibility in one persons hands would be too much. Should be a board of some kind. Whitaker made a motion that the Commission go on record of retension of the building review before the Planning and Zoning Commission. Chairman Tharp stated Mr. Whitaker is asking the Commission to reverse its decision and recommendation to the Council. Feel at this point would be a better thing to appear before the City Council. Seconded by Mars. Tharp aye. Roll call vote - Heneghan aye; Whitaker aye; Mars aye; Mr. Tharp request review before the of doing so. to go on record that he agrees with retensinn of building Planning and Zoning but does disagree with this method Whitaker and Mars to handle plan checking for the next month. Chairman request a special meeting be called when the legal opinions are bo tained. Whitaker made a motion to adjourn favor, meeting adjourned. at 6:25 p.m., seconded by Mars.
